Dow jones is reporting there may be a settlement for Insider Trading charges. All kinds of charges have swirled around this country along with accusations of failing to supervise. Were going to have more in just a minute from Charlie Gasparino whos working on this story, but it appears there could more than a 1 billion settlement to settle all of these charges that have beleaguered sac capital. Lets get back to the markets, Home Builders leading the s p 500 higher for a couple of reasons. Lennar, kb home all up after lennar and kb posted better than expected quarterly earnings, and separately this is sort of the big data story here, and you just heard ashley and tracy talking about this, the chase shiller in caseshiller index did look to show that once again we have home prices that are continuing to rise. For the month of july, the caseshiller index which, basically, encompasses ten different cities, rose 12. 4 , this yearoveryear, and it is the fastest pace of growth in more than seven years. Pretty much the same report showed a slowdown, so the velocity is slowing slightly. Chip equipment manufacturer Applied Materials is going to buy Tokyo Electron in an allshare deal that would create a global powerhouse. It would be the biggestever foreign takeover of a japanese firm. Of course, based in Silicon Valley. Shares of Applied Materials moving higher by more than a dollar. The fascinating move for this company, and the stock has taken off over the past year, up over 50 . So the ceo, gary dickerson, hes in tokyo for the big announcement, but mike splinter will give us the interview. Well ask about the melding of the two cultures of the to company and this huge bet on mobile chips and displays for all kinds of displays. Let me go to teddy at the New York Stock Exchange at the moment, and we do have a bit of a mixed market. Yesterday it was individual stocks that were the story, everything from blackberry to apple. But today what would you say is sort of the threat thats moving through all of these markets . Well, first of all, the volume has continued to contract from the quadrupleripple witching that we saw on friday, liz. Volume is very anemic, and the markets were struggling on the plus side most of the day. Weve given that up here but not with any kind of real vengeance. I just think its more lack of interest on the part of the buyers and perhaps a little selling that still lingers on. So the markets have kind of drifted a little lower here. Really without any real direction. You know, we gave back a couple hundred points in the last couple of trading days. The issues what we talk about endless he is about all the unknowns that make it a little difficult for investors in the short term. The markets clearly are fully priced, you know, weve just made alltime highs just within a couple days, so i guess were going to give a little back here, but i dont get the sense were in any real trouble. Liz well, we were just looking at some of the new highs, weve got a couple airlines in there. Lets get to the nymex and, i guess, scott, you too over at the cme. Tom, were looking at oil prices that have had some heat taken out of them. President obama speaking at the United Nations today, striking a slightly conciliatory tone when it comes to the tensions in the middle east. How much does that have to do with it . You know, i think thats part of it. We came off the 110 level down to around 102. We started the news up when you you had syria, i think well get a little lower from here and good support around 100 and can head higher from there. Liz 100. Okay, we had seen such an incredible runup, but crudes dropped from one week ago about 7 . Do we need to look more deeply into that . Because, look, every company thats gigantic including say, for example, cocacola, has to look and hedge against higher oil prices. We go lower or higher from here . I think were going to go lower temporarily but higher probably by six or eight months from now. Were going to test lower over the next month, and then were going to probably get back up to that 110 is level sometime over the winter. Liz okay. Scott chime in on this and also on treasuries and what you seeing in that space. Well, you know, with oil your last guest says his guess is its going lower. I see that as well. If we do get these conciliatory remarks coming out of the u. N. Here, then we could see oil not only break 100 to the downside, but really look at that 95 level which would be the next big support level below that. So i think in the near term in the next three months or so the pressure is actually to the downside whereas just a couple weeks ago with the tensions coming out of the mideast and syria, it was really up to the upside. Liz okay. Gentlemen, thank you. I want to get to Nicole Petallides. Youre looking at red hat stock. Lets talk about that. Well, were talking about red hat, liz, because of the s p 500 trying to hold that 1700 mark. Its down 11. 25 , and its all about the billing. They came in, and what a they do is they have the lennox operating system. They are the big districter of lennox operating system, that competes with windows, for example. But they came in, and its the Third Quarter in a row that theyve missed on deferred revenue. they also came in with numbers that did not meet the analyst estimates. They saw growth in the billings of 376 million. You know what . That wasnt good enough. The analysts were expecting 400 million worth. So the fact that youre seeing the Third Quarter in a row of this Revenue Growth that was disappointing and now you have a slew of analysts jumping onboard and actually downgrading the Company Overall batesed on this news that based on this news that theyve had slower growth, and that, obviously, hit the companys stock today. Liz teddy, when we woke up this morning, we had a huge deal between Applied Materials and Tokyo Electron. I mean, i dont know who else im sorry, ive just been told we dont have teddy. Let me get back to scott then at the che, you know, these deals are still happening at in the point. As we look at what the fed decided not to do, do you see Bigger Companies saying like a microsoft picking up nokia, you know what . Theres still opportunity here while money is cheap to borrow and grow . Well, you just, you just hit the nail on the head. Money is cheap. Even if they would have started the tapering, you know, historically youre still looking at, you know, Interest Rates near their lows. But the fact that theyre not tapering now, i think theres this window, again, over the next three to six months maybe even extending into Second Quarter 2014 where you are going to see some consolidation, you are going to see more mergers because, like you said, microsoft, over Companies Even other companies that have enough cash on hand to pay for a deal, their going to issue debt because the money so cheap. So i think the fact that the tapering is not starting now and looks like its going to be 69 months away perhaps, you are going to see more deals in the marketplace. Liz okay. Great to see all of you. Liz well, usually and were going to let you in on window of how this kind of thing works the Federal Reserve takes questions, but today its asking questions as it look into the possibility of news organizations wreaking what we call breaking what we call embargoes, when youre supposed to keep information secret until a certain designated time. Reporter well, because if the embargoes are being broken, obviously, some traders could get a jump on marketmoving information. And it is a firm in chicago called nanex which is a highfrequency Software Company that is raising questions about all this, because its looking at some trading data and saying that some, that some trades in stock and gold futures in chicago happened when they perhaps should not have or could not have if you believed that these embargoes are held. And in specific its talking about last weeks fomc decision not to taper. On wednesday it was released at 2 00. We in the news media get this release about ten minutes ahead of time on an embargo canned basis and whats called a lockup, a press lockup so we can read over statement carefully, we can dissect it, we can report the information and quute it accurately when the embargos lifted exactly at two. But according to nanex be, it appears to them that perhaps theyre basically charging that some of the Wire Services that supply headlines to the highfrequency Trading Community might be pushing this information out somehow out of the lockup a little bit ahead of time. Here a statement from nanex saying, quote the Market Reaction to the fomc news on september 18, 201, came earlier than physically possib the speed of light and was, therefore, unexpected by many market participants. The end result will be an increase in sun r uncertainty which will lead to an even larger decrease in liquidity during the next fomc announcement. Basically, its charging that it takes seven milliseconds to press the button in washington for information to get to chicago, but trades went off in chicago within that window, so how did it get there . The fed says it is looking into this, it says news organizations receiving embargoed information from the Federal Reserve agree in writing to make no public use of the information until the time set for its release. Be conducting followup conversations with news organizations to insure our procedures are completely understood. This may boil down to the definition of public use and our editors getting a little bit of information ahead of time, and who knows.
