This is not the first time that the officers have found themselves in trouble with the law. Cnns Martin Savidge has more now. Reporter marksville, louisiana where as the water tower says everybody is a somebody and the somebody everybody here is talking about is 6yearold Jeremy Mardis killed in a blaze of bullets fired by two deputies during a chase in his fathers car. How could it happen . If according to some, this small town has big problems. Its a whole lot of things that is wrong. Its sad that it took a six years old boy for them to come and see what is really going on down here. And its just not right. Fingers point to the deputy marshals. Derek stafford and norris greenhouse jr. Stafford is a Marksville Police officer and the mayor says he has had conflicts with him. I tried to talk to the previous chief about it. And you know, nothing was done. Reporter so has patrick who says that officer stafford had him arrested for complaining about him. I made a complaint to the Sheriffs Office and later on they heard it over the radio and a Police Officer arrested me for disturbing the peace. Reporter he pseudo. It is one of five lawsuits that name stafford as a defendant. In another suit a mother accuses the officer of restraining her teenaged daughter so forcibly on a school bus the girl had to be treated at a hospital for an injury to her arm. All of the suits are still pending. We reached out to staffords civil attorney who said that i will not be making any comment about the pending litigation involving the city of marksville or its employees. Then the criminal activity. Whatever the previous allegations, of course none of them explain what Everyone Wants to know why did a pursuit that night end with an unarmed man critically wounded and his 6yearold son sitting beside him dead . And don, that is the real question that so many people in this small town want to know and the problem for them now is that a judge issued a gag order in the case. None of the participants can speak. So until this gets to a trial, if we get to that point, many people are going to be wondering for some time to come without answers being provided. Wondering what is going on. What i want to know right now, what is the status of these two officers . Well, they both have been charged with Second Degree murder and attempted Second Degree murder. They have been given a 1 million bond each and transported to a facility outside of this parrish. But the father of norris greenhouse was able to make arrangemented for his son. And by the way, his dad, he is the assistant d. A. In this parish. He would normally be pursuing major crimes. The d. A. In this parish had to recuse himself from this case because of the family connections in this case. Thank you, Martin Savidge, great reporting there. I wanting to bring in Steven Mcintosh. He is suing the officer. Lets get right to it. Good evening to you, Steven Mcintosh talk me back to 2013. You were leaving a citywide fourth of july swrags. Tell me what happened. As i was leaving the parade i stopped by another friend to talk with him a while and we heard a loud commotion. We head over to the commotion and a young man was arrested and they had him on the ground. And the cops come out of nowhere and shooting pepper spray and telling people to leave. In the process i dropped my keys and was going to pick up my keys and the officer told me to leave i said i dropped my keys and trying to leave and he just threw me down on the ground and handcuffed me and another cop came and jumped on me. There were three or four of them on me. Tell me about your injuries. We have photographs, and you have an injury to your head. What injuries do you say you sustained . When officer stafford shot pepper spray on my face when i was handcuffed on the ground on my stomach. You were charged with resisting arrest. And did you know why you were being arrested . Did they tell you . No, i didnt. And they didnt say anything . No. Never told me i was under arrest or nothing. Go ahead. They never told me i was under arrest. Just handcuffed me and that was it. Mr. Mcintosh did you have a prior history with officers stafford or greenhouse . No. So when you heard the story of the shooting that officer stafford and greenhouse were involved with with Jeremy Mardis and his father, chris few, what did you think . I was real shocked about the situation. But being that the guys they were, you would expect Something Like that. What are people saying there about that shooting . How are people feeling about it in the community . A lot of people thats upset about it. Wondering why the 6yearold got shot. Go on. They want changes . What . Do they want changed . To do people there want things to change when it comes to the Police Department . Oh, yes. Yes, they do. Mr. Jordan, to you know, what did you think when you found out that this case involves two of the same officers that you were already dealing with . First of all i want to give my condolences to the mardis family and the few family for their loss. You know, don, i was surprised in a sense because there is a distinction between certainly tasing somebody and pepper spraying them as egregious as that is for no reason at all and shooting a car 18 times. But on one hand i was not that surprised. In our case we could see there is a total lack of training in this department. So from that standpoint, this is just a further example of the lack of training that this department has displayed. I will ask you then with the allegations like the ones in your cases that you have and some of the others that are surfacing now after this one, what things could the department have done differently . First of all, they could do better training with these officers, don. In the case of mr. Mcintosh and the kid he was talking about, that is part of the greenhouse family, they are related to this officer that has been arrested. Even in that case, don, i think youve seen those pictures, they threw this young man down and beat him for no reason. This kid was 14 years old and didnt search him for a weapon or a cell phone. The photos that i sent to you showed the kid handcuffed with his camera phone taking a selfie of the injuries that he had. I mean, you know, its just no excuse for the lack of training that this department has. Edmund jordan, i appreciate that. I thank you. And i also thank mr. Mcintosh as well. Please keep us updated. We appreciate you giving us context to the stories happening there. I thank you, don. And i just want to make one comment, don. In our case they did not have body cameras, in this case they did. I think it shows the need on the local, state, and federal level that we need the body cameras. There are good officers out there. And they dont mind the body cameras. And in this one, the dash cam video, the body camera video is not being released at this point because and when cant do a freedom of information request for it because louisiana is not a sunshine state. We will not know until this goes to trial and we dont know when that is going to happen. We reached out to the police because of these ongoing investigations and lawsuits. They are not commenting on this. But we will continue to follow this story. When we come back, a jaywalking arrest gone wrong and caught on camera. Is there more to the story than meets the eye . Matthew to you first. Tell me what happened that night. We were leaving the bars at closing. It was about 2 15 or so. I was walking my friends to our uber that we had just ordered. When we get to red river street, thats when we see bike cops sitting on sixth street on their bicycles. And we noticed that there were the light was about to change and there were no cars coming so we decided to all walk against the signal. And thats when officer yell at us to stop and no one stops because we are in the middle of the street. And when we step on the sidewalk they yell at us to come here and nobody comes there. So thats when the video starts. So this is a report that i have. This must be lordis. Police flashed their flashlights at us and matt and jeremy said foff noting that the street was barricading so the crime of jaywalking was a moot point. What was your interaction before did you have any sort of interaction with them before and is that accurate about saying foff and . No, thats not accurate at all. What happened was when they told us to come over here, me and jeremy were having a private conversation and he looked over to me and said, you know, no, were straight we dont need to go over there, to me. And you know, thats i guess thats what set them off, you know, kind of i think it was, you know, just, like, us being deninety of not wanting to come over there to them instead of them coming to us type of situation. And thats when they dropped their bikes and run over the us. Lulu, i want you to this is a bystander. Yelling at the officers. Listen. What are you doing to him . Taking him to jail. For what . Crossing gwen the light. Why do you think this happened . Do you think it was just because of jaywalking . I dont know of what happened before but this seems like an overreaction for just jaywalking. Correct. It was more than an overreaction. It was incorrect. Why do you think it happened, lordis . We have been contemplating that for a few days and we cannot come with an exact reasoning or what have you as to why we were treated that we. The only rationale i can think of is that they were they were upset that, you know, we were breaking the law, one, and that we knew that it wasnt a very serious situation and we were kind of defiant in the way of, you know, the group of people that we were walking with all decided to cross the street and i think they just, maybe they just needed to make an example of a couple of people to show their, you know, power. So you admit that you were breaking the law. But you just think it was Excessive Force for the infraction that you were committing. I want to read here, guys what the austin Police Department stated. As is standard protocol the chain of kmant will review the response to resistance and the incident to determine what led up to the events captured in the video. What do you want to happen . We are waiting. They have spoken on a different case. We are still pending. Its easy to pull up the rule of conduct. What is the holdup and what more is there to investigate . You know, its article eight about how their conduct is supposed to be in arresting violators of the law. And it is complete opposite of what our situation that happened on last friday morning was. Police are in the spotlight tonight amid questions about possible use of Excessive Force. Joined by riva martin and a retired new York City Police detective. We talked about the two incidents. Let talk about the first tragic case of 6yearold Jeremy Mardis gunned down by two Police Officers in louisiana. Its unclear what happened. Both officers have been arrested and charged with Second Degree murder. What do you think went on her, harry . Until we can see the videotape that the officers were wearing there, it looks like this is an unjustified shooting based on the information today. The head of the state police said it is one of the worst things he has ever seen. You have a man who is not armed. Police officers. We dont know why they were chasing him. You do not shoot at a vehicle that ewe are chasing unless that person is shooting at you which was not occurring at this time. Did they know that boy was in the vehicle also . If they knew the boy was in the vehicle its even worse. There is no justification for any of it . None. The body cam video has been called very disturbing. It is a new addition to the Police Department. Do you think without that evidence this case would have moved this quickly . Not at all, done. What we know about this cases is before body cams and before citizens with their video cameras and cell phones, it was the word of the policeofficer against the person who was shot. In this case it would have been this father who was in Critical Condition and this deceased little boy. We wouldnt have gotten the story, the way we got it, because of the body camera, and i think we have to thank the protesters who became so engaged after the ferguson shooting and made the issue of body cams a National Issue and we see Police Departments starting to use them and its having a powerful impact on these shooting cases. Lets talk more about this little boy. Not about the new video that is up now. They were arrested for jaywalking in austin. Harry, you see where it gips and the cops walk up to them. I wish i saw more of this video but this is all we have. The fact is that the officers told them not to cross the street. They were in the middle of the street when the officers told them to stop. So your guests they admitted they didnt follow the Police Officers orders. So the cops said they are going to issue you a summons. And they asked them for identification. They are coming out of a bar at 2 00 in the morning. And say fyou to the officer. They said they didnt say that. This doesnt look excessive to you . Harry the fact is that they are resisting arrest. Watch the resistance going on here. Watch the resistance thats going on. How many times do you hear the officer to comply, comply, comply. And this is an incident where somebody tuesday not comply. He is keeping his arms here and stopping himself from trying to be handcuffed. Its amazing we are watching the same video and he is seeing resistance on the part of the individual. The cop is punching him in the arm. But wait a minute, the first scene is the cop throwing the man against the wall. The cops are taking a minor incident thrown up against the wall, thrown to the ground and punched by Police Officers. That is such an excessive use of force. Why do you say its still against the law. Its against the law. So watch this. What should he do, go down on his knees right now . Just comply with the officer. Put his hands behind the back. When that officer is punching him in the arm he cant get the arm around. Ive had that happen to me a million times. You think that goes along with Police Protocol .
