Just a moment ago, a senior Law Enforcement official telling fox this matter is now closed. In terms of Hillary Clinton and the investigation. I keep coming back to something in my reporters notebook from a top fbi source saying james comey does not play by mother may i rules, meaning the fbi chief does what he thinks is right, darn the consequences or political or otherwise. Back in july he infuriated republicans when he said there was evidence of potential violations of law in the mishandling of classified information but he thought based on intent or lack therefore, no reasonable prosecutor would bring charges and when he was grilled on the hill he promised transpatien transparency if if he got new emails and the same democrats who cheered him in july questioned his credible and now the same republicans that said give comey time, they are now saying, wait, this doesnt change all of the errors Hillary Clinton made around the server so there is a Little Something for everyone, here are the two Vice President ial nominees weighing in. The fbi last summer concluded that Hillary Clinton having classified documents on this private server was extremely careless. And i and i guess today, i dont know if youve heard, today they announced they had not changed that conclusion. [ crowd noise ] you know, mishandling classified information is a crime. Not surprised. I really felt like the original conclusion was so unequivocal after such a long investigation that when the surprise of the letter two fridays ago happened, i still felt like that would be the conclusion they would reach. Now, frustrated conservatives are all over social media slamming that the fbi worked overtime to go through 650,000 emails in nine days and that is 777,000 seconds but they were focused on the huma abedin emails to or from Hillary Clinton were mostly duplicates but does not let abedin off the hook as they go through more emails and a Law Enforcement official say the classified information is closed, they are still at the fbi investigating the Clinton Foundation, we dont know where that will go. What has happened now is the investigation as to her server correct. And her handling of classified information. That is considered closed by the justice department. But we heard it was closed in july and they got new information. And Loretta Lynch came out after the after the comey announcement in july and said it was closed. Correct. And then when it was reopened, a lot of the clinton defenders said it was never closed. But in fact it was. It is all semantics. But the fbi continuing inquiry into the Clinton Foundation continues. And the foundation keeps going and the server in their eyes is closed. Got it. Okay, ed. With less than two days until election day, how if at all will this change the race. I think it is fascinating how democrats and their allies spent the last days attempting to destroy the credibility of the fbi and james comey and now turning on a dime and whipped up elaborate conspiracies how they were rigging the election and now they want everybody to accept what james comey came out and said. And he said it doesnt change anything from last july where he came out and sort of showed that everything that Hillary Clinton had said about her private server or nearly everything that she had said about her private server was not true. That she had not handled classified information well and people were very frustrated that he let her off the hook for these things. I dont think that really changes but doesnt this to some extent lift the cloud of doubt that had been cast over her candidacy by the announcement that this investigation had been reopened. This is the best thing that happened to here in two or three weeks. And i think theyll make the most of it. I just dont think there is much they could make of it. Here what do we have . Less than 48 hours to go. Donald trump is still going to be on offense and shes going to be on defense. Now she would rather be known as being careless than criminally liable for sure. But the story about the way she handled all of the emails and the classified information doesnt change. Well, we know that not very many undecided voters are left if the polls could be believed and i think they could and if you are a waiving voter and one of the few remains and you are like a lot of americans, teetering between the two. You might not vote at all. Does this help her enough so that people may swing her way enough to make an important difference here, molly. Im not entirely sure this hurt her that much to begin with. I think people it certainly didnt help her. But when you look at the race, she ras already polling ahead of donald trump and that will continue to be the case. At the same time, the way that the Clinton Campaign it is closing though, lately. And the way the Clinton Campaign handled this absolutely. And just freaking out in response to the new information and that drew attention to the problems she had and im not sure this was such a wise idea. It brought to mind everything people remember about clintons and corruption and scandal. And also we learned and didnt know prior to this, that the foundation is being investigated by the fbi for corruption related to her tenure as secretary of state. Overall this is still not good news. Last word, fred. I like the statement by nancy pelosi. She and the other democrats had totally trashed jim comey and now shes happy with what he did but she doesnt mention his name in her release. Four shifts and they fell in favor of donald trump. New hampshire moved from leaning democrat to toss up. Ohio from tossup to leaning gop and both indiana and missouri from leaning gop to solidly gop. With those in mind today, if the vote was today, clinton could get 283 votes and trump 192. The toss up, the yellow they account for 63 votes. But not so fast in michigan. Check it out. It is worth 16. Weve got it as light blue meaning it is leaning democrat but trump is fighting to be the very first republican to carry that state in 28 years. Hes holding a rally there tonight. Governor mike pence will be there on monday. Trump himself will reportedly return for yet another late night rally on monday. Clinton will be there monday and as well as president obama. So why all of the lastminute alist attention. They say it was part of the plan to flood the state leading up to the election because there is no early voting. So both sides have to light a fire under supporters and make sure they turn out on election day and the trump team said now it is seeing an opportunity there. All right. Here is another interesting wrinkle in the Electoral College vote. One electoral in Washington State will refuse to vote for clinton even if she wined the states popular vote, a second elector also hinting he may do the same thing. Both have been sanders supporters and they are not saying who they would vote for or if they will vote at all. Brit. Shannon, thank you. As weve noted, the real clear politics average of National Polls shows the race a virtual tossup. But most season analysts see Hillary Clinton as a clear favorite, partly it is the electoral map that shannon just outlined but it is the polls within the politics average. Lets talk about them with larry, head of the university of virginia esteemed center for politics. Hi, larry. Hi. I think you will agree that the electoral map seems to favor secretary clinton but it is still close enough that trump could pull it out. With a big day on tuesday. But lets talk about this average of polls because they show the race tighter than most analysts seem to think. And lets just take a look if we can. I think we may be able to look on the screen at those polls. And give a sense of the margins that the polls within it provide. Do we have that electoral map in it seems not to be coming up. And you are familiar with one poll in the real clear politics two candidate average that has consistently favored trump. That is the poll from the university of Southern California and the los angeles times. It is not the same kind of poll that most other pollsters are doing. Could you explain the difference. Sure. Its a very complicated poll method logically and if i go into detail, brit, you will lose your millions of viewers. So im going to avoid doing that. But i am going to tell you this. The methodology in polling regard that particular survey as being an outlier and i agree with them. I do not think it is representative. I do not think it is born out on tuesday night. Now if you had shown the chart of polls, it would confirmed what your viewers already believe, which is that polls are all over the lot. You have to know what you are looking for and while this what . Hold on a second. That graphic is finally to our great relief appeared. There it is. And as could you see by looking at it there it goes. The polls generally you could see that only one poll in the nine that are part of the real clear politics average is donald trump ahead and that is the one weve been talking about, the l. A. Times and usc tracking poll which has trump up five. Which sets it well apart from the others and as you point out, you dont trust the methodology and part of the reason is that it is a very large sample to be sure, which is a good thing in a poll. It is likely voters which is also a good thing, as you could see there lv, but it is the same group of people that they go back to time and again and it is consistently throughout this entire cycle favored donald trump by several points. He is always farther ahead in the poll or less far behind than he is in any other. So that may and if that poll were not part of this, the average would be quite different. Go ahead, larry, im sorry i interrupted you. That is perfectly all right. Because you made a good point. Go back four years. What was the real clear politics average showing four years ago . And im not criticizing them. I like them a great deal. But their they are aweek ahead of the election, they had romney up 1 percentage point over president obama. President obama won by four Percentage Points. So in essence, they were off by five Percentage Points which was six to seven million votes. That is a lot of votes. But they were they were closer than many of the individual surveys. So that is why i say polling averages are not perfect. But they are better than the alternative. But if you force me, as your producer did, to pick a couple of polls that are probably more representative, i would pick the nbc wall street journal poll as one of them. Why . Because it is an old poll. They are used to doing these surveys under difficult circumstances. And it goes back a long way. They have a lot of history. The other poll i would recommend to people is the economist you gov poll because they have shown remarkable stability in this race and ive said time and time again that these surveys that hop from plus 13 for one candidate to plus five for the other candidate, this is ridiculous. The vast majority of people knew for whom they were going to vote at the beginning of the general election campaign. You couldnt have a more stark difference than trump and clinton. So the you gov economist poll is very stable. Theyve been about plus three for clinton for quite sometime. And i think it has the stability that i look for in a good survey. All right. When they come after her, we have to stand with her. And in this election in many ways is about what kind of future our country will have. Will it be dark and divisive, or will it be hopeful and inclusive and united . I personally believe we have come too far to turnnow. But they also are very concerned that 37 million voters have already been cast and they feel that the damage is already done. Also, brit, im told that it is not clear whether that Clinton Foundation investigation is actually continuing. There is there is some indication that that Foundation Investigation is no longer ongoing. And also sources had told me that they had not found any classified information on that computer, on Anthony Wieners computer and all along they believed that huma abedins emails were duplicates. Back to you. Ed henry has reported that that investigation into the foundation, which is being conducted by the fbi, without a apparently much support is very much open and ongoing. There is not a lot of polling showing that trump is winning here but there are polls that show that the margins have tightened as well. For him to pick up a victory in michigan or minnesota might be one of the blue states that he could flip and they have some evidence by in the momentum, not necessarily in the poll numbers, that that could be pulled off. Trump has not yet reacted to director comey of the fbi decision that the conclusions dont change. His running mate, as ed henry played early, and Kelly Anne Conway has said, it doesnt change much in their view. We already knew they lied to the fbi about the number of devices that she had, there were a whole series of other problems and that she was called reckless and extremely reckless by the fbi director. So they are going to continue to march as though as trump likes to say corrupt hillary is still colluding with the justice department, his words, not mine. And that this is an opportunity for change.
