iphone has stepped down at ceo of apple, steve jobs is gone. here come the questions, what about his health? what about the company? what about the future? we'll have a live report. >> i'm amy hollyfield live in san francisco, convicted criminal barry bonds could get that conviction against him tossed out today. former giants' star has an important hearing. >> waiting you outside, clouds another on freeway in daly city. details coming up. >> good morning. thanks for joining us. i'm eric thomas. today, tim cook era begins at apple. steve jobs resigned yesterday in the wake of continued health problems. terry mcsweeney is live at the new apple store and everybody is wondering what it will mean for the direction of apple. >> yeah, steve jobs built apple into the number one tech company in the world. now, in a very brief resignation letter he left a whole lot more questions. he didn't give a whole lot of answers. what business snelth who is the new guy? let's take a look at man who built it. he has been compared to a modern day thomas edison, synonymous with ipad and phone. he says he can no longer fulfill his duties as ceo. he is still chairman of the board but not on the day to day hands on. he did have a liver transplant but he did not mention health problems. the new ceo, tim cook, former chief operating officer moves over as ceo. had here is some observations on cook and jobs. >> he is iconic. he represents part of apple. frankly it's going to be hard i think moving on. >> i admire him and i'm glad to hear he stepped down. >> i think it's big. he is apple. >> reporter: taking a look at the scene at the store when they opened. they didn't have any fantastic giveaways it was just apple opening a store in berkeley and people came out. there was the usual hoopla that goes along with anything apple. steve jobs did an amazing job, approval rating of 97% making him the third most popular ceo of all time. still a lot of questions to be answered. we hope to find out more as the day goes on. this morning, news about jobs is not going over well on wall street. in after hours trading, apple stock fell more than 5% that is $19 a share or $18 billion in value. we posted steve jobs' resignation letter along with tweets reacting to the news. that is at abc7news.com. former giants slugger barry bonds will be back in federal court today with a pitch of his own. he'll try to convince a judge to throw out his felony conviction for obstructing justice. amy hollyfield is live at federal courthouse in san francisco with the story. >> this is a big one. he is now convicted of a crime he would like to change that. he would like to ask the judge to set the conviction aside. he looks like he is doing okay. he made a rare appearance at giants game last night. he held up a ball that they signed and gave him. he was convicted in april of obstructing justice because what he said to a grand jury. he was asked whether his former trainer ever gave him anything that required a syringe. bonds' answer rambled on and on and jury convicted him. unauthorized rambling is not a crime. but jury foreman did say that the jury did under the charge. the judge will have to consider all of this as she is asked to set conviction aside. prosecutors have a big decision to make, likewise, to retry him for the obstruction of justice charges. jury was hung on those charges and declared a mistrial so no word on whether prosecutors will make the decision today, but it's a decision everybody is watching for. today is going to be a big day in court today. potential for being bigger depending on what prosecutors say. live in san francisco, amy hollyfield, "abc 7 news." this morning, thousands of families in placer county who were under a mandatory evacuation are back in their homes after fire crews allowed a rail tanker to burn itself out. let's take a live look. you can see they are still spraying water to keep it cool. the fire chief says there is still propane inside the tank and continue to shoot water on it for few more hours. he says there is no longer a threat of a major explosion as there was when the flames were burning like that. it remains unclear how the tanker caught fire on tuesday afternoon in the northern propane energy yard. a state assembly committee will consider a senate bill that calls for replacing the death penalty in california with life in prison. they approved the measure last month. they believe the death penalty does not reduce crime and costs too much. they argue that california has spent more than $4 billion on just 13 executions since reinstating the death penalty in 1978. if the bill becomes law, they would close death row in san quentin. >> the f.b.i. in pinole police are trying to figure out if two men behind a deadly car robbery are behind two other bay area heists. it targeted a loomis armored truck. they killed one suspect and wounded another in a shootout. one officer was shot and wounded. investigators are trying to determine if the two suspects are responsible for robbing an armored car warehouse earlier in the month. two masked men followed them into buildings and made off with cash. the two brothers may be linked to the may 25th robbery of a brinks armored car in richmond. >> san jose police department has ended the controversial deployment of homeland security officers. the department launched operation community shield to battle an increase in gang violence and city's highest murder rate. since june, officers have made more than 300 arrests, 70% of them gang-related. police plan to continue their collaboration with the mayor's gang prevention task force. >> 5:08 and you will probably see mist on your way to work this morning. >> especially if you travel through some of the higher elevations, even down at the water level, i found some drizzle on my way to work. you can see the cooling trend is on the way. take a look at some of the temperatures around today. you can see the highs are going to be much cooler than yesterday. we're talking about temperatures dropping anywhere from 2-11 degrees. it will be a slow reveal of sunshine, one of the reasons of the stronger push of cooler air from over the ocean. we will probably have to wait until noon to get clear in our inland areas, 2:00 to get clear of the bay. coast will never get clear of the clouds. upper 50s in richmond. low to mid-70s around identically and san mateo and mid to upper on 70s and palo alto. mid-80s in the south bay and mid to upper 80s in the most of the east bay valleys to near 90 in antioch. low to mid-70s with santa cruz and salinas. 80s inland valleys. seven-day forecast, even cooler tomorrow but look at saturday, a slight warming trend that hangs around monday before another cooling trend tuesday and wednesday. we've got good news westbound on 80, we were mentioning albany cleared out of center lane so that will be making it easier to get to ago navy didn't it this it was college material. this morning, in sacramento, jerry brown will unveil a tax proposal that he says will reverse the state's corporate tax formulas back to the way they were before 2009. los angeles times reports the plan would add new sales tax exemptions for companies that manufacture products and hire people in california. it's less than a week after california's unemployment rate went back up to 12%. governor brown needs support from two republicans in the house to get the plan passed. >> several san francisco neighborhood groups are suing the city in hoping to stop the insulation of more at&t utility boxes. they are asking the court to order a review and stop the boxes from being installed while the case is pending. they say the boxes are an eyesore and block the pathway of pedestrians when they cross the street. at&t boxes hold the equipment for digital tvs and high-speed internet. last month the board of supervisors passed a measure to allow the boxes without conducting an environmental review. there is a crisis in america it's hunger. 50 million americans live in food insecure households but there are food banks that are helping. you can make a difference, as well. don sanchez checks in with this report on hunger at home. it is a familiar story. families work hard but with expenses their dollars don't far enough for food. they manage a coffee shop. they have two small children. >> food bank, they provide food and cans. >> 42% of our households are working families. we're serving 49,000 people and half of those -- >> they use the intelligence mj food bank a couple of times a year all rely on food stamps. >> i plan on use it but at this time in my life right now, we kind of need them. >> in san francisco the number of people relying on the food bank has doubled in one year. almost. almost half the people we serve has some member of the household that is working. >> here the food pantry comes to the community at 60 sites to the city. they offer choices, create a menu so no child goes hungry. >> a farmer's market, they can take items they want. hunger war isn't going to end soon. you could help change lives by becoming on a mission to end hunger crisis. he has created a waste no food to let people pass on their excess food to the hungry. they get restaurants with organizations that are looking for donations. 13-year-old says he begin creating the nonprofit two years ago and the whole idea is make a difference. >> one-third of all the food in california is wasted yet at the same time 11 people in running in the upper 50s with clouds and 60s and drizzle and fog in your neighborhoods. sunshine will take a while to return to the coast and keep the cooling trend going for today. cloudy tonight, look for patchy drizzle tomorrow morning and small warming trend will hang out this weekend, even next week it will get cool, cooler than average like most of us are today. livermore, 2 degrees warmer than average, san jose and oakland, 3 degrees cooler than average. 5 in napa. redwood city, 6 degrees shy where we should be. sunset at 7:49. here is a look at extensive cloud cover. everybody being touched by clouds and drizzle. that will start to dry around 7:30 and clouds will retreat out of inland valleys by noon. note they are still hanging around the bay. probably pull out here, i would say about 2:00, it will be very stubborn around the coast. upper 70s to low 80s in most neighborhoods. los gatos probably around 85. 60s around the peninsula. low to mid-60s along the coast. daly city 60 degrees. mid to upper 60s downtown san francisco and sausalito. 59 in bodega bay. most of the valleys will be upper 70s to near 80 degrees. low to mid 70s for most of the east bayshore. fremont could be the exception at 78 degrees. antioch and brentwood near 91. rest of the valleys are mid to upper 80s. cloudy conditions around monterey and carmel. more sunshine for the rest of the bay and low 70s. mid to upper 80s in the east bay valleys. giants game, 7:15 first pitch, 61 dropping down to 58 degrees. tonight cloudy and patchy drizzle, more widespread 50s than what we're dealing with this fuel to the space station. accident occurred less than five minutes after the rocket lifted off yesterday. >> reports that was just given to international space station commander is that the russian flight control teams lost communications with the vehicle and there was no final stage separation. >> the rocket's upper stage motor apparently failed. nasa says they have enough supplies on hand to last a few months. >> you could say a jewelry heist in georgia was an inside job. the resident dog ate $10,000 worth of diamonds. it happened when working with loose diamonds and he came back some of them was missing. sure enough the owner took the dog for an x-ray and they found the suspicious diamonds. it took a little while, two diamonds were recovered. >> a bay area school board back pedals. man behind the i-pod and iphone is no longer behind the bosses desks. he resigned yesterday and everybody is wondering if health is the reason. terry mcsweeney is live at the new apple store in berkeley. >> reporter: it would make all the sense in the world. this is a man who has been very sick over the past several years. a lot of speculation that is it his health. in the letter of resignation, he says he is no longer of capable of fulfilling the duties and expectations of the ceo. there is another explanation. take a look at the man who made apple the number one high-tech company in the world. man that brought us i everything. sit a health issue. there is no mention of it in the resignation letter. he had a liver transplant in 2009. tim cook is the new man, apple's chief operating officer now the ceo but what is apple going look like now? in a rare interview back in 2007 this is at the time when he was launch is the first iphone what if there came a time when there was no next big thing in high tech. >> we don't worry about stuff like that. we try to build products that we think are wonderful and people might want. sometimes we're right and sometimes we're wrong. i think we're going to hit a grand slam with this. >> reporter: he was right about that. these are pictures la last weekend when this apple store here in berkeley opened. the crowds lined up for hours just to be the first in. there wasn't a new product available but there may be soon. as far as why he is doing it, why he is resigning people are saying he may have a recurrence of cancer that he had. there may be a problem with his liver, but moto.com it might be a perfect time to resign. he has got the number one high-tech company in the world. he is one of the most popular ceos of all time. they would be an ideal to step down. you have to be rooting routing that article is correct. most people are weighing in medical reason. stocks are down 5% in overnight trading. it will be interesting to see what happens on wall street when it opens this morning. we will be watching. later today, barry bonds will take a swing at getting his conviction thrown out. former giants slug er and legal team will be in federal court in san francisco today. amy hollyfield is there and she is live with more on the story. >> he faces serious business here in court he had a little fun last night. barry bonds actually went out and watched his former team. it is rare for him to make appearance for giants games. he held up a baseball that the two giants announcers gave him. he would like his conviction for obstruction of justice set aside. he was convicted because of what he told a grand jury. he gave a very long answer to one question and prosecutors called it evasive but his defense attorneys are now saying that excessive rambling is not against the law. they would like the judge to set that conviction aside. he does have another dark cloud hovering over him. three perjury charges that resulted in a hung jury and mistrial in april. prosecutors are still deciding whether they retry him on those charges. no word
