The defense suggests that when kirk killed his wife in may 2014 he was so impaired by the marijuana infused candy that he may not have intended to kill his wife. Before her death kristin kirk told dispatchers that her husband was acting more drunk crawling to a bedroom window and cutting his legs on broken glass. Prosecutors argued that kirk had the wherewithal to remember the code to a locked gun and press the weapon to his wifes head.
