FOXNEWSW Special Report With Bret Baier May 29, 2019

So. The president legal team quickly called this exoneration Legal Standard backwards. President trump tweeted today that this case is closed. Correspondent kevin corke, and reaction from the white house, peter doocy looking at the growing call for impeachment proceedings to begin from democrats. A senior political analyst brit hume has all of the analysts. We begin with chief intelligence correspondent Catherine Herridge and the mueller statement. Good evening, mueller cover the same ground as a 450 page russia report, on collusion and obstruction in april. But what the special counsel emphasize this morning that shook washington. If we had had confidence that the president clearly did not commit a crime, we would have said so. Breaking his silence, Robert Mueller made clear that he and his team did not exonerate President Trump or charge him with a crime of obstruction, saying that he was constrained by existing regulations. Under longstanding existing policy, a president cannot be charged with a federal crime while he is in office. That is unconstitutional. Without using the word impeachment or naming congress, mueller said the regulations did not allow them to gain evidence for future action. It is a process other than the criminal Justice System. To formally accuse a sitting president of wrongdoing. But attorney general william barr testified to the Longstanding Justice Department regulations known as the olc opinion was not mueller sticking point. He was emphatically not saying but for the olc opinion, he would have found obstruction. Bret barr said that he t reach in a decision on any obstruction charge, and that underlying facts were an issue. Of the future case against the president might be such that a special counsel would recommend abandoning the olc opinion, but this is not such a case. And the 448 page report was released in midapril, barr explained that he worked with ebony general Rod Rosenstein to look at the evidence against a president. And he came up short. We accepted the Legal Framework in reaching their conclusions. Mueller addressed the dispute against the attorney generals decision to release a fourpage letter to congress obtaining barr assessment of the conclusions. I looked at certain portions of the report to be released, the attorney general wanted to make the entire report public at once pay to speak of the ten minute statement, mueller emphasized the core issue. There were multiple systematic efforts to interfere in our election. And that allegation deserves the attention of every american. Taking no questions from reporters, the fbi director indicated that he would resist further comment. There is my testimony. I would not provide information beyond that which is already public in any appearance before congress. Access to the reports underlying records as being decided by another office adding that he would not provide information beyond what is already available setting up another potential flash point with investigators. Bret do we know when the Inspector Generals report is supposed to come out . The Inspector General is handling multiple investigations. The focus at the very least in the genesis of the russia probe. The best estimate based on my reporting is sometime in june. It will be late june at best. Bret catherine, think you pray of the Term Administration was given an advance warning of muellers Statement Today. After watching the special counsel, they had a coordinated response. It is time to move on. Correspondent kevin corke has a reaction the white house. From the pipes president of the White House Press secretary, to the Trump Campaign to the private attorneys. A mutual blizzard of statements from inside and outside the Trump White House about bob muellers comments today, each with a definitive conclusion, jay sekulow said it puts a period on a 2year investigation, the Trump Campaign wrote that there was no case of obstruction, even Vice President mike pence weighed in. The investigation is complete. All for claiming an end to the investigation that the white house officials believe should have never taken place to begin with. He said that it was completed. He is case closed, and shutting down his office. And going back to his private life. We think that it is great that he is doing that and we hope that everybody else does that as well. The sentiment echoed by the president who took to twitter to claim his innocence. There was insufficient evidence and in our country, a person is innocent. The case is closed. Case closed from the president s perspective, but not to mueller whose comments today lead the white house to wonder if he was nearly setting the stage for Congressional Democrats to continue a impeachment drumbeat. Rudy giuliani, a frequent critic of the team was bemused. When a prosecutor cannot reach a decision, that is a decision. There is no case on obstruction, there is no case on obstruction, and i never exonerate everyone. Is there enough evidence to bring a charge or isnt there enough charge . End of case. Barring a congressional subpoena, making his continuing looking at not testifying further. The words are the final report on the topic. No word at the white house whether the president will have more comments of bob muellers reports today. Bret kevin, thanks. The democrats running for president to lead the loud calls for impeachment proceedings to start on capitol hill. And it is not just democrats. One of the loudest voices in congress now for impeachment is Michigan Republican justin amash. But the democratic speaker of the house is looking at a different approach so far. Peter doocy reports from capitol hill. Speaker pelosi says that she would rather have six different house committees looking at the present and then one streamlined impeachment proceeding for now. Nothing is off the table. But we do want to make such a compelling case, such an ironclad case that even the Republican Senate would look at the time that seems to be not an objective jury, will be convinced of the path that we have to take as a country. To do that, the number 2 democrat in the house wants Robert Mueller to do something that he does not plan to pay to testify before congress, and writing that to the president has not been cleared of wrongdoing and given the seriousness of the interference in the democracy i believe that the American People deserve to hear testimony from the special counsel about the report and the reports conclusions, does that mean that there could be a subpoena in muellers mailbox . Has Judiciary Committee chairman was asked today . Mr. Mueller, told us a lot of what we need to hear today. It is very important to be clear on what he told us. Speak of the Top Republican on that committee, doug collins says while i had hoped to that he would come before the committee and answer questions from lawmakers, Robert Mueller has led an extraordinary life of Public Service and is entitled to his life as a private citizen once again. At least eight democrats running for president are calling for impeachment and they have an unlikely ally, congressman justin amash, a republican. I think that it is very important that we do our job as a congress. Amashs rebellious tome was shrugged off by kevin mccarthy. He wants to have attention. Last night to amash clapped back pay you saw what happened from her so call leader kevin mccarthy. I read the Mueller Report and im sure he did not. He is the only person in his party pushing for impeachment and join several dozen democrats, but their numbers are not big enough to move the speaker yet. Many constituents want to impeach the president , but we want to do what is right and what gets results. Nancy pelosi has had a week to think about what President Trump told her when he walked out of their infrastructure meeting at the white house. And that is that House Democrats can either go down the investigation track or the investment track. And it seems like for now, nancy pelosi picked the investigation track. Bret peter doocy live on the hill, brit hume joins me now for analysis. It is been a long day. You know, it seemed like what mueller said was in the report. Yes, it is not a legal matter that he moves the ball really at all today. Everything he said as you suggest was in the report and echoed the report in some cases it sounded like direct quotes of the report. As a political matter it is a little bit more complicated. You heard the renewed calls for impeachment, and the expressions of interest in the fact that he reiterated the president was not exonerated especially on obstruction of justice. But if you listen to nadler after hearing what mueller had to say about testifying that the impeachment cause lost some ground for this reason. One of the reasons democrats are hoping for is that they can hold a series of wellpublicized hearings that would be broadcast live in which the Mueller Report would be thoroughly gone through and discussed, and perhaps with greater impact that it had when it was released on the public and that that would build a case against the president. It sounded like he was not at all confident that they would get him to testify, and if he did, it would not be the four corners of the report which means that they would not get the things that you are accustomed to getting out of the hearings when witnesses come forward and drop bombshells. It sounds like there would be no bombshells if there had been any already. Bret that would be a calculation whether they call or subpoena him and hear the report, which mueller seem to be okay with that especially on the rational parts and what russia did. The other thing that was striking was that the prosecutor traditionally is a go or nogo, we do have a case where we dont have a case. But people pointed to this, this is jim comey talking about Hillary Clinton. Although there is evidence of potential violations of the statutes regarding the handling of classified information, our judgment is that no reasonable prosecutor would bring such a case. And looking back at our investigations into the mishandling or removal of classified information, we cannot find a case that would support bringing criminal charges on these facts. Bret jim comey says that Hillary Clinton did it, but she did not intend to, we exonerate her. Mueller says we cannot find evidence that he did it, but we think that he intended to, so we cant exonerate him. He is saying because of Longstanding Justice Department policy that they could not indict him . So it would not be fair to accuse him, because he would not have a trial where he could clear his name. Bret other than the public trial . Exactly right, if you follow that logic it would have meant that on the issue of collusion and conspiracy on which he did clear the president , basically, that if he had found otherwise, there had been a conspiracy with the russians, he cannot upset that either for the same reason. I dont think that holds up very well if you look at it that way. And i think that it leaves the impeachment policy with a little bit of a problem, and that is that in the end, there was no charge. And if you talk about impeachment, it is politically and constitutionally correct that a person can be impeached for anything that the congress decides is impeachment worthy. But the constitution talks about treason, bribery, and high crimes of misdemeanors, which is the appraisal that countless americans have heard, and the association with impeachment. If you come forward with something for which such a crime or even misdemeanor was not charged, you are going to have a hard time making people believe that you are on the right track. Bret we will see, as always, thank you. The dow finished 221 today after being down more than 400 earlier in the day after muellers investigation. The s p 500 lost 19, the nasdaq drop 60. Supreme court before the 2020 election, he will push for a vote in the senate and to fill the vacancy. Three years ago you may remember that he orchestrated the block on president obamas choice of Merrick Garland after the death of Justice Anthony scalia saying that the choice should be left to voters in an election year. Senate minority leader Chuck Schumer called mcconnell a hypocrite on twitter today and warned that he doubts mcconnell will ever allow a confirmation of a democratic president s nominee for the high court. Spokesman says the situation is different, because the senate and the white house are held by the same party. There is no vacancy on the court, and no justice has publicly indicated that there will be one. President trump tweeted a warning to alabama republicans, the consequences will be devastating if republican roy moore runs again for the senate in 2020.
