U. S. Intelligence Community Leaders are there. You will hear from them. This is really significant. Despite the president s claim just in december that isis is defeated in syria or nearly so, the intel leaders are warning that that is not the case and that the terror group still commands thousands of fighters in iraq and syria and those fighters quote very likely will continue to plot against the u. S. We cannot overstate how significant that is. Le that is really big. This is just the beginning. Reporter this is just the beginning and a much different tone from National Security leaders than from the president himself and the remarks about isis significant given what the president has been saying over and over again that isis is essentially defeated and that is one reason why u. S. Troops need to come out of syria just to give a sense of what dan coats, director of nationally intelligence just said. He did say isis commands thousands of fighters in iraq and syria and maintains eight branches and thousands of dispersed supporters around the world despite significant leadership and territorial losses. So that is not the message that we are hearing from the white house and certainly not the message the president has delivered in the aftermath of the decision last month to announce a withdrawal from troops from syria. So these divisions i think will become more pronounced as the hearing goes on and question the National Security leaders. That was a significant piece of news at the on set of this hearing that is just starting here. Its become a consistent pattern, as it not, where the Intelligence Community contradicts the president s campaigns. The president in june last year said there is no longer a Nuclear Threat from north korea. Youre hearing from the director of National Intelligence here that in fact that is just not true. What is he saying . Reporter this was also another remarkable bit of news at the beginning of this. He said there are four Major Concerns for the u. S. Globally. He said china, laid out concerns about russia much starker than he has about talking about iran. He talked about north korea. The president said that north korea would completely denuclearize. The president has been rosy about the outlook about north korea. While they have halted testing, he said it is clear that north korea has no intention of giving up weapons of mass destruction. Here is what he said. We currently assess that north korea will seek to retain its wmd capabilities and is unlikely to completely give up its Nuclear Weapons and production capabilities because its leaders ultimately view Nuclear Weapons as critical to regime survival. Our assessment is boles administered by our observations of some activity that is inconsistent with full denuclearization. While we assess that sanctions on exports have been effective and largely maintained, north korea seeks to mitigate the effects of the u. S. Led Pressure Campaign through diplomatic engagement, counter pressure against the sanctions regime and direct sanctions evasion. Reporter so, again, that is a much different assessment than what we have heard from the president since his meeting with kim jongun last year. Afterwards he tweeted that the world is much safer, that north korea has essentially agreed to denuclearize. That is not the view of the president s own Intelligence Community, his own director of National Intelligence saying they wont give up their weapons of mass destruction, there is no sign that they will. You ignore the Intelligence Community on the assessment about interference of the election, ignoring it is consequential. We have a lot of news this morning. At the d. C. Federal courthouse, roger stone will be arraigned at the top of the hour here. We have sarah murray i believe at the courthouse now. What do we expect to see today as this happens . Reporter so we are waiting for roger stone here at the courthouse. He will be arraigned here in d. C. He is facing seven charges from obstruction of justice, witness tampering, lying to congressional investigators. We are expecting him to plead not guilty. We are getting interesting news from Matt Whittaker predicting the end of the mueller probe. Listen to what he said. I have been fully briefed on the investigation. I look forward to director mueller delivering the final report. But right now the investigation is i think close to being completed. I hope that we can get the report from director mueller as soon as possible. Reporter obviously that comment raised a lot of eyebrows because we have heard next to nothing from the department of justice about the timeline for muellers work. There is another indication that the idea that it is wrapping up may be relative having to do with Andrew Miller challenging a subpoena for grand jury testimony as well as muellers authority. His lawyers heard they are pursuing the testimony. That is an indication that the government could be pursuing more indictments and more charges against roger stone in the future. We know you will keep us up to date. Cnn Law Enforcement analyst for the Great Southern district of new york. For folks at home having trouble keeping track of all of this stuff, you have the acting attorney general say yesterday this thing is close to being wrapped up. There has been a lot of theorizing about that. Then you have a defense attorney for Andrew Miller who worked for stone being told that the special counsel wants his testimony. What does that mean . Is it close . I dont think so. The phrase close to being wrapped up or close to complete is completely relative. Does it mean we are two weeks away or six weeks away . Something people need to understand, criminal investigations dont just end like you are running a race and you break the tape. They carry on as far as the evidence and the facts dictate. I have had cases of my own i thought i was close to done and i didnt announce it terribly. Something new breaks. If you watch the clip it looks like he panics. He doesnt have a way to wrap up. It could be i need to update the public. I think we have seen that making comments on pending investigations is only problematic. Once you go down that road it is really hard to turn back. I think he will regret that. I do wonder what the impact of a superseding indictment could be on all of this with roger stone and Andrew Miller. What is the actual sort of real effect . Every indictment stands on its own. Even if mueller declared tomorrow im done, we have roger stone. He was just charged. Look at the loose ends that we know about. Roger stone, that case just started. It will take months to get that to trial or a plea. Maybe he coop rates. We have Paul Manafort needs to be sentenced, michael flynn. They need to be sentenced. We have open matters in the Southern District and the district of d. C. We have state attorneys general. We have the subpoena battle and on and on. Im a little skeptical. We have to be patient again. You have been around the Justice Department for quite sometime. The attorney general says he has been fully briefed on the investigation. That is his right. He is overseeing the investigation. He has not recused himself. Based on your knowledge of how things work, would we expect that he has briefed the president on the status of the investigation and perhaps given him some proprietary information about what the investigation has learned . I hope not. That is the fear when whittaker was brought in on the scenes, is he in place to end the Mueller Investigation or constrain it or serve as a source of information for the president on the status of this ongoing investigation. What we run afoul of here is this norm that there is separation between the white house and the Justice Department on any investigation. If the acting attorney general was given a heads up on what to expect that would be highly appropriate. And i would say about the panic, if he did make a mistake, if he said this thing was close to being wrapped up and that was a mistake it is incumbent on him to correct that mistake. This is possibly the most highly charged political investigation that we have seen. So if he is signaling the certain element to the population even accidently, he has to clean that up. Separately, but potentially consequence for the president is Michael Cohen agreeing to behind closed doors testimony with the House Intelligence Committee on capitol hill. Its going to happen next week, potential a public hearing. The significance of that knowing that he lied to congress before . And the most important thing that lawmakers will want to learn from Michael Cohen . They are giving him a mulligan here. They want to know the truth about the questions that they have asked. The House Intelligence Committee we have seen has been highly politicized. You have the investigation being conducted. You have the factions fighting with each other on the committee. At the end of the day the public and investigators need to know what the information is, what is true. And if Michael Cohen lied to them or any other wins lied to them, at the end of the day they need to know the facts. These overseers need to get to the bottom of what happened just as much as Robert Mueller does. One thing that is invest is the house intelligence hearing. It is interesting to see whether the House Intelligence Committee gets to hear what Michael Cohens hearing. Thanks as always. Still to come, a really significant new pole a long way out. That courthouse, i spent countless hours inside there as an investigator sitting before a judge, trying to get them to approve certain investigative activity. One thing that is so interesting is this is the one place where the president s bluster where roger stones bluster, none of it actually matters. In this court of law, this is where we are going to find out what actually happens, what consequences roger stone will face. We have the arraignment today and are far from a trial. That is so fascinating to watch that here you have elements of our own government that are trying to appeal to the court of Public Opinion. None of that is going to matter inside of that building. What will be interesting for us is what this judge does with respect to roger stones ability to continue to speak out, to continue to do the press conferences. Judge Amy Berman Jackson is a very impatient person. We have seen in the past that there is no question that she will seek to limit ones ability to go out and do interviews if that impacts an investigation. At the end of the day, i think it comes down to this. If the shenanigans taking place in the court of Public Opinion will impact her court of law then she will put a stop to that very quickly. We will wait to see what comes of this arraignment and what parameters are set and then for the larger investigation what does this mean . Does this mean that there will be additional investigative activity that investigators will want to seek as far as roger stone . Will he actually testify . Will he provide information that is helpful to the investigation . We know publically he has been very defiant. That may change once he finds himself sitting inside that courtroom. The that is true. That announcement hot off the heels of a phone call between President Trump and House Speaker nancy pelosi. We are told the pair spoke about infrastructure. They did not talk about the wall which still remains at the crux of negotiations to fund the government by february 15. If no deal is struck, another shutdown is possible. This as a brand New Washington post poll shows 53 blame President Trump and congress for shutdown. Joining me now is democratic senator bob casey of the keystone state of pennsylvania. I should note however that you have democratic colleagues including members of this new 17member Bipartisan Panel that will negotiate this including jon tester of montana who said he would be willing to give money for a wall. Would you vote for or against the compromise bill that would include money for an actual physical barrier on the border . What i want to vote for i think is what people in both parties want to vote for which is effective Border Security. That has to be the test. As yo u. U know, the comprehensi immigration bill which i hope could be the direction we move in which is a comprehensive solution to a broken system, not simply Border Security. That bill spoke directly to developing a plan that would involve fencing, infrastructure and technology, fencing, infrastructure, technology. That is what the experts tell us we should do to really secure the border. That has to be, i hope, the focus of the negotiators. It sounds like if you are including fencing, a barrier the president says doesnt have to be a concrete wall, it sounds like you will vote for a bill that has a comprehensive solution that includes a physical barrier, fencing included. Similar to what i already voted for. The president has insisted on a wall. Whether here wants to deny it or not, he has said repeatedly not just wall but he is talking about a concrete wall. I know he backed away from that. Lately he says it doesnt have to be a wall. Lately he says it doesnt have to be a concrete wall and it doesnt have to be from sea to shining sea. If a deal comes to you that includes some money for a physical barrier, a fence, not a wall, would you vote yes . I have already voted that way. Fencing is different. A wall should not be confused with Border Security. No serious expert would recommend a wall, even the most ardent supporters of a major Border Security initiative would not make the case seriously that a concrete wall would be the answer. We do need to focus on the ports of entry which is where most of the drugs are coming in. Commissioner and head of border withdrawal has said he would hope we can invest in that because in terms of sea containers, cargo and vehicles, that is where the drugs are coming in. You want to stop drugs you have to spend money on that kind of infrastructure. Fair point. We have had officials on air who made that point. I want to ask you on another issue that will come before you for a vote, that is the president s nominee to be attorney general bill barr. In followup answers to the Senate Judiciary committee, he said he had not committed to releasing the full report making it public.
