And now to baltimore, where the Police Commissioner said in an exclusive interview he was surprised to learn six officers would be charged in the death of freddie gray and the Police Commissioner is trying to assure the community that a change is coming. Loretta lynch was in baltimore today meeting with Police Officers and city officials and Community Leaders and freddie grays family in a private meeting. She said what she heard is how people how people in baltimore are committed to improving the relationship between the police and the community n. A minute well hear from a Law Enforcement officer who said this was about revenge and appealing the mob but we have an exclusive interview with the commissioner since the death of freddie gray. Tell me about your feelings when the state attorney was going to bring charges last friday. I found out what the state attorney was going on and present about 10 minutes before she was going on. She gave me a phone call and told me about what she was going to do and told me about the charges were. What were the first words out of your mouth when you heard that. I dont want to get into that so much. Like i say, i was probably surprised by the information that i heard. Then my mind started going to what is going to be the response in the community and what is going to happen in the community and i went to what is going to happen with my officers. Did you have an agreement ahead of time you would get more notice . In previous situations like this you usually give police some notice so you can be prepared for whatever the Community Reaction would be . I had one meeting with states attorney and her executive team and executive staff and she sat down and shared with me she was concerned with the amount of information going on and she wanted to limit that and she heard me give a News Conference that we are limiting the information coming out of that meeting. And i want to be as transparent as possible but the states attorney has to try a case and they have concerned with the level of information that comes out and i have to strike a balance and the balance is trying to give as much information as we can without impacting her case as she has to go forward. I had pretty close to 45, 50plus employees on this case. I pulled them off of homicide cases, i pulled them off of robbery cases and put this task force together with my lab, personnel. We brought out our Training Staff and we put a lot of work into this case. And my focus was not just and i dont have the luxury just to focus on what happened inside of that van, the booking van. I have to answer questions of what started on that officers day and what every one of the officers did, what were the gaps and fill in the blanks so my 40plus task force were focused on getting the entire complete story. So you have 45, 50 employees, my understanding, 30plus crime investigators who are focused on this on this case and then to have them usurped by another officer doing an independent investigation, from what i understand they have four investigators doing this what does that feel like for your employees . If they do with four what we did with 40, they are good at doing what they do. I know you want to rebuild trust with this community and how do you plan to do that . It is clear that i stepped on ground here today that there is lack of trust in our community in certain parts of our community and weve been trying to do that with day one by being trans parent and to be open transparent and to be open when we make mistakes. And the freddie gray case is what to you . An aberration, something that sets you back . No. But every metric you set a Police Department on and we are heading in the right direction. There is a lack of trust, period bottom line and that will take healing and not just here as a Police Department but the problem as a whole, that weve been part of the problem. Anderson what you hear from the commissioner there is between the lines. Hes talking about the fairness of his Police Investigation and hes making a contrast with what many people say was a hasty decision by the state attorney to bring charges against the six officers and hes drawing a contrast between the two cases, aernd. Evan in your interview, are you saying the states toernl only had four investigators on the case because she said from day one they had investigators and you are saying they only had four investigators working on it . She had four investigators leading the case and a few other staff. But in comparison to what the police threw at this case she had 40 or 50 people working on this from day one. What he was trying to say is they had a thorough case and drawing a contrast with what she had done. And there is also now a couple of interesting things that have come out. First of all, two of the names in the that the states attorney put out, i guess in the charging documents, were incorrect and they were actually the wrong persons names. And i also understand now one of the officers is disputing in court saying that the night that the arrest that the knife that freddie gray was, in fact krar carrying was illegal, and wants it released so they can show that. And that is the difference between the two investigations the state investigation and the one commissioner batts was doing it. And when the states attorney spoke across the street here saying that the knife that freddie gray was carrying was not illegal according to her in the state of maryland. However the Police Department said that the knife violated the city code. So what you see the officers now trying to do is draw a distinction between the two cases and the two investigations are ongoing and that is just the beginning of what the state attorney will have to face in her case. I appreciate the interview. Joining me now Milwaukee County sheriff and also sunny hostin is friends with the mayor of baltimore and mr. Toobin. And now you see two of the names were wrong in the documents and you saw that Marilyn Mosby offered these officers up as sack official lambs. Can you explain what you mean. When you rush to decision you can see and i think this will unravel and you can see the problems you have. The brilliant scholar alan shesho witz said that this was political and overrushed and done for mob control and i concur and she has a right to charge these individuals and has to prove it beyond a reasonable doubt. But when she went down that political rabbit hole and made claims of i hear the voices young people it is your time no justice, no peace, those arent legal terms those are political statements and i said these officers are Political Prisoners and i stand by that. I investigated with a team of investigators that investigated 400 homicides and ive never had a criminal complaint issued on a homicide case and im talking about a standard one not as complex as this within 24 hours and i dont care she had some investigators parallel and alongside. These things are have volumes of reports, evidence has to be gone over. She should have taken her time before she made this decision and she did not. Jeff toobin what do you think about that . My friend makes a good case against this prosecution. However, freddie gray woke up healthy on april 12th and he was dead by noon and the only people he was with for Police Officers. So the idea that he was dead as a result of a crime makes a certain amount of sense. Whether she should have investigated longer and whether the crimes will stand up in court, well see. And it is important to say well see. And she may be right. And sunny, youve raised concerns about the speed of this and arent regular people charged with crimes like this this fast all of the time . Not necessarily. Especially when you talk about a complicated crimes and i have raised concerns about the haste in terms of bringing the charges. I had concerns on the day it was announced because i heard her say things i heard your calls for justice and peace and prosecutors cannot take the city demands into consideration and most of the times we bring cases despite and in spite of what the citizenry wants and so i was concerned about some of the statements that she made. And i am a bill concerned about the fact that the coroners report was given to her merely 24 hours before she made filed those charges because that is the linchpin of this case that autopsy report. And i dont think she would have had the time to have independent experts review the coroners report. But to jeffs point, were talking about a young man who was otherwise healthy, who ended up dead with a severed spine after being in police custody. So the fact that something criminal happened is probable. But i just do have some concerns about the speed within which she decided these charges. Sheriff, the fact that the states attorney only gave the Police Commissioner a 10 minutes heads up what do you make of that . How would you feel about that if that was the case. Extremely problematic. And usually you are alongside the commissioner and it would be my job as the lieutenant to keep my superiors informed and 10 minutes is extreme. And you dont get a doover, when you make mistakes like this early on you never get a chance to recover. That wasnt miss mosbys fault and she should get it right but like allen der sh witz said she was more concerned with quieting down the masses and the angry mob about doing this thing right so that the right ending occurred. Something happened to freddie gray and i dont know the facts of the case but that doesnt mean that the Police Officers had anything to do with it or that there was criminal intent for the charge of seconddegree murder or manslaughter. Well i actually think the lack of communication was a good thing, not a bad thing. Remember in ferguson everybody was concerned that a that a prosecutors investigation of the police they were too close together. They were they were ordinarily teammates. This was basically an adversarial process where you had a prosecutor deciding whether a Police Officer should be charged. I think a certain amount of distance and a certain amount of the prosecutor clearly being in charge was a good thing. But, jeff you dont believe politics played a role the desire to bring calm to the city played a role . I dont know. I dont know. And i think we will learn that as the facts are unfolded. Look it was i certainly thought it was very fast. I understand why people are criticizing. These early mistakes long the wrong like the wrong names on the forms seem like undue haste.
