Lets talk about the fact that South Carolina does not have a hate crime on the books. How does that affect this case . I dont think it affects it that much. Hate crimes make it a little bit harder for the prosecutor to prove the case because there is an additional element. They have to prove why the person committed the murder not that they just committed the murder. In this circumstance many jurisdictions find it burdensome. I think the hate crime statutes are more political in nature. They show the community or the target audience that theyre there for them they look to protect them. They just have enhanced penalties. Here we have nine murders. This person doesnt need hell probably get the Death Penalty. Lets look at the states that dont have hate crime statutes georgia, wyoming, arkansas, michigan South Carolina. Youre saying he will probably get the Death Penalty as well. An admission of hate crime. Race color, religion national origin, gender, Sexual Orientation orientation, gender identity. In this case because he went after africanamericans, it would fall under the statute if there was one. Absolutely. There is a federal hate crime statute, and typically the federal statute is sort of a backstop if the state prosecution doesnt result in the appropriate result, the federal federal government will step in the Justice Department will step in. Will that happen before or after the first trial . Typically the feds wait to see what happens in the state prosecution. To give an example, the eric garner case. They didnt get a grand jury indictment. The feds are now looking into the violation of civil rights. Because many times in cases like this that are horrific that seems to be the defense. Do you think thats going to happen here . Certainly the defense lawyers will pursue whether or not they can get support for an insanity defense. Theyll have him evaluated by psychiatrists. There is so much evidence of guilt here theres very little room for them to defend this case. So as a matter of course they will look at that. I dont know what his psychological evaluation is but it takes very little for them to find you sane to stand trial. Typically, during arraignment, you are assigned a public defender who might not be the same one, it might not be the same one who will conduct the trial, but yes, hes entitled to representation at this point. Thats the only way someone is going to present is through an attorney. Do they say, you get this one . They have the ones that handle the more serious cases, murder the ones where the defendant is really loathesome and they committed the most serious crime. Theyre the most experienced at that.
