Now to Pleasant Hill where a woman says a call to police ended with her pet dog being shot and killed by an officer. New at six, ktvu Crime Reporter henry lee is in the newsroom. You spoke with the dogs owner and police. And they both have difference stories about what happened. Reporter thats right. I have covered many of these cases before. A pet owner says the dog is friendly and never acted up in the past but police say the dog charges the officer and the dog loses its life. It has happened in Pleasant Hills and video of the tense scene afterwards. This is clyde, a 6yearold mixed breed dog that belongs to Jessica Marquez of Pleasant Hill and this is the same dog after he was shot dead by this Pleasant Hill police officer. You are seeing video shot by marquis boyfriend anthony, you can hear marquez crying in consolably. It began yesterday morning when marquez called the police for help on a civil matter. The officer was already parked outside when she arrived home in her jeep with clyde in the front seat and when she got out that is when things went south. Clyde went out to the front door and the officer shut his door. The noise caused the clyde to look at the officer. Clyde moved closer and barking and the officer kicked him and clyde grabbed on his pants as he kicked him and where we are standing is where clyde noticed that he went to get his gun and next thing you know clyde is over against the fence and bullets just went off. And one hit him and he started to cry and limp and run back to my car. And then he just. Reporter the officer fired three shots. One lodged into clydes lung and the other two bullets have not been found. Police say the officer had no choice but to defend himself from a charging dog and no time to use his taser or pepper spray at one point the officer fell to the ground. The dog tore a hole in the officers uniform. As far as we could tell the officer acted reasonably and within policy. Reporter we met up with marquez as they brought clyde to a pet hospital to prepare for cremation. He was a good dog. And everybody loved him. He didnt have a mean bone in his body. Reporter marquezs heart is broken over what she says was needless force by the officer. It didnt have to happen the way it did. He wasnt anywhere near that officer. He was at least 10 feet away. He could have easily tazed him. Pepper sprayed him. Reporter we spoke to attorney nick casper that has filed lawsuits on behalf of people whose dogs have been shot and killed by police. I think it to good err on the side of safety and let the officer know of the presence of animals. Reporter marquez asked for police to meet her an hour after she call but the Police Responded quickly and didnt give her enough time to secure her dog. A tragic case. Henry, thank you.
