The governor and the state activated the National Guard, of course, they are all on pins and needles as we head into the evening hours now. In america of course is fighting to get back to normal. This situation is nothing like any normal that we want to be in. It is tragic enough that george floyd had to die like this with an officers knee on his throat. There are calls across the country for the rest of the Police Officers that are involved. The fbi is on the scene and they are also investigating, the federal government involved as well. Two of the four officers have been involved in several prior incidents we learn today where their behavior at crime scenes was brought into question. But now the city that george floyd called home is being torn to shreds by criminals who loot and burn under the guise of protest. One person was killed in this looting situation last night that was just unbelievable. Look at the fire that that city is in. This was provided for a journalist, we will hear from very shortly, look at all of the businesses and the buildings that were burned down last night. Target, look across the food stores, dollar tree, all of these places just burn down in the middle of the neighborhood in minneapolis. We are going to talk to him shortly. Many of these businesses have been closed for months due to coronavirus. Lots of things do to reopen good Outdoor Dining centers reopening, supposedly in minneapolis on monday, so even the restaurant where george floyd worked, which was closed down because of coronavirus. He was a tenant in an apartment owned by the people who owned the restaurant where he worked as a couple of miles where you see all of this unbelievable damage tonight. So we will talk to kyle lewton who shot this disturbing video. He was on the scene all throughout the night last night. And as the tensions continue today. Watch this. [shouting] [chanting no justice, no peace] joined by federal prosecutor, and governor from South Carolina, we will speak to him in just a moment, fox news contributor. But we begin with mike tobin, also live on the ground there tonight as minneapolis looks ahead to another evening that they hope will not look like last night. Hi, mike. It has already started in that direction as it was last night, martha, you already the clashes and tear gas out. And i have to go with the witness account, but somebody says there was someone injured on the ground. The paramedics showed up and they are was harassment of the paramedics. And the police said that they tried to give the paramedics some space to work. They got the teargas and cleared out that area, and everything has returned to normal, everybody back on the street in front of the third precinct which has become the flash point. What you heard from the u. S. Attorney is not what the crowd wants to hear. They dont want to hear about a long process and an investigation. They want to hear about swift arrest. They dont trust the process or the people involved. But the plea we got from the u. S. Attorney, give them some calm and give them some time to work. We understand the severity of the situation unfolding. It breaks my heart to see what is going on in our streets in minneapolis, and in st. Paul, and in some of our suburbs. And i am pleading, i am pleading with individuals to remain calm, and to let us conduct to this investigation. Back out here live, this is the crowd in front of the minneapolis third precinct. As you note, governor kim wells did activate the National Guard. You wont see they National Guard act in a martial law type of fashion. What you see is that they come to supplement the manpower. They enabled the police force west, the training of crowd control to do that thing. But you do see really small Police Presence here right now im keeping these people from getting into the third district, the third precinct i should say. This is where the flash point was where it all got started. And officers are bracing for another tense night, martha r. Martha mike tobin, thank you very much. My next guest was also on the ground last night, and captured some stunning scenes on video. A contributor at the daily caller, and he published these videos last night. Good to have you with us this evening. We are going to just start putting up some of these videos that you posted last evening. It is unbelievable the damage and the empty shelves as people are Milling Around in the us Community Stores in the neighborhood, probably where many of them live. In the most shocking thing to me when i was on the ground is realizing just how quickly the emphasis of justice for george floyd was lost. As it went on into the Early Morning hours, the original crowd that was there holding protest signs, doing chance, quickly deteriorated, and instead we saw a crowd of thousands of people drinking alcohol, smoking marijuana, partying in the parking lot and Looting Stores like target and burning down buildings like the construction project we saw. Martha everybody understands the impulse and the right to protest. What we all saw on that video, and that is justified. That is completely understood, what is not understood is the breakdown that leads for some of these individuals, and i want to point out that we are not talking about everybody out there last night, but what was your sense of whether or not they were local . Or they had come from other places . What was your sense of the crowd that was actually doing this . Thats a good question. My sense is that most of the folks were local. They knew their way around, people knew each other. There was a lot of interaction between different rioters and looters that were helping each other carry stuff around stores. There was a line where people were lining up and sending another person inside to bring cart fulls of electronics, televisions, other items, and loading it into their car. So i had the sense that it was people who were local and knew the area. Martha it is just unbelievable. It just attracts so much from the death of this man in their community, and it draws peoples attention away from where it should be in the middle of all of this. It is such a heinous act to tear down the buildings in your own community, when your community is suffering like this. It is just unbelievable. Can we just play one of these out so everybody can hear and listen to kyle on the ground last night. [sirens] ive never seen anything like this. [sirens] [shouting] martha it is unreal. It is just unreal. Can you play the one with all the fires and the burning buildings behind him and i want to ask him one more question. Lets see if we can switch over. There we go. The air is so thick right now. Yeah, i agree. This was autozone. You hear the explosions, guys. That is something else. Lets go around to the other side and see how far it spreads. No, the air is so bad for us right now. Yeah, i agree. Martha kyle what is your take away . When you look back at everything you shot last night out there, have you ever seen anything like that . And is that the story that you thought you were going to see when you went to cover the protest for the life of george floyd . Oh, absolutely not. I never have seen Something Like this in america, let alone minnesota. That to building that you saw burning in the background was intended to be a place where people of low income could live, that building was designed to better the community for the people that actually live there, and when they burned it down, it was really discouraging, both for me and a few of the other people that i talked to at the riot, and i think that watching the building burn in the community crumble really does detract from the injustice that george floyd suffered. In these clips of rioting and looting and debauchery take away from the entirely justified message that antipolice brutality protesters have. Martha it is hard to wrap your brain around how this is an outgrowth of what we saw in that video. And we hope that it stops. This obviously with a virus and the pandemic, we have been through such tough times for the economy, and your heart breaks for these people who are going to have to go back to that and clean that up in order to get their lives back up and running. Kyle, great work, i listen to it on daily caller and glad you could join us tonight. Thanks so much. Thank you for having me. Martha moments ago Eric Mcdonald gave the update on the federal probe into floyds death. Heres what she had to say. To speak at the department of justice has made the investigation in this case a top priority. And to be clear, President Trump as well as attorney general william barr are directly and actively monitoring the investigation in this case. Martha i am joined by House Oversight committee trey gowdy, a former federal prosecutor as well. This is just a heartbreaking story. And i think we focused a lot on the protest when we talk to kyle, and we want to get your thoughts on that. But at first i want to go back to the legal side, because as mike tobin reported, what we heard from those who were going to try to find justice in this case just a little while ago is not necessarily what the protesters on the street want to hear. They want to see people arrested and have them happen now. I can tell you take the uniform off of that police officer, just have a knee on another mans neck, there is already an arrest. I dont need to wait on the feds, this is a violation of Minnesota State law. Its either murder 1, 2, or 3. So i am happy that the feds are investigating civil rights violation, but you can take all the time for that. There is no reason that this officer is not already charged with either murder 1, 2, or 3. Martha why do you think that is . I have no idea. I watched the video. I discussed it with tim scott on the way over here, and to see the officers hand in his pocket. He is under no threat, no danger. There is no resistance. And you have a guy literally the life stepping out of him, and there is an inherently dangerous act. It may not have been premeditated, take murder 1 off, but it is murder 2 or murder 3. In in South Carolina somebody would already be arrested. If you werent a cop, if it was just another person killing someone in the street, if exceeding them, there will already be an arrest. You have to ask minnesota why it takes that long to process a video . Its pretty clear to me. Martha im reminded of the other case that we were following of the man who was shot by the other two gentlemen in the pickup truck, and as soon as that video came out, thats what precipitated those arrests, because everybody could see what happened. This is investigated. That will go further. But your point is such a good one. When we have this video. We have also seen today surrounding videos, videos of him being taken into custody. He was handcuffed and seem to walk down the street. This all goes back to a store where he supposedly tried to pass off a counterfeit 20 bill, and then they called the Police Officers when the store realized or surmised that thats what it was. Is there anything else that you see on any of these videos that give you any indication that this is something other than what it looks like . No. I watch every video you can see. I was a state prosecutor as well as a federal prosecutor. I did a bunch of homicide cases. If i was a person of color, i would be wondering how dylan roof who killed nine people in South Carolina can be arrested, but mr. Floyd under suspicion of passing a counterfeit 20 bill cannot live through the arrest . I am not a fan of vigilante justice. You are creating additional victims and taking away from your argument, but it would do us all well to take a step back and try to see the genesis of this outrage. He was arrested after he murdered nine black folks in a church in South Carolina, and yet this guy cannot even survive an arrest for a counterfeit 20 bill. Martha this is the mayor of minneapolis jacob frey. Lets watch this. I believe in minneapolis. I love minneapolis. And in believing in our city, we must believe that we can be better than we have been. Martha you talk about the rule of law and you hear the emotion in his voice after what he saw and his city. And i know that you have concerns about what this means for all of us. What it means for the country when we look at this situation. My first question would be if you love minneapolis, why did you have a cop with this background . This is not his first foray into inappropriate conduct. If you love minneapolis, why are you hiring and retaining cops that have resumes like this cop did . I think bill barr, this is a state matter, but i hope that bill barr gets involved, and the first two phone calls he needs to make is to me, val scott, and val demings. We need a national conversation. It needs to be wrought and it needs to be frank and it needs to be honest, because we are not going to survive with a Justice System where communities of color do not have confidence, and it has been that way for a long time. We cannot have this talk after a black man is killed. We have to have it the day before somebody is killed. Maybe we can prevent the next killing, but we need to have a national conversation. And i would start with tim scott and val demings, and he can put whoever else he wants on it, but this needs to be an American Family conversation, not people putting torches to target stores in minneapolis, that is not going to accomplish nothing. Martha we can start it right here, maybe we can have val demings coming you, and tim scott all come together and we can talk about this. I would love that. Maybe we can put it together. Trey gowdy, thank you so much. Yes, maam. Martha we are keeping an eye on the situation throughout the evening and we will continue to cover it. Martha President Trump signing an executive order to go after practices on social media in a move that weakens Legal Protections for platforms like twitter and facebook. Two days after a pair of the president s tweets got the factcheck mark, which he did not like. Kevin corke has the story for us tonight from washington. Matt, kevin. President trumps decision to sign cracking down on censorship social media wide is a direct result of twitters decision to use that factcheck label on one of his tweets. Sources tell me tonight that it is about much more than that. They say that it is about unfair practices and selective censorship employed by many platforms including twitter and facebook for example. The new eo targeting Liability Protections through section 230 of the Communications Decency act. The choices that twitter makes, choosing to suppress, edit, blacklist, shadow, ban our editorial decisions. Pure and simple. They are editorial decisions. In those moments twitter ceases to be a neutral public platform and is an editor with a viewpoint. This executive order is a strong step to addressing the problem. It sets up a rule making procedure that will eventually be under the fcc to try to get back to the original interpretation and understanding of section 230. At the center of the action, section 230 of the Communications Decency act indemnifies twitter, google, facebook for any action taken in good faith to restrict access or availability of material, whether such material is constitutionally protected. You are free to have at it and have it however you want to. Unless you are censoring, then it is editorial. Bill barr who said that the doj would likely seek to sue social Media Companies because he feels like that statue mark has been stretched way beyond the original intention. Critics are howling saying that this is an affront to free speech. The aclu saying this, much as he might wish otherwise, donald trump is not the president of twitter. The order if issued would be a blatant unconstitutional threat to punish social Media Companies that displease the president. Of course, the president says that he expects a legal challenge to the eo, but he may have support from an unlikely corner, former vp joe biden. You may have heard this in january calling for the provision to be revoked. Ortho. Martha push comes to shove, saying thank you very much, kevin couric in washington tonight. President trump is set to make another big announcement. And this one is going to be on china. Its going to happen tomorrow. That is two u. S. Warships sail into the East China Sea and beijing forces are hand with a crackdown in hong kong. So where is this heading and how quickly is it escalating . Marc thiessen to talk about the next.
