To me on the phone to discuss what this is doing in terms of our attitudes about it and polls related to it is our friend from The Washington Post Emily Gustin Emily thanks for coming on the show thanks for having me OK so the 13 are never grads 0 Republican oh wait that's right again never mind what is this doing in terms of the polls though what do we the people think of Robert Muller in this investigation in light of these attacks so I you mentioned the president doesn't think that the miller came and stare him but that is not what most Americans think they see special counsel or special counsel Mahler's running a fair investigation and concert. It's in him has either cells held steady or grown in recent months despite Republicans and Trump's increasing scrutiny of that fact you know he so. So we were saying. Hang on I think did these polls are they kind of differentiating his supporters versus kind of everybody else because I believe his approval rating is about the same as the number of people who are not confident in Robert Muller's investigation aren't there so we looked at a few different polls a purely suppose this past week asking how fair and how asking if they were confident that Muller would conduct a fair investigation and that was they released data split by Democrats and Democratic leaning independents who generally are less supportive of the president and Republicans and Republican leaning independents so that poll overall found 61 percent of Americans who are either very or somewhat confident that molar would conduct a fair investigation which was an increase from 55 percent who said the same in January and 56 percent who said the same in December if we split that by those Democrats and Democratic leaners 75 percent of them said they were at least somewhat confident and Mahler's investigation which is up from 65 percent in January so that's where the movement is the Republicans in the Republican leaning independents 46 percent of them are confident Mahler's probe which is about the same as it was in January. Oh this is really interesting polling data Emily Gustin is joining me from The Washington Post So while the president continues his series of attacks. And I mean you know I was arguing this against Judge Pirro and tommy warren Saturday night on Fox News and it's like no there's there's actually something to investigate here and Robert Mueller is well decorated Bremer's the Republicans who are like yes he's good let's get him on and so the American people are apparently for the most part ignoring the president's attacks. But now let's see I mean has it changed anything with Democrats as Trump attacks actually hardened Democrats into saying yeah of course I support Mauler What is that where the polls tell us about Democrats so there was a movement there with the Democrats or the Democratic leaning independents we saw 75 percent of them so they were confident in Miller which is up from 65 percent back in January another poll also found a little bit of movement there Maris did a poll in February 53 percent of Americans said Miller's investigation was fair up a little more than 40 percent in January and there is a similar partisan split there that Pew found so 77 percent of Dems and 51 percent of independents said it was fair which are marginally for both Democrats and independents again 35 percent of Republicans said it was fair 46 percent unfair so there is more agreement that Muller's fare among Democrats that's interesting again it was a Republicans were the ones who all came out when I was picked to be the special counsel and everybody said yeah no these meet and so it's just the way talk about propaganda and marketing and how all that works I wonder if Cambridge analytical was any part of it now and separate separate topic but I want one more question for you though Emily Gus skin is joining me from The Washington Post and I know this is not part of the article today which is Trump is attacking Muller as faith in the special counsel is rate rising. You know you guys do a lot of polls at the Washington. I was in with other organizations and you're always reviewing the what's going on with with the president trumps numbers because didn't he just say like last week or the week before he's like never been higher in 50 percent that's not true is it well the data that we've been the most frequent tracking poll is the Gallup tracker and our last poll which came out of the field on the 18th which 2 days ago they had 40 percent approval for the president shot performance and 56 percent disapproving which is pretty much where it was the week before they're doing a weekly weekly poll now are they used to do some daily averages so last week on the poll that went out of the field on the 11th had 39 percent approval and 56 percent disapproval so that's not really much of a difference and it's been at that point for a while the last 1234 weeks it's been either 39 percent or 40 percent and the highest approval rating we have for him on record is the 1st week of his presidency January 29th 2017 or he had 45 percent approval the lowest we've got in the Gallup tracking list 35 percent in October 27 teen has President Trump come out and said and we got going that's all fake news I'm 75 percent approval like a lot of your prudence right I mean I'm sitting he does seem to choose the polls that he tweets out are ones that see him he likes to choose ones that sometimes are as he has a more favorable approval rating than others but there are different polls out there they're all snapshots of of polling in time and it's good to be a prudent poll reader and find the polling that is fair balanced and ask say a random sample of Americans Great stuff as always thanks so much for checking in with us polling analyst Emily Gustin from The Washington Post and we always appreciate talking to you thanks for your time thanks for having me absolutely and by the way there's actually a big I think this is big breaking news that just came through. DAVID LAZARUS The article today as Facebook says you own all the data you post not even close say privacy experts David. I've been talking about this quite a bit and it's it's it's actually worse than we think isn't it I mean that's the way I look at it David Yeah except let's you know I get teased a lot for only having bad news so let's cut right to the good news and that is the Mark Zuckerberg has lost about $10000000000.00 over the last 24 hours that doesn't just say and you know I mean you know if you're your hurts. But yeah I mean this is an enormous deal and in my column today I tried to look under the hood of Facebook's privacy policy because what's really beautiful is that they say flat out in their terms of service you own your data the things you post on Facebook they are yours and you can control what happens to them and that is of course total B.S. Moreover they even even validate that elsewhere on their website if you look into their separate data policy which I did down near the bottom you can see that in fact yes they will share your data with their business partners and they will also and this is a massive loophole they will share your personal data with anyone who says that they are doing some kind of survey or some CYA some kind of academic research and what we've learned from this thing involving Cambridge analytical and all of that data was even though 270000 Facebook users agreed upfront to have their data used for academic purposes which again is. Bogus it turns out that because of the way Facebook is set up those 270000 people inadvertently gave back cess to all of their friends which opened up the entire universe of available data to 50000000 Facebook users which probably means you and me and a lot of people you know. Rights and that's exactly what is happening by the way I just want to dive right into a key part of this because as what I said to Carol Costello this morning David Lazarus as I said. You know that's called a contract of adhesion people say oh you don't have to use Facebook right well so a 3rd of the entire planet uses it you have no negotiating power to say I don't like what you're saying that you're just oh you're going to hand it over there's no culpability here in other words we don't hold them accountable just like the Aqua fax breach just like the Sony Pictures Entertainment breach we lack laws that hold companies to account when they don't protect our information if we put massive fines in place now would actually encourage companies to start doing the right thing and protect our information but as long as we say. You know you're going to get away with it why would they ever spend the money to properly protect our information David and you're raising a really good point in fact the Federal Trade Commission just this morning opened an investigation into this case to look and to whether Facebook dupes consumers because of the F.T.C. Is job is to look into fraud committed in marketing here's the thing if Facebook has an out as long as they have some disclosure somewhere about their practices I mean do they disclose it Well no obviously as I've just demonstrated its thing is is that I spoke with a number of privacy experts which you can see in my column in The L.A. Times dot com and they all say that among other takeaways from this episode is the fact that the laws have not kept pace with the rapid surge in social media and that the social. Media companies there are entire business model is predicated on the idea of using your personal self posted information as a commodity a commodity that they will use to enrich themselves despite all that lip service about how they care about your privacy and your data is yours and all of that know this is about you giving them something valuable your personal data and then be using that with marketers and politicians and researchers and others to leverage it as a profit center and the laws that we have in place right now don't really address these quest
