Happening today, state officials will ask a judge for an injunction that would bar any b. A. R. T. Strike or lackout for the next 60 days. This mornings hearing comes after Union Negotiators and b. A. R. T. Management failed to reach a deal last night. This rare hearing is set to get underway in just about two hours. Alex savage live where the proceeding will be held. Reporter this unusual Court Hearing gets underway two hours from now here at the Civic Center Courthouse in San Fransisco. A superior court judge will be ruling on this petition that was filed last week by Governor Brown asking for an injunction to essentially block any strike or lockout for the next 60 days by b. A. R. T. s union employees. In essence the governor is asking for a cooling off period for the next two months. The judge could deny the he could deny the governors request although observers dont believe thats likely. The law requires the judge to grant a cooling off period if a strike would significantly impact or disrupt Public Transportation service which both sides agree would be the case. Meantime b. A. R. T. Management and three employee unions are continuing to bargain this weekend trying to get a deal done, hammered out by midnight tonight, but the two sides are not talking face toface at this point. Theyre only passing proposals back and forth through a mediator, and they remain very far apart on the key issues of pay and benefits. Our team united have done everything we can to get that deal. Were going to continue to do that. Were going to look at the numbers we get tomorrow. Were going to weigh it out versus the proposal we receive this evening and keep pushing. You just want to look at things, just see where it goes. Now b. A. R. T. Representatives and Union Representatives are planning to resume their negotiations at 1 00 this afternoon back in downtown oakland. Of course everyone involved will be keeping a close eye on the outcome of this mornings Court Hearing here in San Fransisco to see if the governor will be able to order that 60day cooling off period and put off a b. A. R. T. Strike for another two months. Todays Court Hearing will be a first here. The Civic Center Courthouse has never before opened on a weekend ever since its never opened before for a weekend hearing since it opened in 1998. Offered a 9 raise over four years compared to the unions demand of a 15 raise over three years. B. A. R. T. Would have employees contribute 2 to their pensions in the first year with increases after that. The unions want a point 5 contribution. The union wants to limit employee contributions to 5 increases each year over the current contribution. While it appears trains will be running tomorrow b. A. R. T. New this morning, two teenagers have died and three are in the hospital after an overnight car crash in san jose. Police say it happened around midnight. Five people were riding in a ford contour, the male passengers inside were all 17 to 19 years old. Police say the car lost control, went on top of the median and then hit a tree. We have an Accident Reconstruction Team at the scene, and they will do a complete investigation to determine the manner and circumstances surrounding the accident. Two of the passengers are expected to survive. The third passenger who is still alive remains in critical condition. So far the cause of that crash is unknown. Now to the developing story of the california teenager who was the subject of that nationwide amber alert. 16yearold Hannah Anderson should be reunited with her dad at an Ohio Hospital today. The week long ordeal ended late yesterday afternoon when the fbi shot and killed her alleged kidnapper, 40yearold james lee dimaggio. A helicopter spotted dimaggio and anderson in the dense woods. Officers hiked 2. 5 miles to the camp site before an fbi tactical agent gunned him down. This was a homicide suspect in a rug area and we had a 16 yearold girl we wanted to bring home safely. We wanted her home and thats exactly what happened. Investigators believe dimaggio killed hannahs mother and younger brother and torched their San Diego County home before before taking off with the teen. We are going to have a live update on hannahs condition and the fbi rescue. Evacuation orders remain in effect for some residents near the silver fire. They first sparked on wednesday. The wildfire has burned 30 square miles and 26 homes. Ten firefighters have been injured. Fire crews say it is 70 contained and expect to have it fully contained by the end of the weekend. Im grateful. Im so grateful. It couldnt look any worse than what europe looked like when i was a kid, world war ii, the bombing. At its peak, the fire forced 1800 people to evacuate. On friday Governor Brown declared a state of emergency for the area, even freed up additional funds and resources for the firefight and recovery. Dozens of people came together for a prayer vigil in east haven connecticut last night to honor the four People Killed in fridays plane crash. The pilot has been identified as bill heninsgard. He was flying with his teenage son when their plane crashed, a 13yearold girl and her 1year old sister inside one of the homes were killed. Classmates of the young girl say theyre devastated. Its hard, i cant believe this happened. Its horrible. I wish she was here for another minute so i can like say hi to her. Investigators say the pilot was trying to land at a nearby airport, and the cause of that crash is under investigation. Logan stevenson, the 2year old toddler from pennsylvania who died two days after serving as best man in his fortunates wedding has been laid to rest. He was born with a rare genetic disorder. Last weekend his parents celebrated their wedding early after being told stevenson didnt have much longer to live. He died in his mothers arms monday night. It was the most beautiful thing i ever seen because i brought him into this world, and i watched my son leave. Logans funeral was held yesterday, attended by about 75 friends and family. His grandmother says its hard to understand a child dying so young, said that logan had a very big impact on everyone who knew him. The garage was shut down while police investigated. Investigators do not suspect foul play. A man hunt for an accused killer and kidnapper is over. His alleged teenage victim is safe this morning looking forward to reuniting with her father. An update on the Daring Rescue of 16yearold Hannah Anderson. Dominick. Good morning mike, yes, we are expecting Brett Anderson, the father of hannah to reach idaho at some point this morning where hell be reunited with his daughter after a traumatic and dramatic week. She was kidnapped back on sunday by a man named james dimaggio. He was a family friend. He killed her mother and 8year old brother and the circumstances which are still not quite clear. They vanished and were tracked down to the wilderness in idaho about 30 miles east of the tiny town of cascade. There underwent an extraordinary operation. Two fbi Tactical Teams dropped by airplane. They had to hike for two and a half hours to get into position before they could actually confront dimaggio. When they did they shot him dead. 16yearold hannah was found not just alive but apparently unharmed says the fbi. She at the moment is in the hospital we believe in boise where shes undergoing physical and psychological evaluation. We understand that physically if shes okay the issues may be psychological. It depends what specifically shes been through. The Authorities Say she fared pretty well, thats very good news. Her father very very upset by what happened to his wife and his son and has been absolutely frantic about what was challenge to his daughter. He had been working in nashville at the time. He was a little out of the loop he only heard moments after what precisely had been going on. Friend of the family and the rest of the relatives expressing just how much relief there is at this news. Four gang members have been arrest in connection with a driveby shooting that injured 15yearold boy. That shooting happened around 1 30 yesterday morning on murray street near sea bright avenue. The victim was airlift today a Trauma Center for surgery. So far there is no word on his condition. Police say they chased a car seen speeding away from the the shooing after using a spike strip to stop the car, all four suspects were arrested. Oakland police say about 100 guns were turned in during a buy back program. It was held yesterday on macarthur boulevard in east oakland. Gun owners were paid 100 for each gun and 200 for each assault weapon. No questions asked. One young person says she hopes the buyback will help end Violent Crimes in her community. Shouldnt be 13yearolds, 15yearolds shooting each other. That shouldnt be happening. Theres something wrong with it and theyre not getting the guns from nowhere. I think this gun buyback is good. Organizers passed out about 10,000 in exchange for those weapons. The murder trial of a 79 yearold accused serial killer is dom an end. Joseph naso is representing himself in the trial in marin county. He did not take the stand. Hes accused of killing four women in the 1970s and 90s. Prosecutors are scheduled to make their closing arguments on wednesday. A Research Project could helps tension between occupy the farm protesters and the university of california. The university has invited 40 people, including demonstrators to take part in an experiment in urban farming at the guild track in albany. The university owned land has been at the center of a long dispute. Supporters hope the project will help build a better relationship between the university and the community. Theres been a lot of tension about the access to this land, and i think this is a positive step. The urban farming Research Project will continue for the next four months. About two dozen people have been camped out outside that Historic Building on allston way for two weeks. They want to stop the sale of the 99yearold building. Demonstrators say theyve received multiple warnings from postal inspectors to pack up and leave. Theyre trying to sell it off.
