Its supposed to be kept secret. Lets remember, there are very strict criminal laws about disclosing grand jury information. We dont know who leaked it to cnn, it would be a crime if prosecutors or agents leaked it. Reporter a number of former Justice Department officials told me they suspect it came from the attorneys of those being charged. Today there is plenty of speculation about who it is. The two names we heard the most of about in the course of Robert Muellers investigation are former Trump Campaign chairman Paul Manafort and former National Security advisor michael flynn. Whatever the indictment is for, whether its a speaking indictment, an indictment that lays out a broad recitation of background facts or narrowly tailored to specific charges and technical features of the statute. If it goes broad. That may signal the fact uncovered a good deal. Fits narrow technical charge, thats Something Else again. Also the fact there was a mention of a possible arrest seems odd. If that came from the same source as the information about the indictment itself, it suggests somehow the prosecutor is trying to play hardball. Usually in white collar cases there is an arrangement with the lawyer for the defendant, for the defendant to show up at the courthouse and enter a plea of not guilty and have bail set. But if they are going to make an arrest instead of having somebody show up. Thats pretty harsh. Arthel if thats the hardball as you are saying, judge, i know at this point everything is speculation. We dont know who the targets are. But for the sake of this segment lets talk about your serious prosecutor paying hardball. If who, then what . The theory of playing hardball is to tell somebody that you are not kidding. That you are willing to go to the limit to walk them in. Often it will happen if the government is looking for cooperation from a defendant, they will try to work it out in advance. Whether they tried to do that here and failed, i dont know. But it may be thats what happened. They are signaling all bets are off and it will be hardball from now on. Arthel a federal grand jury approved the first charges. Does this change the perception of the Mueller Investigation . In some peoples minds i think it might. They look at absolutely nothing there, there would be no charge. Im not certain that give what we know about whether for example, whether general flynn made proper disclosure of his being engaged by a turkish businessman or Paul Manafort dotted all the is and crossed all the ts. I dont know if that was a realistic hope. But we know there will be at least this charge whatever it is and against whoever it is. In any event you will look in vain in the criminal code to find the word collusion. There is conspiracy to commit a crime. But collusion is maybe improper or shameful, maybe something thats politically embarrassing, but its not a crime.
