FOXNEWSW The Story With Martha MacCallum November 23, 2019

He is the man democrats have claimed would be the final nail in the coffin. Bolton returned to twitter today, claiming the white house had, quote unfairly suppressed his account out of fear of what he may say. Tonight, the two lawmakers who sit on the committee that holds keys to what comes next. Republican Intelligence Committee member Brad Wenstrup and democratic judiciary Committee Member madeline dean. Lets begin with congressman wenstrup. Congressman, good evening to you. Used to being in the morning. Great to hav on the program tonight. This is a huge week, a huge couple of weeks, first off, where do you stand on the chances that this actually goes to the senate . Well, that remains to be seen. I think you can only get that answer from adam schiff at this point and maybe his democrat colleagues and nancy pelosi. You know, i think that we heard from a lot of people. A lot of people that had no firsthand knowledge of any wrongdoing no one none of the witnesses could come forward and say there was some kind of crime. We will see what they decide to do with it. For all i know, he may want to call even more people in. That remains to be seen. But there were witnesses who said that they grew very concerned and notified the correct authorities of their concerns. And i spoke with a lot of democrats this week, congressman, who said they were very troubled by what they heard. So, this could move on to judiciary. I know adam schiff is already prepping that report that would go onto the judiciary. And eventually it could make its way to the senate the president says bring it to trial. Would that help or hurt the president make his case for innocence in all of this . I think im sorry, im having trouble hearing. Sandra i can tell. I apologize i think you were talking about the president wanting to go to trial. Sandra you get your piece set so you can hear me. This is peggy noonan talking about the witnesses that the president and his team could pull forward in the case that this does go to trial. She questions that. Saying that the case has been so clearly made you wonder what exactly the senate will be left doing how will they hold a lengthy trial with a case this clear . Who exactly will be the president s witnesses . Those who testify he didnt do what he appears to have done and would never do it . So, how would republicans strategize this . And im hearing now thought congressman cannot hear me right now. So lets bring the congresswoman. Democrat, madeline dean who sits on the house Judiciary Committee. We will try to get back congressman wenstrup as live tv goes sometimes and i will ask you the question, good evening, congresswoman. Good evening. Sandra what happens next steps now that the public hearings have concluded or at least for now in the house Intelligence Committee . What happens when that report is completed and then goes on to the Judiciary Committee . What happens next . Well, sandra, first, thanks for having me on. I appreciate the chance to talk to you about this. The way you began this is what the president said today he looks forward to a trial he wants to bring forward witnesses which is absolutely puzzling to me. I sit on judiciary. Im a member of the house he had the opportunity to bring forward witnesses. He had the opportunity to bring forward any kind of exculpatory information and witnesses. In fact, he blocked subpoenas. Lawful subpoenas. He has obstructed congress from doing such oversight. So that actually. Sandra perhaps you are giving us an idea of what the articles of impeachment that would be drawn up might look like. Give us an idea. I dont want to preview that for you for a simple reason i am a member of this Judiciary Committee. I take my role incredibly seriously. Certainly we have just heard two weeks worth of damning testimony from career long democrats who dont have a political dog in this fight. They have only our National Security and peace and diplomacy around the world at stake. So what i will say is the judiciary is awaiting the report, as you know from the resolution House Resolution 660. We will receive a report from the Intelligence Committee as well as any other committee of oversight and from that we will draft articles of impeachment. Sandra all right. So where do you stand, congressman, on what you heard over the past couple of weeks. I believe it was over 31 hours of public impeachment hearings do you believe what you heard were Impeachable Offenses by the president . I thank you for that question. I actually had the opportunity yesterday to sit in the hearing room when mr. Holmes and dr. Hill testified how grave and serious the moment was and thats true when we heard. I was in also when ambassador bill taylor spoke at Marie Yovanovitch the ambassador spoke. These are people of extraordinary credibility. I also sat in briefly on ambassador sondland. So we heard from most of those folks, incredibly equipsing credible testimony of bribery by a president of of a president. Sandra pointed out many times in that hearing room none of those witnesses used the word bribery, congresswoman. And as far as the convincing is concerned of even a moderate republican, like congressman hurd, who was looking to take sides on, this and has hinted that he would be a no on impeachment he is not up for reelection. He has nothing to prove to the president here. And this is an incredibly important moment in our countrys history. So, put it to the American People what exactly was it that you heard and republicans make the case that on many occasions which is what someone heard someone say. In the case of that phone call. What is it that you heard spengegly that is you are basing impeaching the president. Lets dismiss hearsay evidence it is credible. He we dont need just hearsay. We had firsthand folks in on the phone call. Hut testimony, dr. Hills testimony was without any kind of scrutiny. The credibility and the precision of it, she spoke so concretely without any kind of inflammatory language. Mr. Holmes, he was the firsthand witness at that restaurant in kiev, where ambassador sondland holding the phone away from his head showing off the noise of a president barking about are they going to do the investigations . We had firsthand witnesses of what the president admitted to. Sandra to be clear he was not on that phone call. He overheard the phone call. Thats correct. Sandra i want to be clear what happens then. We get where you stand on this. And we have lost congressman wenstrup by the way. I hope you do. I hope you get where i stand. Where i stand is for our constitution. Sandra i heard you say you believe the president committed an Impeachable Offense; is that correct . I believe the evidence thus far shows Impeachable Offenses. The president has every opportunity and has had every opportunity to bring forward exculpatory information and witnesses. And what did he choose to do. Sandra if there was a vote taken up today would you vote yes to impeach the president. I dont answer questions like that because we dont have a vote today we dont have articles of impeachment. Sandra it seems odd that if you had heard something that was very evident of an Impeachable Offense that you wouldnt answer it. Its a yes or no question. I think we hear no, it isnt. No, it isnt. This is an extraordinarily remedy our constitution provides for an impeachment only as a last resort and so why would anybody prejudge a vote when you dont even have the articles in front of you. I would never do that. What would happen once this gets into the Judiciary Committee would you hold hearings . Would they be depositions behind closed doors . Would they be public hearings . Will that even happen . I believe we will have some public hearings. I know at this point we are waiting. You know we are on thanksgiving break. I just came home by train to philadelphia today. We are awaiting the report of the Judiciary Committee and as well as the other oversight committee. Once we have their full report, our staff, our attorneys are fully ready and my own staff is fully ready to review that information and begin to craft articles of impeachment. Sandra who would you call forward as a witness . I will not be in charge of calling forward. I will be able to ask and suggest who we will call forward. I would assume. Sandra fair enough. Who would you suggest . One of the panels would certainly be mr. Schiff and those who would make the case to us for what it is they learned as a result of their. Sandra john bolton . I would like to speak to john bolton. Absolutely. Sandra is that in the works already . I dont know. Thats above my pay grade. We know adam schiff in the house Intelligence Committee said he wants to have john bolton as a witness. But it would have to take a while, potentially and he is not willing to wait. Im just wondering if the house judiciary has already gotten the ball rolling on that. I believe its john bolton who actually while he has a book deal he also is in court to find out whether or not he should come forward. He has been separated from this administration. I believe its his public duty as dr. Hill said yesterday. His public duty. Our founders and in the federalist papers, hamilton wrote in federalist 84 that there are good people close to or at the center of government who will sound the alarm for the rest of you was citizens. We have heard that over the course of thieves last two weeks. Good people sounding the alarm. I hope National Security advisor, former National Security advisor bolton is among them. He has a lot of information to tell us. And all we need is the truth. Sandra i will end on this, congresswoman, you are the third democrat in the house that i have spoken to today all three of you will not commit to whether or not if there was a vote taken up to impeach the president today whether or not you would be a yes. Im wondering why that is. Because you have not told me the substance of the vote. I would have to know the article of impeachment that im voting on. Sandra the purpose of the public hearings this week was to hear evidence of Impeachable Offenses. So it was just whether or not you came to a conclusion on whether or not you heard anything in those public proceedings. Final thoughts. You do you understand whats missing . Whats missing is what are the actual articles of impeachment so we will thoughtfully craft those. Can i add one more thing if you dont mind . Because i think the american public, this might be lost on them. At the same time, while all of this important investigation is going on the house has been very busy passing legislation. This week alone, we passed the continuing resolution to keep this government open. In the face of the senate not moving the budget forward. But what that continuing resolution did was it got a pay raise of 3. 1 to our veterans. It fully funded the census. So we have to do both. We have to continue to do substantive work and we have to continue the process of impeachment. So dont be alarmed if someone wont say yes, i will vote for impeachment now. Sandra not alarmed. Its just a question we certainly appreciate your time tonight. We will certainly be following up. Thanks for having me on. Sandra we will see more from the Judiciary Committee in the days and weeks to come. Thank you. We have some breaking news tonight. Sandra breaking news tonight even more details appear to be breaking out from long awaited report deep statement involvement in 2016 campaign. According to the names. The report will name at least one level fbi official, a lawyer named Kevin Kleinsmith accusing him of manipulating the details of an email. Used to later obtain surveillance warrants or carter page. Fbi attorney number two. From the june 2018 ig report. That would make him the unnamed fbi official who was removed by special Counsel Robert Mueller after his election day Text Messages came to light telling another fbi employee, quote i just cant imagine the systemic disa e assembly of the progress we made over the last 8 years. Aca is gone. Who knows if the rhetoric about deporting, paper, walls and crap is true. The crazies won, timely, also, pence is stupid. Here with reaction to that matt whit ter under President Trump. Matt, good evening to you and thank you for being here. What do you make of that . Its unfortunate. Described in the news reports low level fbi lawyer changed a document that was used to get this fisa it thats caused a lot of controversy it. Brings into question the entire process with which these fisa or foreign intelligence warrants are obtained. Then the question is who knew or who should have known that these documents were manipulated to, you know, by in part to get this warrant. The American People expect this report were going to have two weeks from monday to shed a lot of light to hold people accountable and also provide some transparency to this whole process the. Sandra more on mr. Cline smith and what he did here. He took an email from an official at another federal agency that contained several factual assertions. Then added material to the bottom that looked like another assertion from the emails author when, it was, instead, his own understanding. Mr. Clinesmith include compiled for another official to read in signing an affidavit that would be submitted to the court attesting to the facts and analysis in the wiretap application. Obviously we are going to learn a whole lot more why do you think we are getting this now . Well so, why we are getting this now is there are certain individuals that are named in this report and criticized in this report together with folks at the department of justice that have seen it. I think some of these are peremptory to try to shape the message coming out of this report. My understanding this report is its going to be very critical of not only the carter page fisa but also the fisa process generally. So, you know, i also think the American People have watched two weeks of people presuming things like this gentleman did. So i think, you know, at some point in time the actual facts matter. And in this cases in obtaining ex parte, meaning the person you are surveilling doesnt have a lawyer that represents them and doesnt even know they are being surveilled, i think this is a very dangerous to have anybody in the chain of obtaining that warrant that would manipulate evidence or information to obtain that. Sandra President Trump suggested that that the the revelation of this report, horowitz report december 9th its expected. We will hear testimony from horowitz himself its estimated december 11. He projected that this is going to be historic. Do you believe that it will live up to that level of expectation . I do one of the controversial Inspector General reports we have seen in the last two decades. I think it is going to hopefully begin the process of a restoration of confidence in the department of justice and the fbi that i think was lost to some extent through the mueller investigations and through this carter page fisa situation and i hope they lay out as many facts as possible as to how we got here. Because, you know, there are just so many open questions.
