KTVU KTVU Fox 2 News At 5pm June 2, 2017

Bit more than beyond a reasonable doubt. But they did it in this case. So seconddegree murder. How long will their sentence bear, and how long in real terms do you thunk they would be behind bars . Well, its 15 to life for seconddegree murder. They have to carve minimum of 15 years, then they become eligible for parole. And the parole board can let them out then or keep them in. That depends how they do in prison. But think about it. If were three officers and were going to prison, how do you think our welcome is going to be . Its not going to be enthusiastic. Would they put them in protective custody . They probably will, but believe me, the other inmates will figure ways to try to get at them, especially since they were guards in jail. Where would they likely go . I assume they will go to san quinten to start, then from there be shipped out. Thats up to the borrow of prisons. They decide. Talk about how this case played out. The defense tried to say that Michael Tyree possibly could have slipped, possibly could have dealt himself a fatal blow, but the prosecution said the coroners report was consist went being beaten to death. This was a scientific case. The jury listened to the scientific forensic evidence and they didnt believe the defense. Sure, its possible it could have happened that way, but lets look at all the ancillary fact. Lets hear what the other people that testified, the witnesses that testified. One of the people that testified was truly certifiable. I mean, when he testified in the courtroom he was squirting all over the place. He was obviously mentally disturbed. But i think the jury heard a ring of truth in what he said. They beat me. They did this to me, and to them, or to him, the same thing. Michael, stay with us. Right now we want to go down to Santa Clara County. Jesse gary was in the courtroom as the verdict was read. Jesse. Reporter frank, family members are coming out. Go ahead and pan over, dave. Dave, pan over. Family members are coming out of the courtroom. I can tell you it was a very emotional scene inside the courtroom as those verdicts were coming down, guilty on seconddegree murder. We were sitting behind the family of the three defendants, or in front of them, i should say, and they were sitting behind me. I could hear audible gasps and crying, sniffling, et cetera, as these verdicts came in. They understand what it means. 15 to life. As michael said, a minimum of 15 before you can Start Talking about parole. I was told that the deputies were all handcuffed and taken out of the courtroom. Some of the family were saying be strong, as they were taken away. Sentencing is going to be on the 1st of september of this year. So a very emotionally charged courtroom. But having sat in the trial, and listening to some of the evidence presented in this trial, its not that much of a surprise. Guys. Jesse, was there any reaction from the three Correctional Officers . Reporter im sorry, frank . Was there any reaction from the deputies as they were found guilty . Reporter no, frank. I was looking at their backs. One, and i couldnt tell which one, put his hand over his mouth when it started to click. Heres the d. A. , jeff rosen. Let me stop talking and let him talk for a second. Today, a jury convicted three Correctional Officers of murdering Michael Tyree, a mentally ill inmate. This murder happened in the jail right behind me. The jail has three purposes. First, to hold individuals accountable for the crimes they have committed. Second to protect our society from those criminals who have harmed others. And third to give inmates an opportunity to rehabilitate themselves and become productive, law abiding citizens. In order to accomplish its purposes, a jail must be a place where inmates and correctional staff are treated with respect and dignity. Where everyone, including a slight, mentally ill inmate named Michael Tyree are treated with respect and human dignity. I want to thank the men and women of the jury for the public service. With their careful consideration and just verdict, they treated Michael Tyree as a man of value, a person with strengths and problems, rights and dignity, and a family who loved him. We stand here because three men whose very job it was to protect him treated Michael Tyree as something nameless, and they beat and killed him as though he were worthless and nameless. The jurys verdict treated this jail not just as the grim setting for a murder, but as an important societal institution whose employees share a mission of protection of those outside of it as well as those housed within it. Without that protection, there is no law, there is no order. There is no justice. And in the end for Michael Tyree, there was no chance. I want to thank the Sheriffs Department for its excellent investigation in this case. In particular i want to thank sheriffs deputies mark carrasco, jason brown, and julian for their excellent work on this case. I also want to thank District Attorney investigator mike gaynor, for the hard work and dedication. Trapped behind bars and in his Mental Illness, Michael Tyree could not stand up to the men whose job it was to protect him. But we cannot and did not turn away from the tragedy of Michael Tyree. Prosecutor matt breaker who is standing right here stood up to them for michael. The jury stood up to them for michael and for all of us. He is gone now, but Michael Tyrees tragedy was worthy of our outrage. His death will never be invisible. We will think of him as we work toward making the Justice System a better, more fair and safe place for the vulnerable men and women suffering from Mental Illness. I am committed to doing that. We will never forget Michael Tyree in our fight against those when see vulnerabilities as a chance to harm instead of an opportunity to help. Thank you. Today the jury reached the conclusion that these three individuals were responsible for the death of Michael Tyree, and she is the sheriff of Santa Clara County, and she was the Commanding Officer of the three deputies that have been convicted of seconddegree murder. And shes saying i stand behind the hard work and dedication of the 1400 deputies who perform their job every day to the highest standards and do the right thing. Were humbled by the sacred responsibility afforded to us by the public. Every day our deputies wear the uniform with pride and honor. In moments where our personnel fail to uphold the oath and responsibility entrusted to us, we have a duty to report and hold those individuals account afternoon. We will not be defined by the actions of these three individuals. We have been undergoing a broad transformation, ensuring transparency, safety, and the quality within our facilities. This tragic incident has served as a catalyst for our ongoing progressive efforts in the custody bureau. Moving forward, we will diligently continue our transformation reforms. I know that there will be some questions, and i dont want to take any questions, but one of the things that im sure is of great concern is the internal investigation on these three continues, and it will be brought to conclusion soon. California law prevents me from discussing the internal investigation any further. As such, i wont be answering any questions about that, but thank you for being here, and thank you to the jury and the d. A. s office, and everyone that really worked hard, including our investigators that did an exceptional job. Were proud that justice was served and that those that are culpable are behind bars. So once again you are listening to the sheriff in Santa Clara County. We also heard from the District Attorney talking about the breaking news, the guilty verdicts, seconddegree murder for three sheriffs deputies at Santa Clara County accused of killing an inmate, Michael Tyree. They will now serve 15 years to life for that verdict. And Michael Cardoza is here now. Your reaction to what the d. A. Said and the sheriff said. We were talking about the message here. The jury probably thought, you just dont treat people like in this jail, and its much more of a global message. I think it really is more of a global message. The District Attorney talked about the value of life of Michael Tyree. I agree with that. But ive got to think the jury is thinking, you dont treat people like in that jail. Because what do you do when you treat them like that, treat them like animals . They come out worse than they went in, which puts us as citizens more at harm. I look at them, and i know theyre happy that the verdict came back, at least theyre saying that, but it does affect all law enforcement. But why dont they psychologically test the jailers . I know the union fights against that. But think about that. These jailers every day deal with the worst of the worst. You cant imagine what they throw at them what they say, what times they can attack them with home made weapons. Youve got to be tough as a jailer, but it also has to get to you psychologically. But they do nothing about it. They dont test them. They dont do anything to say, wait a minute, frank, how ruutu day . Whats going on . I want you to see the psychologist. Lets test you. They fight against that, the union. I wonder why, because would it make for a better jailer. If they need time off, give them time off. Ensure that theyre not going to be fired, if they go a little haywire. They face 15 years to life. Theyre relatively young men. You thought maybe they should be on suicide watch. They should be, because can you imagine . You asked jesse, how did they react in court . Im telling you, theyre sitting there, and its like looking behind a pane of glass. Theyre hearing but i dont think theyre processing that they just got found guilty of a seconddegree murder. Remember, these men were walking into the courthouse. They werent in jail. Theyre being taken out in handcuffs. Theyre going to be put in jail. How do you think, when they get to the point where it finally sinks in, theyre going to be saying, oh my god, im going to jail. Im just curious, how big a deal is this in the overall sense, and does this show that, for lack of a better word, no one is above the law . Does it do that, frank, but i think it sends a real message to all people in the corrections business. Dont be doing this, because jurors are understanding what happens now. We have tweets, we have all sorts of media nowadays. 20, 30 years ago, you talked to people, and they say, oa police officer, they would never lie. Oh, theyre perfect. And all jailers are perfect, too. Now we know that is not true. So it has opened jurors minds up to say, yeah, it does happen. And in this case, the District Attorney, and kudos to them, proved beyond a reasonable doubt that it did happen. In this instance, a huge message, dont do in this our jails or it could be you next. The thing that scares me, look at the opposite side. The guys in jail are going to be emboldened and go, now i can accuse you, and they will use that as a tool. So its going to be an interesting time now, because people in jail will try to use this as a tool against the correction officers. All right, michael, thank you. Youre welcome. I dont believe that she would have gone, had she known that it was so unsafe. Coming up, we talk to the mother of one of the 36 people who died in the ghost ship warehouse fire. We also hear what the city is doing now to make sure nothing like that ever happens again. Its slowly but surely warming up out there. Temperatures on the rise. A little more sunshine today. Temperatures a little warmer. Mid80s inland. It is going to get to near 90 tomorrow. I will show you where, how long that heat is going to last, and what you can expect for your saturday and sunday. All right, now to the nba finals. Were an hour away from game one between the warriors and the cavaliers. Our sports director mark ibanez and Jason Appelbaum are outside oracle arena. A key question, will steve kerr be back on the bench tonight . There was some talk earlier. There was an erroneous espn report saying that he might show up, but thats been basically denied by bob meyers. Bob meyers on the radio said he is not quite ready to return yet but he will be here tonight, just in the on the bench. Definitely his input will be heard from the locker room, and he will address the team at halftime, that kind of thing. We are outside because one network and one network only is allowed inside on the court within an hour of game time, which is good news because that means were finally going to get to see some basketball. I dont know about you, he said he couldnt sleep last night. Well, yeah, before we get to that, tell me about your dream. I dreamt that Draymond Green, hes going to win the mvp and the warriors will win between eight and 12 points. They had it under control. So much so that my dream ended, and that was pretty much it. I did not have any dreams, mark, because i honestly could not sleep. Like a kid in a candy store. Imagine the players right now. This is their Third Straight finals for both teams as we know, but nonetheless, no matter what they tell you, i mean, this is a very, very big deal. I think it is going to be the most highly rated television finals in history. There are marquis names galore, theres a great story line. Its the First Time Ever the same two teams have met three consecutive years. Its a rubber match. This is the ultimate rubber match. I would say this is the greatest rivalry right now. I know frank might argue its a hockey rivalry, but i would zane all of sports this is the greatest rivalry. No doubt. And lebron james, you talk about marquis names, it doesnt get any bigger than that. He absolutely has taken it to another level. That was against the east. The warriors plan to pressure him a lot more. He was great in game seven. Talk about steph curry. Twotime mvp. He is going to be matched up with kyrie irving. He was dinged up in last years finals. Just wasnt healthy. Nonetheless he played but did not have a good finals. Really did not have a good playoff. But steph talked about the turning point in the season when this team started to gel. We hit our stride after the new year. Obviously when kd got hurt we had to readjust and try to do it in his absence. I think that made us better when he came back because hes such an efficient, unique scorer. He doesnt require much when it comes to getting him the ball in certain spots. But when we worked around those other opportunities, myself, klay, draymond, knowing that ball is going to be hopping, weve all got to be aggressive, be ourselves, not have to, quote unquote, sacrifice anything of our games as we put it together in that full unit. And you talk about this team gelling, mark. Way argue that theres probably never been a team in history gelling quite like this. They are peaking at the right time. 271 in their last 28 games, and they could be riding a 28 game win streak, but they didnt play Klay Thompson and their starters the second to last game of the season. There was a little concern, steph curry wearing a sleeve on his right arm, his shooting arm. Hes had a little bur bursitis in his shooting arm. He claims its not bothering him. I would say why wear the sleeve. I dont think any team could ask for more health. Nine days rest for the warriors, a we can off for the cavs. This is the warriors fifth game in 24 days. They are very well rested and very healthy. Game two sunday, then they travel to cleveland for games three and four. Joe fonzi will be there. That is absolutely right. Right now were on the outside looking in, but we plan on getting in there and a checking out what truly figures to be an eventful evening. Cant wait. Maybe a series for the ages, truly. I just want to get your take. Obviously theyve had a lot of time off. You have said that they cant stop lebron james. Theyre not going to give away their strategy. What are they going to do to try to contain lebron james . A good question, julie, as usual with you unsports, as a frank can attest to. I think that theyre going to put bodies on him. I think you will see draymond on him. Iguodala. And i think you will see draymond on him as well. Yeah. Theyre going to throw different looks at him. What theyre going to try and do basically is not make it easy. Hes such a great talent. Youre not going to stop him, but you want to make him work for everything he gets, and perhaps even wear him out a little bit. Wear him down. Thats really the only hope. And eight think durant is going to cancel out lebron, and i think steph and kyrie irving. Thats why im picking the warriors. Then it comes down to Draymond Green and kevin love. Up until now, that third match up, draymond has owned kevin love. Hes shut him down and gotten inside his head. Draymond can be quite a trash talker. Draymond thinks that kevin love is a little bit susceptible to that. Back to kevin durant, hes going to get his, 30, 35, you just dont want him going for 40. Theyve got david west who can put an elbow in the rib with the best of them. I think the warriors are deeper and stronger than they were last year. Its funny how you dreamed about draymond. I dreamed that the sharks won the stanley cup. What are the chances . Well, that certainly is a dream. Next year, next year. Enjoy. We will be checking back with you. Good questions, julie. Take care. Well talk to you later. I dreamt about rain. I dreamt about sun. Okay, so here we go. Yeah, its an exciting night out there at the oracle. Markey is out there with jason. A warmer day tomorrow, warmer day on saturday, then things start to cool down. You can see the jet stream. Its starting to go up to the north. Thats an indication of a High Pressure system which we havent seen a real dominant one that wasnt transitory that will st
