CSPAN Satellite Home Viewers Act Markup Opening Statements March 29, 2014

Every member met with satellite operators and Cable Operators among others to discuss the right policy and to get to the right outcome. If you have not met with any of those people, we should talk about where you have been. We have sought the input of our democratic colleagues. We have expressed the reforms contained in this bill. We were in a meeting with chairman upton as well. Compromise requires hard work. That is what we have been about, but we have done it repeatedly in the subcommittee and we hope to do it again here. The work of the subcommittee has generated three bills on internet governance, a topic we will take up more fully in a short time. Fcc consolidated reporting and fcc process reform. La reauthorization can be another example of bipartisanship and one i feel strongly about as we Work Together to get a bill that gets through the house. One section, obviously, that is important to me is section iv toch directs the fcc complete the quadrennial review before moving forward piecemeal on media ownership issues. The hallmark of government is transparent and political transparent processes. I am disappointed the commission failed to live up to the standard. 2010 review of ownership which had yet to complete and in last weeks announcement out of the fcc. Fccs actions will have farreaching consequences for the Video Industry and the actions to deny Public Participation violates the very spirit of public trust. But democrats and republicans alike have been wronged by the process failures of a fcc, and we have spoken out about those. We should find Common Ground on this issue. I urge chairman wheeler to take advantage of this time to consider whether the process and prudence he has pledged should begin now with the media ownership proceedings. I am hopeful we will be able to make a deal by tomorrow morning and look forward to advancing this important legislation to reauthorize the Satellite Home viewer act. Let me make a few comments. I appreciated your calling me over the weekend. I am glad i got a hold of you the next day. Essentiallyrough the three sections of the bill where we had some issues. Iii, iv, and vi. I think there is hope for working out at least so far on the set top box issue. There were two concepts i had discussed with you on the phone. And it is my understanding that essentially concept ii is the one you are willing to accept. Think this is really ready for prime time. That is the way i began my conversation with you on the phone, because for the reasons i expressed, but i do think that for the sake of the order, so to speak, that we move on, and that you are willing to give a commitment to really work these things out. There is no question that you have the boat. You have the majority of the votes. If you want to roll us, you can, but has never been the tradition of the committee. It really has not. If that was practiced, frankly, whatever the bill was would never go anywhere. I think that this is a huge sector of our national economy. We wanted to continue growing. Stillaid, i think that we have some issues in sections iv and vi, that require work, that require negotiation. I think not just chat. It requires negotiation. And im going to waste my trust in the fact that that is exactly trust going to place my in the fact that that is exactly what is going to happen. With that, i yield back the balance of my time. The reauthorization of the satellite extension act will ensure that over one million households will not face disruption of service they rely on. I am pleased we are moving forward to advance this legislation. I want to support the chairmans incorporation of the narrow reforms that will help foster further information among all and increased choice for consumers. I also want to thank chairman austin for excepting the provision of the bill which is the work of jim green on this committee on legislation on regulation on set top boxes. Whatever our responsibility is to enact policies and remove outdated regulations that are counterproductive to economic growth. Repealing the ban would facilitate this effort. I am faced with the legislation and look forward to working with my colleagues to identify other areas we can better align laws with the 21stcentury marketplace. Two weeks ago when we held a hearing on the legislation, the subcommittee is going to consider tomorrow, i said i was not prepared to support the bill as drafted but that i wanted to work with chairman walden to put together a bill we could all support. Im glad to report we are making progress. We still have some issues to work through. But thanks to the leadership of chairman walden we are making progress. One area where progress is clera me is on the issue of set top boxes. I expect tomorrow representative proposalll introduce a as an amendment that will get bipartisan support. There are outstanding issues we still need to address, namely the concerns of section iv of the discussion draft. I share my republican colleagues desire to see the fcc complete a longoverdue quadrennial review of the media ownership rules, but this provision would go the fcc by restricting me from addressing coordination between broadcasters that is undermining local news and diversity of viewpoints from different broadcast outlets that are constituents need. I cannot support the provision as drafted. I want to work with the chairman and the ranking member, and i hope you will continue to give us his commitment that we will Work Together to see if we can remove this language before we get to full committee. Is that a commitment i can count on, mr. Chairman . If the gentleman will yield, i believe our commitment is that we would bracket that language and continue to have that discussion between here and the full committee. That is my understanding as well. Lastly, i remain concerned that section iii does not operate consistent with my colleagues intent and i hope these concerns can be addressed. Mr. Chairman, i look forward to working with you to resolve our outstanding differences before the full committee markup. But live content is sold primarily through the System Congress set up which allows atv providers like satellite operators to buy the rights from broadcasters and other content owners. Local content like broadcast news is also sold through the same system. As the son of a former newscaster of ketv in omaha i am police the legislation we consider today supports our local broadcasters i am weased the legislation consider today supports our local broadcasters and their endeavors to serve the local community. My job on saturdays was to put the weather symbols up on the map for the weekend crew. If omaha was sunny, i put the magnet up. That is dating the years that my dad was the anchor. Addressesd this bill some of the issues that have been very difficult to confront. I have always been very reluctant to get in between pay tv operators and content owners as they negotiate their carriage deals. Nonetheless, there is a pattern showing and increasing and broadcast blackouts where broadcasters and pay tv providers cannot come to an agreement. F to 127 inin 2011 2013. Tv carriers have gotten out of the business altogether in favor of an internetbased model, because of the cost of content. The modest updates in this bill provides are appropriately aimed at blackouts and content costs. Meanwhile, the larger market shifts as video migrates to mobile and i. P. Connections. These should be addressed in the broader Communications Act update. In essence, this is a rehearsal for the real issues that come before this committee. And i thank you for the time today. Yesterday in the French Quarter of new orleans you had grown man yelling stella i am not sure if they were clamoring about getting back to washington helping to deliver that message to you that we need to pass this bill. Maybe it was part of the Tennessee Williams festival that went on in the French Quarter yesterday where they pay homage to a streetcar named desire. Yes, they were ripping off their shirts. They get judged and rewarded. How did you do . Did you win . I did not participate yesterday but i did watch it on the news with great interest as we do every year and paid tribute to Tennessee Williams with the great festival in the French Quarter, and people yelling, stella. Different people yelling at for Different Reasons here today. The bill that is under consideration begins to peel back the layers of outdated and restrictive laws and video rules and regulations that are now decades old and work against consumers and risktaking job creators. Say the to like to current rules take place in a freemarket, i would like to point out that this bill dispels that met with the repeal of this sweeps roll which is just one provision of an entire law called the 1992 cable act that lays out a long and specific onts betweenand d content creators and video providers. On the one hands, it is true that we live in a free country, but on the other, it is a stretch to say these negotiations for without the heavy hand of government localing when and where stations can be carried in how consumers can buy certainty of packages. Unfortunately, the rules are clear and that these mandates work against consumers and job creators. So let me conclude by saying that in an effort to promote more freedom for all stakeholders, i will look forward to a more comprehensive review and reform of the entire suite of Communications Laws and laws to couple with this bill under consideration today. Reauthorization of the Satellite Television extension and location act which we refer to as stela. Mr. I want to commend you, chairman and the full Committee Chairman and others for working to find the Common Ground or the middle ground on the reauthorization. Know, when we first started out, there were some disagreements among the stakeholders. I am told that most of those disagreements have now been settled. And that the broadcasters and satellite providers are in general agreement about this legislation. That is a good thing, not a bad thing. Im happy that you are going to have an open markup tomorrow in subcommittee. I look forward to participating in that markup. Opefully, we will continue the markup in the tenor we have continued the whole issue so far openness and trent parents appeared with that, mr.
