The problem that wont go away for the trump white house, russia, specifically, its ties to fired former National Security adviser Michael Flynn. Just a short time ago the republican and Democratic Leaders of the House Oversight committee emerged from a Briefing Regarding flynn and suggested that flynn may have broken the law. Republican Jason Chaffetz and democrat Elijah Cummings say during his white house vetting flynn did not report money he received from russia nor did he receive permission to receive money from a foreign source. As a former military officer, you simply cannot take money from russia, turkey, or anybody else. The white house has refused to provide this committee with a single piece of paper in response to our bipartisan request and thats simply unacceptable. We have reports and analysis from nbcs kasie hunt, Kristen Welker and chief Legal Correspondent ari melbur. Kasie, on capitol hill, we need to explain the background here. All this starts well before the election. It does, chris. At issue is the are these payments that mike flynn received from rt, the Russian Network with ties to the russian government, and Jason Chaffetz and Elijah Cummings wrote to the white house and other Government Agencies saying hey, we have a lot of concerns about this and we would like to see all of the documents related to the former nsa directors contacts with foreign officials, with any Foreign Governments and leading to these payments. So we saw a relatively rare joint press Conference Today with Elijah Cummings and Jason Chaffetz after the white house declined to provide them with documents they had asked for. I caught up with Jason Chaffetz one or o aft that and take a look at what he had to say. This goes back for, you know, a year prior to donald trump ever becoming the president , so its not as if the white house isnt responding. There just arent documents and thats the problem. Reporter chaffetz also told me that part of why he doesnt think the white house can give them the documents theyve asked for is because there is no documentary evidence of what Michael Flynn did of contacts with Foreign Governments because he didnt follow the rules. I asked him, hey, do you believe that general flynn broke the law and chaffetz said well, i certainly dont think he complied with the law. A pretty significant accusation there. Now, of course, chaffetz, in interesting kind of set of timing, we found out that they received notice from the white house back last wednesday and, of course, we heard two days later that chaffetz plans to not run for reelection coming up in 2018. You wonder if that changes the equation here. To the white house, Kristen Welker has brands new reporting from white house reaction to what was said at that press conference. Let me break this down. The white house is pushing back very vigorously against this characterization that they declined to provide information. One white house official telling me that the white house cannot be accused of declining to share things we do not have or not filling requests that are too broad to fill. So what does that mean . Well according to this official, the request was for documentation in part that was generated prior january 20th, prior to President Trump being sworn into office. Effectively, the clearance documents that would have been processed under former president obamas administration. This official noting that any documentation relating to any contacts that Michael Flynn may or may not have had with foreign officials while he was here at the white house is too broad of a request because he was in contact with multiple foreign officials on a daily basis. So that is their pushback. Now, when i asked about the notion that they may be stonewallingthey disputed that vigorously and i also put the question to this official, that kasie put to chairman chaffetz which is, does this white house believe that Michael Flynn broke the law. This official was very firm saying look, there is a process, we need to let the process play itself out, but this official stressing that ultimately at the end of all of these congressional investigations they believe that it will prove what they say has always been the case which is that there were no contacts between the Trump Administration and russian officials aimed at collusion. So that is the vigorous pushback that we are getting from the white house at this hour, chris. As you know press Secretary Sean Spicer is going to brief reporters in about an hour from now and i think undoubtedly the briefing will be dominated by these questions. This is a headline that the Trump Administration, that President Trump, cannot shake. Its not what he wants to be talking about just four days before he marks his 100th day in office, chris. The fact that they did get back to you and you were able to talk to somebody to get reaction so quickly tells you about their priorities on this. Start with you, ari, and ask you what the white house said its too broad a request but lets start with the law and what it says. Im first going to play something that Jason Chaffetz had to say. Personally, i see no information or no data to support the notion that general flynn complied with the law. That is, he was supposed to seek permission and receive permission from both the secretary of state and the secretary of the army prior to travelingo russia to not only accept that payment but engage in that activity. Doesnt mean he didnt break the law, but what you would typically need is something that was an intent to deceive not just one missing piece of paper. Here is 18 usc 1 001 one of the governing laws for federal officials a member of the executive legislative or Judicial Branch of government knowingly, thats keyesword, and willfully false fis, conseals or covers a material fact can be in prison for up to five years. That gives prosecute ears bors t to swing. If theres a larger conspiracy or concern that foreign money was being actively hidden sure thats the law that could get you in trouble. These documents, are they likely a footnote do you think in this Russian Investigation overall, Russian Investigation, or could this be just sething bigger . Well it really depends on who knew what when. If the documents were something that white house was aware of, that they advised flynn to not put on his advised flynn it was not a big deal when vetted for National Security adviser, the disclosure form was, of course, before trump got into office so its not directly that somebody told him not to enter those items on that form, but the question is did people higher up than flynn know and kind of buried off to the side and not considered a big deal, then maybe it starts to play into the greater investigation. He said it was really unlikely that, despite democrats demands that the Oversight Committee would actually pull flynn to testify before them because the Intelligence Committee is already handling these matters generally speaking, so i think it depends on what flynn says happened around those earnings that he made, that income that he claimed, or that he made but did not claim, and whether that was a concern to trump and his higher subordinates. On the other hand, you have your sf 86 which is your top secret information form, where you have to declare all of your foreign contacts with foreign powers and we understand that Michael Flynn did not declare these in the sf 86 which is the security clearance document. So you have this, you know, you have this split between the two pieces of documentation and now theyre both being investigated and i think youre right, i think it might be a footnote to the Russian Investigation, but it may be a critical footnote that turns into evidence in an actual prosecution and i think it may be something Law Enforcement might pressure Michael Flynn with. And chris, to add to that point, it really does dovetail back with what the Washington Post reported weeks ago now where there were Law Enforcement leaks saying they felt that flynn misled them, which is potentially a separate felony. Donald trump is allowed to complain about these anonymous leaks, but it at least suggests a persistent concern that i would now describe as in Law Enforcement and the fbi and in the congress with now officials in both parties, chaffetz and cummings as you were emphasizing in your reporting that are all weaving around the same point which is not that they dont like flynns policies or general judgment but that they think there was a concerted effort here to hide, obscure or minimize what he was doing with foreign powers against the backdrop of an investigation over the role of russia in this election. This trip comes at a time when ivanka trumps father, President Trump<\/a>, is not very popular, not at all here in germany, and allies and internationals in this country are eyeing his position on trade, on nato, on immigration as well, and these are all topics that you didnt hear much from from ivanka trump and instead she chose to focus on the reason she is here the w20 summit focused on empowering women economically, specifically focusing on female entreprenrs as she talked a little bit in ouriscussion about paid leave as well, but theres still no legislation ta her father has put forward right now, trump stressing the need she says to bring together a bipartisan consensus on that topic and then also the announcement of that womens fund essentially a world bank backed fund to help free mail entrepreneurs around the world. I understand and who wouldnt push back on that headline in the german paper, hallie, anybody in her position would probably say what she had said, she doesnt like the implication of it, but how does she view her role . What did she tell you . First time on the world stage and we saw afterwards there seemed to be some play, positive interplay with Angela Merkel<\/a>, what does she see her job essentially as . So two things here. Number one, i dont know that it is defined at least not publicly. When you ask ivanka trump and white house aides about this position she says as she said today publicly she is continuing to listen and learn. That exact question, chris, was the first one from the moderator here at the w20 panel. What are you doing in your fathers administration and ivanka trump said she is looking to make essentially incremental positive change and right now that defining of the role appears to be still be worked out. And this is an answer she has given now repeatedly as shes taken on this role as unpaid adviser. The second part a relationship with an gloig merkAngela Merkel<\/a>e a couple awkward moments when Angela Merkel<\/a> visited washington last month with President Trump<\/a>, it is possible that chancellor merkel sees ivanka trump as a way to create an ally essentially to create a partnership with somebody close to President Trump<\/a> who can help potentially influence him on topics important to germany. A strategic invitation potentially. Jonathan, you know, look a lot of people have been critical about the and used the word nepotism here but in the broader picture we saw Valerie Jarrett<\/a> represent the president in this way as an adviser to barack obama, and like ivanka, although not a blood relative arguably the person on his staff closest to him, is this any different . With well thats a great question, and Valerie Jarrett<\/a> is a person who would push back fence the comparison of her to ivanka trump but lets look at it this way. You know, the power that Valerie Jarrett<\/a> had in the west wing and in the Obama Presidency<\/a> was that she knew both the president and the first lady, before they ever got into politics and so she knew them when. She had a relationship with them where she could go in and close the door and have very frank blunt and honest conversations with him, her and both of them. And if you take that and apply that to ivanka trump, it is easy to see how ivanka trump could play that role with her father. I mean, i think its interesting that Hallie Jackson<\/a> brought up the fact that maybe chancellor Angela Merkel<\/a> views a relationship with ivanka trump as a way of having some kind of access, someone within the west wing, who seems to be reasonable, who she could talk to, and because ivanka trump is the president s daughter, is someone who is praised throughout her life and on the campaign trail and has brought her on to the staff to be assistant to the president , that clearly she is someone who has his ear and someone he trusts implicitly. So, lets go back to what Hallie Jackson<\/a> said in the twopart question because, you know, her father has called her the mastermind behind paid Maternity Leave<\/a> but nothing has happened on that yet, and yet a lot of democrats, you know this, jonathan, who do see her as the potential moderating factor, as do see her as someone, for example, who can push that through, but does she need to show from a political standpoint, does she need to show that she can help get something done as adviser to the president as we point to things, for example, that Valerie Jarrett<\/a> took the lead on that, did get done . Does she need to do that and do it in a fairly fast fashion . Oh, absolutely she has to show she has power in the office that shes been given by her father. I mean you cannot let story after story sit out there saying that youre a moderating force, that you are someone who believes in and will be an advocate for, you know, womens issues and then not be able to show that you are able to act on that power or act that power out. And, you know, if you want to make a comparison to Valerie Jarrett<\/a> as you brought up, any number of things that the Obama Administration<\/a> can point to that were successes that will lead back to Valerie Jarrett<\/a>s office when they were in the white house. Ivanka trump has it to show that, you know, all these glowing stories and the whispering around washington about her moderating force are not just rumors and not just feelgood stories but are like real. And that have manifested themselves into policy. Which lead mess to my final question for you hallie, bravo for getting this interview, because we havent heard a lot from ivanka and we know how close she is to her dad so its important we have a sense of where she is and what her views are. But do you sense that she feels any of the pressure to get anything done or is she going to be the person who will be behind the scenes who doesnt want to be seen because of the familial relationship and how close she is to her dad is actually having any influence . I think it is clear based on what we have seen, at least so far, chris, during this now, what, 95 day old administration, that ivanka trump prefers to work behind the scenes and that is something we talked about, that she prefers to have these conversations away from sort of the glare of the public spotlight. She referenced and she has referenced before, this idea that things need to be publicly denounced, she didnt like that idea. She prefers to have these conversations with her father and other advisors, iludi i would imagine her husband Jared Kushner<\/a> on his adviserry team. That said there is a question mark of the timeline here in your conversation with jonathan. When might we see the big ivanka trump rollout of x policy, almost certainly will be focused on womens issues, whether thats paid Maternity Leave<\/a> or expanded child care benefits, and i think there is expectations going on. When pressed, its still early, im still getting my bearings on this role and listening and learning. At some point that listening will need to presumably turn into action and that is the question that a lot of folks are looking to see, what is that action going to be . Longer term issues for him potentially and first on the topic of health care 50 of americans have little or no confidence in the gop efforts to repeal and replace obamacare. Thats compared to 21 who either say they have a great deal or some amount of confidence. Then on the issue of free trade, chris, 57 of americans who think that free trade is something thats good, rather than bad. That 50 is the highest number that this in our polls history on this question. On the topic of immigration 60 of americans think that immigration helps more than it hurts versus 32 of americans who believe that it hurts more than helps. Kind of a donald trump has about 60 of the country against him on this one, comes the topic of immigration. How speaker paul ryan, the most unfavorable politician in our nbc wall street journal poll. A lot of the negativity hes taken on from fellow republicans and trump voters after the first two or three moments in office for President Trump<\/a>. And chris, lastly, democrats have a fourpoint lead on the generic ballot. The question asked who do you prefer to be in control of congress, democrats or republicans . On the surface this seems to be a good number for democrats but consider that in 2006 and 2008, the years they had big ins, it was not just a fourpoint lead, they had near doubledigit lead. So democrats seem to boost that number to have a chance to take back the house of representatives although still very early. It is early, indeed. Thank you so much, mark murray. Thanks. I look at the number 4 , mark murray the pollster, im not, when i look at the president s numbers, when i look at the numbers for congress, Republican Congress<\/a> and those horrifying numbers, if youre the speaker of the house, i think 4 doesnt sound like a lot. How do you read these numbers . Well, look, i think were a long way from 2018 and i think voters will make a decision as we get closer to that. I think right now the question is, is donald trump delivering for the voters who elected him . He made a bunch of promises in the campaign and made promises he would deliver things in 100 days and he hasnt delivered those things, chris. Thats the way president s are judged. Fundamentally theyre judged do they keep their promises, deliver the kind of results that they said they would deliver and right now donald trump is coming up short in a big way on that. Thats what you see in the low approval numbers. Lets look at, for example, the wall. We all know what he said on the campaign trail and he said it every single day that he was going to build this wall, they were saying he was still going to build the wall, questions was it going to lead to a government shutdown. Now we hear that hes willing to wait until the fall and wait until things, you know, sort of settle and he doesnt want a government shutdown. I think theres a couple ways of looking at this, right. Its another example of the president not keeping his word or given the statements this morning that he will pursue it come the fall, is this instead a president who maybe learned from the Health Care Debacle<\/a> that things in washington dont always move quickly and he will need time to make it happen, could it be viewed as a positive sign sp. Look, i oppose the wall so anything that puts it off is good from my perspective. He promised almoster day he would build this wall and the mexicans would pay for the wall. Neither is happening, neither seems like theyre going to happen any time soon f at all. On october 22nd when trying to relaunch his campan at near the end of the campaign he wen to gettysburg pennsylvania and promised a contract of things he would do in 100 days, fight for, he would get passed. There were ten items he would fight to get passed through in the first 100 days. Nine he hasnt sent to congress yet. Any hard to see any effort being made to deliver the core promises. Ivanka trump and child care and paid leave that is one of the things he promised to get passed in the first 100 days and he hasnt released a plan on that. Just a lack of action on the bread and butter issues that people who voted for donald trump thought he would deliver on and hes just not delivering on them. So if thats true and i think, you know, quantifybly what you say, for example, about his contract and the ten pieces of legislation he was going to do is absolutely true and we see some of these bad numbers for him on some of these issues, what do the democrats do about it . Do you have a sense that they have a plan to move forward to say, we have an alternative here and that theyre going to speak with one voice . We didnt see it, for example, when we saw the head of the dnc go out on the road with bernie sanders. Well look, were the Minority Party<\/a> and theres a lot of disadvantages to that but one advantage its not our job to get these things passedp we dont have the votes to get them passed. We dont have the votes in either chame ter to get them pass. You have to have a message. The first step of the message is telling voters that donald trump hasnt delivered for them and making sure everyone understand that. Sdrms to put forward some of their ideas on infrastructure and taxes. I spent a couple weeks ago laying out a plan for democrats as a tax reform plan we would put forward. I ink we hav to have alternativ. The first question is, is the president doing the job . Hes not doing the job. Thats the most Important Message<\/a> for democrats at the 100 days mark. Generally the people we talked to at this popular pub, diners and elsewhere is that they wanted change. They voted for barack obama twice, in fact, because they wanted change, and now theyve turned around and voted for donald trump. Some people told me they wanted a change in attitude and approach in the perception that the United States<\/a> had across the world, and generally those that we talked to who voted for donald trump say that he is doing that. He showed how decisive he was, they said, in how he responded to syria and theyre cautiously optimistic he will be able to handle north korea well because of his abilities as a dealmaker and negotiator. That was generally the sense, though, every person had a different answer on what they think should be done. A couple of examples. I do like him meeting with china, leaders from china, meeting with people in the area. I think you can get a lot done through allies and through talking. However, if you have a dictator like he is, in north korea, and hes threatening everybody and he might be a bit unbalanced you dont know what somebody like that is going to do. They keep letting this go and letting this go and try to talk to him and in the meantime he keeps building up his weapons and Nuclear Weapon<\/a>s. They should get rid of him real quick. Reporter now what was interesting to me is that even though this is a place where, as you mentioned, ford shut down a plant in 2008, now ford has said they will reinvest, jobs wasnt necessarily top of mind for a lot of people we talked to. They, when i asked about how trump was doing generally, they talked about forei policy. So theyre takingotice and theyre paying close attention to these kinds of things that donald trump is doing. I want to bring in jeremy bash, former chief of staff at the department of defense and cia now an msnbc National Security<\/a> analyst and john park, Asian Security<\/a> analyst at the Harvard School<\/a> of government and get into the nitty gritty, but if i can jeremy, because of your roles in the past, i am curious about the views of the American People<\/a> and the fact that there is a lot of attention being paid now to the situation in north korea. People do seem to be engaged in it, theyre afraid of it. Does that ever play into decisions that get made . Absolutely. I mean the National Security<\/a> Decision Makers<\/a> in our government try to reflect what they think they are hearing from the people, from the congress, and theres no doubt about it, kim jongun and north korea is one of the most significant threats we face. Hes inscrutable, unpredictable, he has a record of destabilizing activities and now hes building these capabilities to include not just a miniaturized Nuclear Weapon<\/a> that can go on top of a rocket but also that delivery device, intercontinental ballistic missile, a matter of grave concern to south korea our ally where we have about 30,000 troops, our ally japan where we have about 20,000 troops and australia and others in the region. So this is top of mind for National Security<\/a> Decision Makers<\/a>. The question is what have we gotten from the administrations approach. We probably have gotten china more engaged but some of our messages have been inconsistent. Secretary mattis and tillerson have essentially given the North Koreans<\/a> the silent treatment. I think thats smart because fundamentally what kim jongun craves is attention. The president has been tweeting about preemptive military action and were going to take care of this problem by ourselves. They could hit seoul and its game on in the peninsula. War breaks out and its a dangerous situation. How much, john, is the clock ticking . There was a New York Times<\/a> headline today and i want to read part of the story, as they were talking about the pace that north korea is on to continue to be an even greater nuclear threat. Quote, a growing body of expert studies and classified intelligence reports that conclude north korea is capable of producing a nuclear bomb every six or seven weeks, how much is the clock ticking . Its ticking very fast, chris. If you look at the current state of development, north korea is on a trajectory with its Nuclear Weapon<\/a>s Development Program<\/a> to essentially jump a few steps here in the sense of what we had estimated traditionally where north korea would be. But with respect to what the reports are saying these days, we have to keep in mind that its one thing to produce the fissile material, the weaponized material for nuclear device, its another to test it, to master it and then eventually to deploy it. Those are the areas that were seeing unfolding, but there is a bit of time. I would say that overall the pace is certaly picking up, but looking at where north korea needs to go, what the last few stages, there is a bit of wiggle room here. You heard one of the folks say they were glad that, you know, were developing a relationship with china. The other part of that is, how much of the United States<\/a> should the United States<\/a> be trusting china. Where do you think they fit into all this . Well, its one thing to trust china. Theres a big debate about how much we should either outsource as some people call it the problem to the chinese or pressure china to do more. But ultimately it boils down to the definition of the issue at hand, the problem if you will. If you look at the chinese responses in the past when they have been the target of tremendous political pressure from washington or seoul, the chinese response is this is a u. S. Problem. China will be supportive, will try to support dialog and peaceful negotiations, but ultimately this is something that the United States<\/a> has to solve by sitting down at the table with north korea.
