We begin with the state of the union, unlike any other, impeached president addressing a bitterly divided congress while also seeking reelection. Those divisions were on vivid display last night. With the president looking away from the House Speakers outstretched hand to nancy pelosi ripping up the president s speech when he finished. At times it felt more like a Campaign Rally than a formal address with republican lawmakers chanting four more years. And democrat s jeering the president. Trumps showmanship was on full display by reuniting an Army Sergeant with his wife and kid. Promoting School Choice for announcing a scholarship for a pennsylvania student. And awarding Rush Limbaugh with the president ial medal of freedom. Also noted the president did not mention impeachment once during the entire speech. For more on dramatic moments we just mentioned watch what happened when the president announced legislation to lower drug care costs as if such legislation had not been passed by the house. Moments later, pelosi omitted the customary language about it being a high privilege and distinct honor to introduce the president. Merely saying the president of the united states. On a different point throughout the night, pelosi could be seen shaking her head and appearing to mouth the words thats not true in reaction to the president s words. The night ends with pelosi ripping up her copy of the president s address as soon as he was finished speaking. Reporters asked her about that moment after she left the floor. Madam speaker, what did you think of trumps speech tonight . I tore it up. Because it was the courteous thing to do. With 71 of precincts reporting right now, Pete Buttigieg holding a slim lead over Bernie Sanders. Senator Elizabeth Warren is in third place, followed by joe biden. Of course, hes positions may change once the votes are eventually counted. The Iowa Democratic party is blaming the issue on a coding issue with a new app that was meant to help speed up the caucus results. Lets get into this a bit. Reporter of the Washington Post, eugene scott, some of the best stuff i saw coming out of twitter with regard to the release of some of those results. At that point, i believe it was 62 of the release of the results. One tweet i saw someone saying i just watched 62 what was that movie with jack and rose titanic. Titanic. Seemed like jack and rose were doing pretty well which i thought was funny. What do you make out of the latest numbers out of iowa . Well, you know, theyre still coming in. But it certainly suggests that there was a lot of support in iowa for a new face, specifically Pete Buttigiegs. And i think that in addition to the idea that many voters do want a moderate, as far as his lead goes, is telling. Now, obviously, his lead right now is not lead to imbalance ahead of Bernie Sanders who is not a moderate so that also suggests that a sizable percentage of voters so far are interested in a more progressive direction for the Democratic Party. And so, i think people right now, are still waiting. And cannot draw any sweeping conclusions about the direction of the party based on iowa. Until the final results are in. Lets talk a little bit, eugene, about the state of the union and how republicans, after seeing what happened yesterday, as well as the white house being on and responding to speaker pelosis actions of ripping up the president s speech. Is this seen as further tensions between the Political Parties given the fact that also as you mentioned did not shake her hand and offered her that courtesy and respect walking into the house . Well, it certainly didnt bring about unity. But that wasnt really the expectation. Anyone paying attention to where the parties are right now. What they do during the daytime. The hours leading up to this speech would not have expected them to be on the same page, despite the fact that the state of the union generally is viewed as a unifying moment for the parties. It hasnt been for a while. And that goes before the trump administration, as anyone who covered the Obama Administration has seen. But it will be really interesting to see what could happen at the next state of the union, because it will be following, obviously, the 2020 election. But i want to circle back to the iowa results here, eugene. Because i feel like the overarching theme that we have heard so far is joe biden really dodged a bullet here. If these results had come out within the 12 hours or so after the caucuses began, we would be talking specifically about the fact that joe biden was in fourth place, if thats in fact where he remains once all of these results are released. But in fact thats not what were talking about, instead, were talking about what took place in iowa. The fact that were still two days later waiting for all of the results to be released. It definitely would have been a big day one story had joe biden come in fourth place. That would not have been as big as his critics hope because that would not have been the end of the joe Biden Campaign. We know that joe biden is doing really well in South Carolina and doing well in nevada as well. While im sure his team would have loved to win they did not need this win the sway over some other candidates attracting a lot of doubt outside of their bubble such as the Buttigieg Campaign really did need it. Beyond that, one person who dodged a bullet in all of this is amy klobuchar. Had these numbers come out right after the voting theres no way she could have given that same im going to encourage encourage speech. Eugene scott, well talk to you in a little bit. Speeches on the senate floor will continue today before the vote on the articles of impeachment when the trial resumes at around 4 00 p. M. Its still unclear whether senator doug jones of alabama will break from democrats on impeachment. He told reporters just yesterday that he will announce his decision ahead of this afternoons vote. Meanwhile, republican senator Susan Collins of maine said on the floor yesterday that she will vote to acquit on both articles. It was wrong for President Trump to mention former Vice President biden on that phone call. And it was wrong for him to ask a foreign country to investigate a political rival. I do not believe that the house has met its burden of showing that the president s conduct, however flawed, warrants the extreme step of immediate removal from office. I will vote to acquit on article 1. House managers described impeachment as a last resort for the congress. In this case, however, the house chose to skip the basic steps of judicial adjudication and, instead, led straight to impeachment as the first resort. Therefore, i will vote to acquit on article 2. So collins later told reporters she would have considered supporting a censure, had the house not moved forward first with impeachment. And republican ben sasse told the omaha world herald that it was wrong but trump did ultimately the right thing by releasing that aid. Joining us here on set, msnbc legal analyst danny cevallos. Danny, pretty straightforward, obviously that counts are known publicly that the president will be acquitted on both of these charges. But are we likely to see fireworks today or over in a few minutes . Look for a vote straight along party lines, 53 to 47 in favor of acquittal which, of course, is nowhere near the twothirds majority required to actually convict and then remove a president. No surprising today. Perhaps arguably no surprises from the outset of this trial. Because unlike a normal trial in the judicial branch, this trial has a bunch of jurors that we already knew their leanings before the trial began. I want to talk about what i just spoke about with regard to report ben sasse, we heard from senator Susan Collins. We heard from Lisa Murkowski with regarding to the way she was going to vote. All of them basically saying the president did something wrong here, but yet i will not vote to remove this president from office. Im wondering what you make of the significance of all of this . Is this them basically saying i want to get on the record saying the president did something wrong here, but not be on the record with my vote . Its a way of having their cake and eating it, too. By saying that the president did something wrong they can arguably saying were talking about maladministration, being bad at his job, doing something with questionable purpose and that is argue aboably acceptabl the constitution. The framers accepted maladministration being terrible at your job as that. They can conclude that the president did something wrong but can conclude that it doesnt rise to the level of a removable offense. That is something that is really critical because if they do vote to convict, if they say i do think the house has met its burden, but i want to convict the president but not remove him, they can thought do that, because a mandatory removal, on any conviction, no matter how serious or not serious is mandatory removal of the president. Let me get your thoughts quickly. Im not sure the country has the appetite for another impeachment trial. In a normal process a person cannot be charged for the same crime twice. Going forward, if theres new evidence that emerges if the house is able to get john bolton in front, and they realize theres something there. And if the president wins a second term, could there potentially be another round brought by the house . Virtually, none of the protections that apply to a criminal defendant in the judicial brarcnch in the articl3 courts have any application to the article 1 impeachment trial which has virtually no established rules of lower inclui procedure, including the double jeopardy clause. There is no double jeopardy clause you could impeach the president arguably again on exactly the same conduct because there is so such protection as afforded criminals. If new evidence arises especially an Impeachable Offense coming out of the same conduct, yes, arguably, you could see a new impeachment trial begin again. Im not sure americans have an appetite for that especially on an election year. Although adam schiff did say if he did it once, he can do it again. What a warning.
