Soil for the first time in years. Their plane in the air as we speak. It left from qatar a bit ago and President Biden has spoken to each of their families, families that soon will be reunited with loved ones in washington after so long. These are the five u. S. Citizens who are freed. Two have not been publicly named. As part of the deal five iranian nationals were released by the u. S. , and 6 billion in iranian funds were made available strictly for humanitarian use. Bertrand is here with us. Natasha, how did this deal come together . Really, the administration has been trying to get these americans released from iranian prison since they came into office. Some have been all of them have been held there over five years, one for nearly eight years. Clearly something that was a high priority for them, but it really started to take shape, the deal itself, for the last six, seven, eight months. Thats when the administration began to negotiate with the iranians in qatar, notably not facetoface. The qataris served as intermediaries for the talks, and last month we saw the beginning of the movement when a couple of americans were moved to house arrest and the Secretary Of State issued a waiver that would allow the 6 billion that you mentioned to be transferred to qatar to be used for humanitarian purposes as a request of those funds. Now, the Secretary Of State, he is already preempting the backlash we have heard already from republicans, from critics of this deal by saying that these funds were never to exempt, of course, being used for humanitarian purposes. The u. S. Does not levy sanctions to punish the people of the governments, under the governments that the u. S. Is trying to punish here. Here is what he said in remarks earlier today. From day one our actions have clearly and indeed always exempt the use of resources for humanitarian purposes because our aim is not to harm the iranian people. Our problem, our profound problem is with the iranian regime. The funds were removed to another bank where we have absolute oversight of how theyre used and they can only be used for humanitarian purposes. Now, notably, the administration has really tried to emphasize here that the fundamental relationship between the u. S. And iran has not changed. The u. S. Is still going to try to hold the iranians accountable and they still consider them a terrorist state, but it remains to be seen how iran is going to react following the announcement earlier today of new sanctions targeting Irans Ministry of intelligence as well as the iranian president. They may not take kindly to that, especially after they believe these kind of humanitarian gestures between the u. S. And iran can continue. We will have to see how it plays out. I want to bring in cnn White House Correspondent kayla tausche. C kayla, the administration has been clear, it does not turn the page on the u. S. iran relationship. Case in point, announced new sanctions. Reporter thats right. In fact, Senior Administration officials discussing the deal have said this will not be the last sanctions under the levinson act that the u. S. Will be placing. The question though, given the fact this week is the u. N. General assembly, whether the u. S. And iran will be talking this week. The administration has said in no uncertain terms, absolutely not, noting that any diplomatic discussions would continue to be held through intermediaries like qatar and like oman with the administration giving particular thanks to The Sultan Of Oman for his role in some of these talks. Now, of course, the deal is not without its criticism. The fact theres 6 billion in funds that will be freed up from overseas Bank Accounts for iran have drawn criticism of gop president ial candidates like former Vice President mike pence, who said this will allow iran to foment terrorism. Senior Administration Officials have said they believe there are Enforcement Mechanisms in place and the risk of diversion for iran to use the funds for anything other than humanitarian purposes is low, but they are continuing to keep a very hard line on the country, even as they acknowledge this deal done through humanitarian challenges is a big win for diplomacy. So biden, of course, is there in new york for the u. N. General assembly. I think it will be part of a bigger approach but it remains what that bigger approach is. The u. S. Hes suing the agency claiming that two of the whistleblowers leaked Confidential Information to the public and he suffered, quote, staggering harm. This comes days after the president s son was indicted on three felony gun charges. Cnn has been following this. Tell us what this lawsuit claims and who it targets. Reporter hunter biden is suing the irs today for the actions of two of its agents, Whistleblowers Gary Shapely and joseph ziegler. They are alleging they went beyond what is permitted under the Whistleblower Laws and disclosed Confidential Information about Hunter Bidens tax returns. Disclosing Confidential Information is illegal. It is a very highly protected part of the u. S. Law, and when people are not allowed to learn other peoples tax information. They are saying they went beyond what was permitted by giving a series of media interviews. In one of those interviews to cbs over the summer, gary shapely is discuss evening with the reporter how hunter allegedly used personal expenses as Business Expenses on his tax return. Take a listen. There were personal expenses that were taken as Business Expenses, prostitutes, sex club mem memberships, hotel rooms for purported drug dealers. Reporter in that interview he says hunter biden he owed the irs 2. 2 million. Thats what he is suing over, saying that information was confidential and shuntouldnt h been disclosed. They are insisting it is a Smear Campaign and they did not go beyond what was permitted as whistleblowers, so theyre both pushing back on that. The irs says they will not comment on pending litigation, jim. What exactly is he suing for here . Reporter biden is suing for damages and asking for 1,000 for every disclosure of Confidential Information. They are asking for attorneys fees and they want documents and records relating to the transmission and the release of any of his Confidential Information. So looking here, theyre looking to get a little bit insight what was going to the irs, what safeguards were around these documents and who asked for them and how it was disseminated within the agency, jim. Caris can el, thanks so much. A federal judge in atlanta said he will decide soon whether Jeffrey Clark can move his case from state to federal court. The former dojo official is indicted over his efforts to help President Trump overturn the 2020 elections in georgia. Clarks attorneys argue he was acting on behalf of the federal government. Cnns Katelyn Polans is live outside the courthouse in atlanta. Did the judge give any indication of where he will side . Reporter he didnt although he had tough questions for Jeffrey Clark and his attorney. One of the things that happened that was so crucial in this hearing and may be crucial when the judge does rule here is that Jeffrey Clark, he wasnt here. He tried to submit a declaration of what his role was at the Justice Department for donald trump after the election and it was not accepted by the judge. Thats a bad sign for Jeffrey Clark because it was on him and his team to prove what he was doing for donald trump after the election, wanting the Justice Department to send a draft letter to the state of georgia that prosecutors say had actual inconsistencies in it and totally outside of his authority, he was going to have to prove it was something that was in his responsibilities as the acting head of the Civil Division at this time. He doesnt have that sort of evidence he is able to submit now, and so instead we heard from jodie hunt, someone who served in that role in the Trump Administration before who testified that, no, this wasnt part of his job about the oversight of the election and to even work with the president. One really interesting thing that came up in this hearing is that clarks attorney, harry mcdougal, he argued not even in the oda would it be possible if he wasnt a federal official. Moreover, not just he was a federal official but that donald trump was directing him to do the things he was doing after the election and gave him authority at the Justice Department. That too, boris, did not result in any evidence coming into court today. We will have to wait and see what the judge does with what was argued today. Katelyn polantz. Jeffrey clark attempting to move the case from State Court To Federal court. Does clark have an additional chance of getting this successfully moved . Look, his argument is this was an issue right before the Justice Department, the question of whether federal election law was certified in these elections. He is trying to make the case it was part of his job. The problem is he was the acting head of the Civil Division which has almost nothing to do with the election, maybe civil rights. Unusual for the Civil Division which handles lawsuits against the u. S. Typically to be involved in such a matter. Hard argument to make. Former Department Official jodie hunt made that point and hunt was the head of this before clark took it over. I assume that testimony must be somewhat influential. Joudie hunt would know. I think it is going to carry a lot of weight with the judge as to whether Jeffrey Clark was acting in his official capacity. Lets talk for a moment about the principle codefendant in all of this, foremmer President Trump. He gave a wideranging interview over the weekend and, of course, as he often does commented on the case. He said it was his decision to believe that the 2020 election was rigged. My understanding of his defense was in part he was listening to his lawyers advice. By saying it was his decision it was rigged, does it threaten their defense . Thats an example why lawyers tell their clients not to talk to the press. He is getting himself in trouble. He is saying that he listened to a lot of people but he decided. He is trying to make his defense of counsel argument but doing it in a way that could cause problems down the road. It is not a good look for him as a client, as a defendant. This is why you want your cliept scl client to stay off of television, donald trump cant help himself. It is a statement against interest by a defendant. It can be brought in. It is not going to be, you know, it is himself. He is saying himself on television. Hard to know how it plays out. The United Nations is revising its estimated death toll from the catastrophic floods in libya. It is now believed just under 4,000 people were killed nationwide. Thats a major drop from a Previous Report on saturday that put the death toll at more than 11,000 in the city of derna alone. Obviously it is still a very large death toll. The revised estimate says more than 9,000 people are still missing, and that is a huge number as well. This is coming as the rapidly escalating Health Crisis in libya with contaminated water and sewage exposing residents to serious risks. We have cnn joumanna joining us from libya. What can you tell us about the conditions the libyans are facing right now . Reporter well, brianna, more than a week since the catastrophic event in the city of derna, and you still have thousands of men, Women And Children who are unaccounted for right now. You have the sure you have people sitting by the sea looking for loved ones, hoping that the waves will wash back the bodies of their loved ones because people are telling us all they want are the bodies so they can bury them because the thousands are now presumed dead. It is not an easy task to try to recover these bodies. We have been speaking to rescue teams here on the ground in the city. You have teams that have been working on the different sites that really look like a bomb site, the aftermath of an earthquake as you have seen in these pictures. You have these searchandrescue teams, some international teams, nowhere near enough to deal on this scale. You have libyan volunteers using everything from their bare hands to go through the rubble of these homes to try to find bodies. Officials are telling us the majority of these bodies, thousands of them ended up in the mediterranean. They say it is such a challenging task for them, something theyve never dealt with before. They say they believe there are thousands of bodies in the sea, but theyve not had enough manpower, enough equipment to deal with a Recovery Effort on this scale. It is very difficult to navigate the waters around the shores here of derna. One team says that they did spot 300 bodies just a few days ago but they were not able to recover them. They say right now these bodies are Diss Intereintegrated Remai they wont be able to recover. You can imagine how devastating this is for the families who just want those bodies to bury, just a final farewell for their loved ones that they might not be able to get right now. What we are seeing tonight as well is that grief, that Shock Turning into anger as well. We have seen hundreds of derna residents protesting in the heart of the city, in one of the most devastated neighborhoods there. Thats the derna valley where you saw those floods over a week ago. They are demanding accountability. They are saying they want officials held accountable for what happened because they say it is not just a natural disaster. This was compounded by years of negligence, neglect, corruption and mismanagement and they want officials held accountable for what happened. We certainly are beginning to see the anger. Yes, this, of course, precipitated by Dams Collapsing and collapsing into heavily Populated Areas where perhaps people should not have been living. They certainly should not have been living. The scale of this, jumaane, you are one of the few journalists for a western outlet who is covering this from the ground, how far reaching is this in terms i mean everyone in derna i imagine, entire families were swept out to sea but everyone must know someone. This is touching everyone in this city. Reporter and it is not just derna, brianna. This is libya. It is a large country but a very small population, a very interlinked population. A lot of people have family from derna. They feel linked to this. It has been something that has hit the entire country so hard, and we are talking about for the past ten years it has been divided between east and west, a civil war where you had City Fighting city. What we have seen since is you have this outpouring for the city, cars coming in, volunteers from different parts of the country, putting their differences aside, coming together, united in their grief and their attempt to try to help the people of derna in the absence of Real Functioning State here. People feel that they want to try to do whatever they can to assist this devastated city and its population. The Human Suffering here is just unimaginable. I mean you are talking about a third of the city according to estimates that has been destroyed, and we are talking about erased. We are talking about historic old neighborhoods. You mentioned entire homes with the families washed into the scene. This is the level of devastation. It is just so you know, you look at it and for me i have covered natural disasters before. I still find this incredibly shocking to look at. The Human Suffering of the people, they dont even know how they are going to recover from this, brianna, with the state of libya right now. We would be out filming and you just look at peoples faces and you can see theyre still shell shocked. You have people Walking Around in the streets, walking past you sobbing, carrying whatever they could salvage of their belongings if they were able to get into what is left of their home. You have people who are still searching for the missing. We have spoken with people who have lost their entire family, men who have lost their wives, their children, their brothers. I mean you talk to people and they list the number of people theyve lost and it is usually 20 and 25. Now they just dont know what to do next. How do they find them . Some people were Still Holding on to the hope that they might be alive, but right now that hope is fading. As we are hearing from officials, as we are hearing from rescuers, those thousands of missing men, Women And Children, up to 10,000, are right now presumed missing, absolutely devastating. Yes, the numbers, the magnitude of the loss for derna and for the country of libya is astounding. Thank you so much. Military is asking for your help in trying to find an f35 fighter jet that went missing on sunday near charleston, South Carolina in what theyre describing as a mishap. So how did this happen . The military isnt really offering too many details, only that a pilot was able to safely eject and was taken to a local hospital. The planes location though remains unknown as Joint Base Charleston says anyone with information should immediately reach out. Cnn pentagon correspondent Oren Lieberman has been tracking this story. Military cant find one of its own fighter jets, but it looks like exactly what happened here. On sunday afternoon a marine corps f35b fighter jet was flying over South Carolina when something happened during this flight and the pilot ejected, as you pointed out. The pilot landed safely. He was taken to a local hospital. He is stable according to the marines. The question, what happened to his jet . Take a look at this graphic from flight radar 24. This is the ongoing search for the jet which has multiple aircraft including from the Civil Air Patrol and the military looking for this over a fairly large swath of South Carolina. Sort of north and northwest of charleston, it looks like it has expanded more up towards myrtle beach as planes zigzag back and forth in a search pattern looking for a fighter jet. A Lockheed Martin f35b lightning 2, a 100 million jet. It goes about mach 1. 6 so it is a supersonic jet, a Fifth Generation Fighter and costs about 42,000 an hour to operate. That leads to the question, well, where is it . Another Jet Operating with the jet during the mission returned safely and yet the search is ongoing for this f35. The key question here that Congress Woman nancy mace asked on twitter or x as this was going on, and it is a question i think all of us are thinking, she asks, we know the f35 was stealth by this is ridiculous. Earlier she said, how in the hell do you lose an f35 . How is there not a Tracking Device and were asking the public to, what, find the jet and turn it in . As of now the answer to that question is yes. Thats exactly what the military is doing, asking for the Publics Health in finding this f35. The search area doesnt look like it has been narrowed down at all. The part thats supposed to help you track the jet is a transponder. It is unclear if it was or wasnt working, if it was turned on or off, and how much fuel was left that could have kept this plane going essentially after the pilot ejected. Investigators are looking into the cause of a deadly crash at the National Championship air races and air show in reno, nevada. Two pilots identified as nick macy and Chris Rushing were killed. Organizers are said to be cooperating with the ntsb and they cancelled the remaining races. This is actually not the events first fatal crash. A pilot was killed last year in a plane crash there and in 2011 11 people were killed when a plane veered Out Of Control and actually crashed into spectators. Also, nine teenagers who escaped from a juvenile Detention Center in pennsylvania have been captured. The teens fled after a riot at the Detention Center. All nine will be charged with escape, riot and aggravated assault. The juvenile facility is 15 miles west from escaped Murder Convict Cavalcante was captured on monday.
