We are grateful to the jurors for coming up with the right decision. Antolin Garcia Torres sat expressionless as he was found guilty of kidnapping and murder with special circumstances. A verdict that could put him on death row. This is a longtime coming. Its bittersweet. We dont have sierra thats the bittersweet part. There were no witnesses to connect antolin Garcia Torres to sierra lamars disappearance from this morgan hill crossroads. No evidence that he knew her. No murder weapon, or evidence of what happened to her body. Defense attorneys claimed that she was a runaway and is still alive. Prosecutors pinned their hopes on forensic evidence from her phone and purse, found nearby. The purse had her clothes inside. And there, they found the defendents d n a. He was arrested two months after her disappearance. And detetctives discovered her d n a and a strand of her hair in his car. That was enough for the jury of of six women and six men. They delivered their verdict after deliberating for just two days. We now move immediately into the next phase, the penalty phase, where the jury will decide whether the defendent gets the Death Penalty or life without parole. That process begins next week. Whatever the outcome, sierras mother says she is glad her fdaughters killer will never walk the steve this story has captivated much of the bay area for more than five years now. And even with todays verdict. Additional Significant Developments have yet to play out. pam grant lodes joins us now with that part of the story. grant the sentencing portion of the trial starts next week. Same jury will hear arguments from both sides in the penalty phase. Will Garcia Torres get life without parole. Or the Death Penalty . Our legal analyst. Defen se attorney curtis briggs. Who well hear from momentarily. Says the sentencing phase could take anywhere from one to four months. He says Garcia Torres defense team will likely file a new trial motion based on what the defense believes are errors made during the initial trial. Afetr sentencing. The defense will probably turn its attention to the appeal process. And one thing people are wondering. Will Garcia Torres reveal where sierras body is during sentencing. In an effort to avoid the Death Penalty . If it was my client i would have asked him to do what was right. It appears as though he felt that stating that he was not a part of the murder was the right thing to do. I expect that he would continue on that course of action. Heres why. He wont be put to death in california. Chances are, hell be in prison. But if he gets the Death Penalty hell have more access to resources lawyers and a better chance of appealing. So if he stays the course hes going hell get better lawyers and wont have to admit to the crime. grant brigss called all the searchers and supporters a worst Case Scenario for the defense. Were talking about a lot of emotion. And he says the jury picks up on that. Sentencing starts next tuesday. steve as weve said antolin Garcia Torres could face the Death Penalty. But its been years since the state of california has actually executed a prisoner. pam kron 4s Vicki Liviakis is here to shed some light on what might happen. Vicki . vicki yes pam and steve. California has the largest death row in the nation but it hasnt executed anyone in over a decade. But the question is if antolin Garcia Torres is given the Death Penalty would he ever face the executioner. The last man to be put to death here was Clarence Ray Allen in 2006. Thats because a judge put the 3drug lethal injection on hold. If you recall, this past november voters approved prop 66 meant to streamline the process and get the Death Penalty moving again. But thats been put on hold by the California Supreme Court to review its constitutionality. Certainly passions run high both for and against the Death Penalty. What we know is that in ten years since the last execution crime has not increased. Are reacting to the verdict. philippe sierra lamar never made it to Ann Sobrato High School the day she went missing. And, ever since her disappearance, the Morgan Hill Community has been invested in her case. They are deeply saddened by her loss. But theyre grateful for the verdict. Twila salvador searched for sierra i went on the first search, and i thought a little girl goes to school my little girl could have been my daughter. Twila salvador and her husband steve say theyre pleased with the guilty verdict. Steve salvador searched for sierra hopefully, hell never see the freedom again. But the salvadors are still upset that sierras body has not been found. I just know that, uh, i just pray that god will bring healing to the family. A family with the full support of this community. He has been in the shoes of the lamar family in 1993 he felt panic of a missing child. The agony of police search. And an exhausting trial filled with gruesome details. Of a childsdeath. Simms went to show the video to the Police Officer assigned to the school tuesday. But the youtube link was broken. vo a message says it was removed by the user. Simms was frustrated because she says people, including the police, should see how bad it was. But her daughter says shes happy its down, because now it will be harder for people to see it and spread it around. This is some of that video that we showed you yesterday, where another student started pummeling the victim on the Basketball Court during pe back in early march. Simms also says since our story aired, shes spoken to at least two other parents at the school who also say there is a bullying problem. A lady came to me, i saw you on tv. My daughter had two teeth knocked out. She was beat up, had two teeth knocked out; were going to the dentist now. Has a concussion. its just horrible i cant believe it vo another mother called our newsroom saying she had to take her daughter out of the school three years ago because bullying got so bad. Simms says she asked the school to take her daughter out of that pe class for the rest of the year, but administrators said they cant do that. Simms is also still working on the complaint form she plans on turning in to the district office. I tried contacting the district again tuesday. We should mention though that we got an after hours call from the person who handles media inquiries. We still havent been able to speak to them directly, but they did return our call. In vallejo, Spencer Blake, kron four news. steve new tonight at 8, state Officials Say they will help pay for a network of surveillance cameras along east bay highways plagued by an alarming increase in violence. Kron 4s Charles Clifford is live for us tonight in hercules with reaction and details on what happens next. Charles. Well, theres wide held belief that if cameras and surveillance equipment are installed along interstate 80 and highway 4 it will deter crime on the roadway and help Law Enforcement catch suspects when there is a problem. Now, that system has come a closer step to being reality. Natsover the past two years, there have been dozens of shootings along interstate 80 and highway 4 between richmond and antioch. 8 people have been killed and Dozens Injured in what is believed to be Gang Violence that has spilled over onto the roadways. Now, the California State Transportation Agency has agreed to help build a Surveillance Network that will hopefully deter the violence. The specifics of the plan are still being worked out but the network will most likely include wireless cameras, license plate readers and possibly shotspotters. Which can detect gunfire. The network would be most likely monitored from a control center which is already up and running in pittsburg. Its now up to a Task Force Made up of the Contra Costa CountyDistrict Attorneys office and Law Enforcement agencies from across the county to design the system and submit a funding request to the state. Early estimates have put the cost of the project somewhere between 800 thousand and 2 Million Dollars. Sot dan romero sits on the hercules city council. Police have arrested a suspect in connection to a violent robbery at a costco store. steve Authorities Say it happened last night. And that two other suspects are still on the run. According to police. Three suspects entered the costco on fostoria way just after closing time. The three worked together to break open a case of jewelry and run off with it. Two got away.
