Hes charged with nine counts of murder one count of weapon possession for a violent crime. Theyre still looking into hate charges. South carolina has the Death Penalty which warrants more than one person killed in one act. And governor nicki haley says shes for it. Nick fatuna will give us an nalz analysis now. It was interesting to hear the judge talk about a speedy trialbail. He cant be a flight risk and he cant be a risk to other individuals. There is no way the judge is going to let him out in the community again. Hes a hateful person with a tremendous amount of problems limited education. They dont want him in the community. Lets talk about the fact that South Carolina does not have a hate crime on the books. How does that affect this case . I dont think it affects it that much. Hate crimes make it a little bit harder for the prosecutor to prove the case because there is an additional element. They have to prove why the person committed the murder not that they just committed the murder. In this circumstance many jurisdictions find it burdensome. I think the hate crime statutes are more political in nature. They show the community or the target audience that theyre there for them they look to protect them. They just have enhanced penalties. Here we have nine murders. This person doesnt need hell probably get the Death Penalty. Lets look at the states that dont have hate crime statutes georgia, wyoming, arkansas, michigan South Carolina. Youre saying he will probably get the Death Penalty as well. An admission of hate crime. Race color, religion national origin, gender, Sexual Orientation orientation, gender identity. In this case because he went after africanamericans, it would fall under the statute if there was one. Absolutely. There is a federal hate crime statute, and typically the federal statute is sort of a backstop if the state prosecution doesnt result in the appropriate result, the federal federal government will step in the Justice Department will step in. Will that happen before or after the first trial . Typically the feds wait to see what happens in the state prosecution. To give an example, the eric garner case. They didnt get a grand jury indictment. The feds are now looking into the violation of civil rights. I want to alert viewers that what you see on the left side of your screen is what were waiting for, the alleged suspect come in for his first court hearing. It may be swift, it may not be but the judge has two things to think about. Risk to citizens in the community, yes or no. And is this particular person alleged murderer a flight risk. How does this factor at all into this particular phase of what were doing now . Because the crimes are so substantially different, theyre mostly minor crimes, trespassing, he acted very strangely in one of the stores possession of illegal narcotics. It was a Prescription Drug that he didnt have a prescription for. I dont think its going to have a big impact on what his propensity to commit further crimes when theyre analyzing this. The crimes he just committed now, nine people dead. No matter what his prior criminal history, that alone is enough to keep him in. Okay. What about the insanity situation . Because many times in cases like this that are horrific that seems to be the defense. Do you think thats going to happen here . Certainly the defense lawyers will pursue whether or not they can get support for an insanity defense. Theyll have him evaluated by psychiatrists. There is so much evidence of guilt here theres very little room for them to defend this case. So as a matter of course they will look at that. I dont know what his psychological evaluation is but it takes very little for them to find you sane to stand trial. Its just a very low standard whether you knew right from wrong at the time you were committing the crime. Stand by if you can for just a moment. Is mike tobin Still Available for us by the way . I wanted to tell our viewers it looked as if a Police Officer came out and did this with his fingers, giving the sign of two, which were going to assume this could be a twominute warning before we see this alleged murderer come in and face a judge for the first time. How does a confession play into that . A confession properly taken is one of the most powerful evidence a prosecutor can have. Witnesses in a high stressful situation like that dont have the same perception. Lots going on with those people theyre targets of the crime themselves so theyre not necessarily the most reliable reporter of the facts. He confessed to the crime. If they dont have specific forensic evidence you have witnesses saying contradictory things this will be a very powerful tool for the prosecutors. You know theres got to be a broader policy issue to stop these kinds of acts or to you know prevent these people from going this far. Its really terribly unfortunate. Whats going to happen for the kind of attorney that dylann roof is going to get . Ostensibly hes going to be given somebody by the government right . Right. Hell probably be appointed a public defender. Im sure within the community hes going to be ostracized somewhat but those guys are usually professional. A man or woman will be ostracized for taking the case. Do they have a choice . In most cases, i guess if they have extreme objection, but thats part of the job. They have to take the case. Someone has to be assigned in the prosecution center. Theyre usually very professional. They dont take the Community Pressure so hard and they usually do the best they can for their clients in these circumstances. Are we going to see that public defender at this hearing . Typically, during arraignment, you are assigned a public defender who might not be the same one, it might not be the same one who will conduct the trial, but yes, hes entitled to representation at this point. Thats the only way someone is going to present is through an attorney. Do they say, you get this one . They have the ones that handle the more serious cases, murder the ones where the defendant is really loathesome and they committed the most serious crime. Theyre the most experienced at that. They have a rotation within that group and they get assigned. Interesting. Part of the conversation has to be how do we encourage people out there to kind of selfmonitor. The last thing we want is vigilantes to turn people in for their own agenda but we have to learn how to recognize some of these things and who to tell. Judge james gosnell, rob, who started off with a speech of his own, and it would be my understanding that thats quite rare for a judge to make a Statement Like that. Today were reaching out to everyone were reaching out to the victims of the nine people who were murdered their families but were also reaching out to the victims on the other side of this story. Were reaching out to the victims on the side of this alleged murderers family as well. Is that rare . You know gretchen ive been in Law Enforcement a long time and ive attended a number of criminal trials and bond hearings and ill tell you, to be honest this is the first time ive ever seen a judge give that preamble that he did prior to even holding the hearing. Not only was that unusual, but even at the end when he had the victim impact testimony thats what that was called victim impact statements we usually dont see that at a bond hearing. Usually you wait until the end of the trial and then you have the victims families come in. I dont know why this judge would, in fact put the family members through this today to face this monster when they havent even buried their loved ones yet. You dont agree with it then . Im sorry; what was that gretchen . You didnt agree with him having the family members come forward. No not at this point, thats too much for the family members. I dealt in homicide i dealt with family members, and right now thats too much for them to face this monster. Those people are hurting. As you know, and as youve been reporting, gretchen they dont need to be in that hearing facing this monster today. That bond hearing should have been three to five minutes and it should have been over. Thats an interesting take. I want to bring back in richard fortuna. Have you ever seen anything like that . No never. I understand robs point on this but one of the things i think the judge was doing was looking past the family and looking at the community. Giving the victims an opportunity to speak in court is not just for the victims, but it allows the frustration to come out. Otherwise it stays bottled up. The community is grieving as a whole, so vicariously they were acting for the community, and i think the judge saw that and gave them an opportunity to speak. I have to tell both you gentlemen that i was astounded at the words that we heard from these victims family members. As you say, rob, they havent even been buried yet, and these are just snippets the family of ethel lance, her daughter i forgive him. She went on to say, ill never talk to my mother never again. May you have mercy on your soul. I forgive you. The family of Myra Thompson anthony thompson. I forgive you. I hope you will repent and confess. Christ can change your ways. And it goes on and on. To another victim felicia sanders. Every fiber of my body hurts. He was my hero. May god have mercy on you. Deep in my heart, my goodness these people are already forgiving this potential monster. They are. These are goodhearted people. None of these people deserved to die. I want to mention one thing nick just touched on. I know what the judge was trying to do when he was talking about the community. But lets face it this young man, even though hes a monster, he has his right and he has his right to a day in court. Hes not guilty at this point. He hasnt been in the court so we have to be careful about that. Do you agree, nick . Rob, i do agree with you, but it was a bond hearing. The judge took the opportunity to address the Community Concerns and it is the most unusual thing ive never you know. But maybe he thought the issue was bigger than just this hearing. He had no authority to set bond on the murder charges. We were talking earlier there was no way. I wanted to ask you about that. So he sets the bond for roof at 1 million, but thats only on the one count of a weapons charge. Right. Possession of a loaded weapon. So why cant he have anything to do with the nine counts of murder . Its a statutory provision. Some states have that youre not allowed to set bail on murder charges. If you do so hes automatically remanded. He has to be held once he starts with murder. So theres no way if he comes up with a million bucks hes getting out . No he still has to stay in. What that does is for some reason if the murder charges are dropped, which isnt going to happen he still has a milliondollar bond on the weapons charge. Rob, take us through the next phase. This is judge james gosnell. And this came out about 15 minutes ago where he came out and gave a preamble to the community. Rob, tell us this. October 23rd and february 6. He already said when the next hearings will be. Whats that mean . Hell start meeting with his attorneys and theyll build a case. Then theyll go into a negotiation phase with the prosecution. Thats what will happen because the evidence is really overwhelming. I cant even see this thing going to trial at some point. I think theyll just end up reading some kind of plea agreement. Were waiting right now. The attorney for the ninth District Court about to give us an update on the court. This is going to be a press conference, as you can see, on the right side of your screen as we just heard from dylann roof. Hes going to be in a second appearance on february 5, 2016 if we can already put our brains that farah head ahead. Now were waiting for this other press conference. What do you think we might find out here nick . At this point theyre going to talk about how the charges are going to proceed, probably and what they intend to do as far as the Death Penalty is concerned. But theyve already started talking, the governor of the state already said they absolutely intend to pursue the Death Penalty. Is that her decision . No its the prosecutors decision on that. Its within their discretion. One thing i would say is that if there is a trial, its because they are pursuing the Death Penalty because they have nothing to lose by going to trial. You know if they dont take a plea for something less than the Death Penalty, which it doesnt sound like at this point anybody is inclined to do, the defendant has nothing to lose by going to trial. We did some research here. Rob, South Carolina has the Death Penalty but they dont use it as often as you might think. For example, they dont use it as often as texas, or probably in the latter days virginia for that matter. Does that have anything to do with this case at all . I dont think it will. The bottom line is this kid, if he is convicted and they do have the Death Penalty there, i dont see any way out of the Death Penalty for him. I think he is doomed if you want my opinion. If you listen to this if thats any indication of anything. And im not suggesting this kid is a monster, he is a monster, but all im suggesting is he is entitled to his rights and his day in court. Rob, were you there with me and watching from the beginning to see this alleged murderer and the way he answered the judge . He seemed tobacco be coherent . He seemed to answer with yes sirs. He also said he was unemployed and he was 21 years old. Did that mean anything to you . No it didnt and i listened very a tentatively to what he was saying. I didnt pick anything up one way or another. He was probably instructed by the defense attorney how to answer and thats exactly what he did. Does any of that play his demeanor there and how he answered the questions, enter into any kind of insanity defense . Theyll look at his behavior before evaluated, but the most important part is to have him evaluated by a psychiatrist get the report on whether or not he is sane enough to stand trial and knows right from wrong and can help in his own defense. Im saying just in this little bail hearing, he seems to understand the judge quite well. Does this play into it . Theyll evaluate all his behavior prior to going into the medical evaluation. Individuals coming from as close as a nearby restaurant a waitress coming here to deliver flowers and a card. Also people coming from hundreds of miles away. One man, an artist said he had a piece he worked on that he wanted to bring here and pay his respects so he drove two and a half hours from northwestern South Carolina and did just that. All of that to pay their respects. I told them this was a Historical Church and its always been historical and it was sad this incident had to happen. I think the Community Response has been awesome. I think the nations response has been awesome. I think everyone of all races and all creeds and genders are tired of hate. Delighted. Even under these horrible circumstances, still to see everybody coming together like this just warms your heart. One reporter one woman who came here from buford South Carolina said she was watching everyone pay their respects and she said it feels like the 1960s again. She said there was hope that black and white people were coming together to pay their respects and try to heal. Gretchen . I know vigils are sprouting up all over town but what about anything organized . They will have a vigil at the college of charleston this evening. Then on sunday, this city known as the holy city because it has more than 400 places of worship, will be asking any of those places with a bell to ring it at 10 00 in the morning. Thats whats planned so far, but this vigil breaking up we had no idea it was coming here until a short time ago. So we expect to see this throughout the weekend and perhaps the weeks to come. In South Carolina the way that it works, it goes before a Circuit Court judge, which is a different level of a judge. This is a magistrate. He even identified himself as a magistrate the guy today, and he said that he did not have the authority to obviously, to issue a bond on the murder charges. But thats going to go to another level of judges. Now, will roof be allowed to get bond on the murder charges . He will be allowed that if the judge sees fit. But if hes a flight risk as you talked about earlier, gretchen he will not get bond. And i can tell you right now, hes never going to get out. He wont get bond. What would they even set it at i cant even think of past examples can you . Can you think of past examples when anybody has received bond when they murdered nine people . If we really dig deep in history, well find something, but a case with this much noto rirks e riety and everybody watching he is a flight risk and i cant sigh judge in this country giving him a bond. So well have to have a second hearing . We have to the Circuit Court judge come in and talk about the nine counts of murder. And i think thats the hearing in october. October 23rd 2 00. So were not going to hear anything about this until october 23rd at 2 00 p. M. Maybe, maybe not. The reason i say that is because you have to keep in mind now, roof has an attorney and his attorney is going to start see some movement before that october date. It just depends on how much they come together and i can tell you that one of the judges is going to issue a observation, a mental observation on roof before even that next court date.
