FOXNEWSW Outnumbered Overtime With Harris Faulkner July 9, 2019

People in palm beach knew him. He was a fixture in palm beach. I had a falling out with him a long time ago. I dont think ive spoken to him for 15 years. I wasnt a fan. I was not a long time ago. I would say maybe 15 years. I was not a fan of his. That i can tell you. Harris i do apologize, that obviously was not the right to clip from the president. He was talking about Jeffrey Epstein. We were expecting something about the labor secretary acosta. So here is how we will recover. We will go to our john roberts, who will have it all for us outside the white house. John . Heres how you recover, harris. Its live tv and sometimes things happen harris [laughs] the president made news on two fronts there. Alex acosta, his labor secretary, and Jeffrey Epstein paid the two things are indelibly connected, because when he was the u. S. Attorney for the southern distrt of florida back in 2008, alex acosta cut a plea deal with Jeffrey Epstein that kept him away from federal charges but did put him in jail on state charges for 15 months, related to. But avoided bigger federal charges on potential sex trafficking that could have put him away for life, which is what prosecutors in new york are going to seek now. So now there has been a cascade of calls for acosta to step down as the secretary of labor. I know youve got a correspondent coming up from the hill to talk about that. Lets deal with for the president has said about this. You saw what he said about epstein. Back in 2002, when he was talking about epstein to new York Magazine in a profile, the president said that epstein was a terrific guy and like me, the president , he likes beautiful women, some of them on the younger side. We dont know if back then President Trump knew just how much on the underside. But now the president is stepping forward to at least defend in the near term is labor secretary. Though we dont know how long that is going to last. Listen to with the president said about acosta. I feel very badly for secretary acosta because i know him as somebody who works so hard and has done such a good job. I feel very badly about that whole situation. But we will be looking at that and looking at it very closely. That is the key part of that phrase. Clearly the president is standing by his labor secretary for the moment, but he says, we are going to look at all of this very closely. In the past, on several occasions when the president has looked at something very closely regarding one of his cabinet secretaries, that cabinet secretary ends up not staying very long with the administration. A clear example of that would be scott pruitt. Not to say that what acosta did and what pruitt was doing were similar things, but certainly there was a cloud of controversy over secretary acosta now. And secretary acosta himself commenting on all of this, taking to twitter to say, the crimes committed by epstein are horrific and i am pleased that new york prosecutors are moving forward with a case based on new evidence. Also going to say, with the evidence available more than a decade ago expending his decision back in miami prosecutors insisted that epstein go to jail, register as a sex offender, and put the world on notice that he was a sexual predator. Not that new evidence and additional testimony is available, the new york prosecution offers an important opportunity to more fully bring them to justice. So secretary acosta is saying there that he did not the full body of evidence back in 2008 when he cut that deal with epstein, but democrats are suggesting that epstein got a sweetheart deal from federal prosecutors because of his wealth and has power and his connections, particularly in the florida area. You saw President Trump say, i knew him like everybody else in palm beach did. Epstein had a 59 million place in new york city and a very big house not too far from maralago, where he used to hang out a lot. So, we will see where this case goes, but it certainly created a lot of intrigue here in washington, d. C. , harris. Harris i can imagine. And f Nancy Pelosis daughter, christine pelosi, put out that this could hit some of their faveses and the Democratic Party. It wasnt already like all things in d. C. , political, now it is in every way. Was not forget that epstein was a very good friend of bill clintons, as well. And bill clinton flew on his jet at least four times. A couple of those times on major overseas exclusions for the Clinton Foundation so theres a lot of political connections. Harris think you always come qaddafi. I want to get to Doug Mckelway come alive on capitol hill with direction from lawmakers. Speaking of which. So what are democrats saying . More and more democrats are now calling for the secretary of labor alex acosta to step down. Chief among them today is Senate Minority leader chuck schumer, who took the well of the senate to express these sentiments. Secretary of labor alex acosta cut epstein a sweetheart deal while acosta was a u. S. Attorney in florida in 2008. While a federal prosecutor, acosta signed a nonprosecution agreement that allowed epstein and his coconspirators to remain free and easy justice despite overwhelming evidence. Shimmered joins speaker nancy pelosi, who last night, like slat night, tweeted this about acosta. Secretary acosta must step down. As u. S. Attorney he engaged in an unconscionable agreement with Jeffrey Epstein, prevented victims from seeking justice. This was known by potus, she says, when he appointed him to the cabinet. Republican senator ted cruz among a handful of republicans to join democratic ranks calling for acostas resignation, but most republicans are holding firm against that. Senator Lamar Alexander told reporters yesterday that acostas confirmation in 2017, the committee, and i could hear from senator alexander, looked into this thoroughly. We found that the plea agreement when he was u. S. Attorney was approved by the bush Justice Department. It was defended by the Obama Justice department, and then by the trump Justice Department. Heres what acosta himself said during his confirmation hearing about the epstein case. At the end of the day, based on the evidence, professionals within a Prosecutors Office decided that a plea that guarantees someone goes to jail, that guarantees that someone register generally, and that guarantees other outcomes, is a good thing. And democrats note that under the plea deal that acosta agreed to, epstein did not face any federal charges. He served only 13 months of partial confinement. We say partial because he was allowed to spend 12 hours of each and every day at his office and then return to the jail cell. Moreover, none of the 40 teenage girls that epstein was alleged to have traffic, know their attorneys, was consulted about that plea deal. He argues that clinical stakes cannot be higher, as he talked about. He had epstein cultivated many relationships in the upper echelons of both parties. What epstein has to say if he continues to plead not guilty about those relationships is very, very key. The world is watching what hes going to say. Harris its definitely true. Im looking now. Christine pelosi, a Democratic National committee official, daughter of Speaker Pelosi. This weekend she said, quite likely that some of our faves are implicated in the sex trafficking case against politicallyconnected financier Jeffrey Epstein. Very interesting. Doug mckelway, thank you very much. I want to bring in james trusty, former Justice Department prosecutor and now a whopper and a pretty good to see, james. Hey, harris. Harris in your former job you looked into some of this. What would you be looking at and what would you question . Theres a lot to question and i think everybody else has a piece of the puzzle. Where they end up press getting set of federal, thats not unheard of. To get shuffled on to state court for resolution. Even ceiling that matters not crazy, because the person is not admitting guilt in federal court, so they should necessarily have to have all their dirty laundry out there for the world. Was unusual was the decision not to include the victims. There is a federal crime victim bill of rights that wasnt with the ignored, none of these victims were contacted. Thats the part the kind of reasons the biggest stink to me, which is, whether the Attorneys Office make a decision not to include people statutorily eligible to know whats going on with their case . Harris very interesting. I know that a couple times, dont want to bore the audience that word. But as we go deeper so much as unexpected. Lets talk about that wide brush. The result that his News Conference yesterday, the fbi number looking for more victims. Youve got people on the hill including House Speaker Nancy Pelosis daughter, christine, saying some of her own political favorites in the Democratic Party could be on a list. Whats really kind of interesting, he reminds me of the old mayflower madam case that happened years ago where a bunch of highprofile men were very nervous about a black book and whether their names would be out there. Obviously, bill clinton has already gotten someone in front of this issue by issuing a statement yesterday, but thats a big concern a lot of people have. See when he just simply said he didnt know about it. Go right. But it wasnt out of the blue that he came out with a comment about Jeffrey Epstein. He knew about the indictment and wanted to make sure he had his gloss on things. Whats interesting is epstein could be like another michael cohen. He could have recordings, pictures, documents. So a lot of people right now are sweating his decision as to whether he is going to try and cooperate and lower the damage or whether hes got information that is more credible than just his own words. Harris when you are that democrats in particular focused on thenu. S. Attorney and no labor secretary acosta, what do you say . Theres a political dynamic that is kind of obvious, and thats up to them if they want to try and knew his hide to the board. But the reality is that the plea itself should be driven not by who Jeffrey Epsteins book by the sufficiency of the evidence. If you had professional prosecutors that told him this is not a great case but they could come up with a guaranteed sentence in state court, it might not be crazy or unusual or corrupt or anything like that. Im sure it would get a good scrub. Again, i think the issue is basically the exclusion of the victims. Thats what smells, thats what creates this issue of why they were making decisions they made. Harris james trusty, formerly of the doj. Good timing to have you on as the news was breaking after the president has spoken. Thank you very much. Democrats lodging some serious allegations against the president. Its all about, should you ask people if they are here illegally . The administration is determined to ask a Citizenship Question on the u. S. Census. Up next, a republican senator with a bill that would do just that. And Speaker Pelosi is not holding back on the matter. This is about keeping you know the hat . Make America White again. They want to make sure that people, certain people, are counted. The fistfight caught on camera on saturday showing a man punching to women, knocking went to the ground and ending her repeatedly while shes down. All this, as children are in their group. Look at all those people watching. Their kids saw this, too. Some of them tried to break it up. Disney security eventually intervened and kicked out that a group from the park. Unreal. Attorney general william barr says the Justice Department would in fact support Robert Mueller if he decided not to testify before Congress Next week. He supposed to do that on july 17th. The former special counsel is scheduled to appear before two democraticlighthouse committees about the russia investigation. Chief intelligence correspondent Catherine Herridge now joins us from washington with the latest on this. Catherine . Thank you, harris, and good afternoon. The former special counsel remains a reluctant witness, eight days out from his congressional testimony. We are told a number of options are under consideration. Traveling in south carolina, the attorney general william barr emphasized that mueller said in his only Public Statement about the russia investigation that if he was compelled to testify he would not go beyond the four corners of his report. I was disappointed to see them subpoenaed, because i dont think that serves any purpose dragging bob mueller if he is going to stick to the report. The only reason it seems to me for doing that is to create some kind of public spectacle. If he decides he doesnt want to be subject to that, the department of justice would certainly back him. Harris, Lease Development cannot be seen in a vacuum. The me of the testimony is scheduled for next wednesday with democrats signaling they want mueller to explain why he could not exonerate the president , or could exonerate the president on obstruction of justice charges. And they want mueller to explain how early he knew that there was no evidence of a conspiracy between the Trump Campaign and russia. Meantime, there are new developments with reuters, first to report that the former british spy Christopher Steele has not been interviewed by the Inspector General Michael E Horowitz as part of his investigation. Fox news was first to report on friday that a key witness outside the fbi and the doj had come forward to the Inspector General and that now appears to be Christopher Steel Christopher Steele. Our contact report that Christopher Steele was very concerned he would get thrown under the bus into alleged surveillance abuse during the 2016 campaign. I think its worth nosing dont like noting that if you look at the Mueller Report there are no references to the dossier. They referred to as reporting is just that, reporting, or reports. That has the effect of minimizing the fact that it was Opposition Research that was paid for by the democrats, harris. Harris thats a fascinating point youre making there. Changing the wording so people would have a different reaction to whats actually a dossier. It sounds very journalistic when you read it, but it was not that. Harris Catherine Herridge, thank you very much. A growing sense of sure done. Attorney general william barr says he sees a legal way to ask the question about u. S. Citizenship on the 2020 census. This, after the u. S. Supreme court blocked the move last week. But now the attorney general says he expects the doj to finalize its new legal strategy to move forward in the next few days. My next guest has introduced a bill that would had a Citizenship Question to the census. Tell me about the progress of this. Will it happen . I think its very important, this question, as part of the senses. Its absurd as a sovereign nation we cannot ask the question, are you a citizen or not, on the census. This goes back to the late 1800s. This was on the census for over 60 years. So i think its important as a sovereign nation. We know how many u. S. Citizens live in this country. Harris as you look at the court coming back, the judge said he got to make a more compelling argument if you come take another bite at the apple. This piece of legislation allow the
