Senators have been giving impassioned speeches. Heres a sample from democrat cory booker. Lets send this bill in to committee. Lets do this process as this institution was designed to have it done. Lets join together like our forefathers and formothers have done to expand liberty, to expand opportunity, to extend hope. We can do that. All of us collectively have that power. And weve kind of reached the moment of truth here. There were two votes set for early this morning, late evening your time. The first one passed. It was a procedural vote. The second one is really the one that everyone is keeping their eyes on but weve reached what appears to be an impass. Right now Vice President mike pence is making a case to senator john mccain who actually came out here from arizona after being diagnosed with brain cancer. Hes making a case right now to john mccain to vote for this socalled skinny bill and it could be the very last opportunity for republicans to repeal and replace obamacare. They deserve better than obamacare and its skyrocketing cost. They deserve better than obamacare and its plummeting choices. As republicans scramble in the 11th hour, still searching for gop plan to repeal and replace the Affordable Care act. Reporter in fact, republicans say their last and best chance at healthcare reform is a socalled skinny bill which would strip down key obamacare mandates, including repealing the individual mandate, revealing the employer mandate for a minimum of six years, and providing greater flexibility to the states among others. But even some republicans at this late hour are calling this skinny bill a political tactic and not sound policy. The skinny bill as a replacement for obamacare is a fraud. Whats so interesting about this is you just heard from senator lindsey graham. He and senator john mccain and a few others basically want reassurance from the house that they wont pass this bill. You heard me right, that they will not pass this bill in its current form. They just want to move it forward so they can then go and negotiate with the house about how to make this better so its not every day that you hear the gop or any lom pushing for any lawmaker pushing for a bill, just gives them an opportunity to negotiate with members of the house. New at 10 00, three new cases of arson in antioch have investigators trying to track down what could be a serial arsonist. Fire crews were called to sunset drive just off of highway 4, one block from where an arsonist hit last week on hill crest avenue. Crews today were called to two more fires near the location of seven fires that investigators say were intentionally set last week. No one was hurt in any of the fires but a few of them did come dangerously close to homes and a church. Investigators say they do have some leads on a suspect theyre following up on, but so far no arrests have been made. A barbecue grill is being blamed for sparking a wildfire in lake county. Firefighters are making progress on the fire but it has destroyed three homes and several outbuildings. Crews say they have stopped the forward progress of the fire. Its burning on foothill drive on the northeastern shore of clear lake. The fire was first reported just after 5 30 tonight. A witness told our news desk that the three homes were destroyed in the first months after the fire broke out. One of the homes was abandoned. Another 30 homes in the area had to be evacuated. Air tankers dropped fire retardant from above. One person was taken to a hospital for treatment of a minor injury. New the south bay where homeless advocates are claiming victory tonight after the city of san jose backed away from a controversial crackdown on people feeding the homeless in a downtown park. The city says they want to focus more on educating the homeless here at this park on how to get help and also educating the public on concerns with feeding the homeless before enforcing this ordinance. How you doing . Hows your day so far reporter its a random act of kindness for brandon. He decided to feed those less fortunate at the park in san jose. Because i understand, living out here in san jose is very difficult. Its very hard. Very expensive. And the quality of life for everybody is not equal. Reporter its food 57yearold Lavelle Moore relies on, but it stirred up controversy. Last month the sutd of san jose driven by residents complaining about litter and trash considered issuing citations in early august, enforcing a 2005 ordinance as stated on this sign, prohibiting food distribution. That plan drew outrage. On wednesday homeless advocates say the city told them theyre now backing down. Right now its off the table. Anyone who comes to feed can continue to feed and be free of fear that they might get cited. A spokesperson for the city of san jose points to eight soup kitchens downtown, four within walking distance of st. James park. She says the city is focusing on education rather than enforcement at this time. Were not here to Issue Citations unnecessarily. Were here to get the community to work together. I appreciate the city is willing to be reasonable. Were reaffirming their dignity and humanity and the churchs right to take care of the poor. Reporter advocates point to strong opposition from Church Groups and hardship from disabled Homeless Individuals to get the soup kitchen. Gilbert works downtown and has mixed emotions. A little disappointed the city is backing down given a few families are ever at the park. They have to put a stop to it. I know its hard for them but they do have to stop it because they are giving them like free rein. In the distance you can see Homeless Individuals are staying in tents here at this park and its 10 00 right now. Homeless advocates are pushing for a piece of land or property where they can get a permit and serve food. In the meantime, advocates are also starting a program, they want to start a program where they can clean up trash at this park. Azenith smith in san jose. Thank you. Two shooting suspects are in custody after an intense manhunt in san leandro tonight to put a neighborhood on lockdown. An Armed Robbery was reported about 2 30 near davis street and douglas drive. Police say the gunman fired shots in to an occupied car, injuring two people. They then took off running. Police set up a perimeter near arthur and midway avenues in order to shelter in place for nearby residents. At about 8 30, police said theyd taken the two suspects in to custody and canceled the shelter in place order. Lawyers for google were in federal court in oakland today defending the company against accusations of enabling terrorists. As ktvus tom vacar reports, a lawsuit was brought by the family of the cal state long beach student who was killed in a terror attack in paris. Reporter lawyers for the parents of nohemi gonzalez, slain in the paris terror attacks are suing youtube and Parent Company google. They charge youtube was complicit in the attack and deaths because youtube repeatedly allowed isis and its supporters to post many videos, sometimes with paid ads. U. S. Magistrate questioned both sides, but frequently challenged the parents lawyers claims. She was hard on us. She obviously read all the materials. I think she is going to very carefully consider everything. She asked us the tough questions and i think we answered them as best we can and shes going to ultimately make a decision. Reporter google is relying on the 21yearold Communications Decency act, a law passed long before most social media even existed. That law says that internet social sites cannot be held liable for things said and shown that was provided by others. The things were seeing in terms of the way that the internet is being used were not even imagined by the people who created that Communications Decency act. Reporter the lawyers argue in the world of worldwide internet, youtube should be responsible for providing isis and its supporters a platform they repeatedly use to practice and encourage terror attacks. Google maintains its immune from that as well and that the gonzalez case should be outright dismissed. After two solid hours of questioning and hearing the lawyers, magistrate ryu took the hearing for advancement that could be weeks or months away. That big book of cases in front of her, shes looked at this very carefully and shes going to look at it very carefully and i expect shell take as much time as she needs to write a scholarly, careful decision. Its blooming again and creating a toxic risk at some north bay beaches. The warnings going in to the weekend. Warnings are back up about toxic algae in the russian river. Sonoma county beaches will be open this weekend but visitors may want to leave their dogs at home. Debora villalon is live in heelsburg after talking with a dog owner who discovered the danger firsthand. These signs are posted along the Russian Reserve at the beaches advising about the blue green algae which weve seen elsewhere in the bay area. One pet owner warns where you see these signs, take them seriously. We were only in the river for a couple hours before she passed. Reporter its still pain frequently for brook to talk about posy, her 2yearold golden retriever who died on a float trip down the Russian Reserve. A trip brook and her husband had taken posy on before. I didnt see her drink any of the water. She was jumping in and out of the boat swimming beside us. Reporter they had no idea posy had contact with blue green algae which mixes with other river scum but produces a lethal toxic. Since dogs will play and swallow water and small children may put their hands in their mouth, for them its especially hazardous. Warmer water is more susceptible. And across california, lakes and rivers are seeing toxic algae bloom. We test 10 beaches along the russian river, the 10 most populated and frequently used beaches. Reporter Sonoma County found trace amounts at three beaches on its second week of tests. When we get up to the warning level, thats where we start saying perhaps people shouldnt be swimming in the water. Reporter its one of the spots with elevated levels. Like the other beaches, open but use caution. Theres the potential that the toxins are in the water so we want to encourage people to take precautions to protect themselves and particularly their animals. But other than that they should go and enjoy the river. So the weekend will be the tell i think, the proof. Reporter some who live near del rio beach wonder if the threat is well understood. Im aware of it but i dont know that everybody is. And i think people are just like, well, weve always swam in the river. Our dogs have always swam in the river so im not going to change anything. I think about her every day. Theres not a moment where shes not in my mind. Reporter brooke wishes shed gotten a warning. But summer before last, the threat was just emerging. Posy, who started the river trip a healthy dog, began convulsing and died in the canoe. She was shaking. It looked like she was cold so i was holding her because shes my baby and i love her. Reporter rudas insists no algae risk is worth it. You dont need to go in the water now. Just wait. Wait for the water levels to rise. Wait for warnings and other things to go away. Its not worth the risk. Since Sonoma County started monitoring, its never had to ban swimming or close beaches like some lakes have, but the river benefits by being a moving body of water so its always flowing and its not stagnant. Still, were headed in to the hottest months now, and thats when this algae blooms the most. You feel for that woman who lost her dog. And one thing i did learn today that people with pets should be aware, dogs are actually attracted to this algae. They seek it out. They want to play with it, chew on it. So its something theyll go toward which makes it even more risky. With her dog, it seems like it took very quickly. The dog died in the boat . Very quickly. Organ failure, respiratory failure. No recovery. No real antidote. It happens so fast. Pay attention to those signs. A sewage spill in to monterey bay has forced the closure of mackby beach. The beach closed Tuesday Morning and will remain closed until samples indicate the water there is safe for people to enter. Officials warn contact with water, contaminated by sewage, may cause severe stomach problems and other waterborne illnesses. Were tracking the heat around here. Temperatures really came up today. There we are on thursday. You can see the numbers, not the numbers but the trend has been way up there. Then on friday and saturday, tomorrow and saturday, temperatures will come down just a little bit. Its still pretty darn warm out there. These are the highs from today. We did see tripal digit heat in the valley. Highs tomorrow similar around the bay. I think it will drop one or two degrees. Going to be very minimal. The changes are very subtle. Outside we do have fog at the coast. We have fog trying to work its way in to the city. Across the bay. But its not going to have a big push. So you wake up and concord tomorrow, youre not going to have fog. Youre not going to have in richmond. Might have a little fog in berkeley and oakland. Burns off quick tomorrow and temperatures warm up. Thats sort of the plan for tomorrow. Let me jump ahead to the model. These are some of the temperatures. The winds are blowing basically in a lot of different directions. The microclimates tomorrow. In the bay youll be lots of 70s. Then low 80s and as soon as you get over the hill, temperatures roam rapidly tomorrow especially in the inland bay valley. Not upper 90s but mid 90s in the hotspots. 97 in discovery bay. Weathersby was shot and killed on new years eve of 2013. Three weeks later, his 19yearold brother and childhood friend were both shot and killed as they sat in a car near their home in east oakland. Witnesses reported seeing a suspect leave the scene, possibly in a silver dodge durango. A 30,000 reward is being offered for information leading to arrest in these cases. A napa county mother and her boyfriend were sentenced today to life in prison without parole for the torture and killing of her 3yearold daughter. Caleigh was found dead at her home in february of 2014. An autopsy showed she had died from Blunt Force Trauma from being stomped and punched.  the girls mother, 27yearold Sarah Lynn Krueger and her boyfriend, 29yearold Ryan Scott Warner were both tried together, but before separate juries for her murder.
