James comey has been called to appear on december the 3rd, and Loretta Lynch one day later. Already comey is signaling he will fight the subpoena tweeting this. Im still happy to sit in the light and answer all questions, but i will resist a closed door thing because ive seen enough of their selective leaking and distorti distortion. He continues, lets have a hearing and invite everyone to see. Joining me live Pete Williams and former u. S. Attorney joyce vance. Pete, let me start with you. What does the outgoing chairman of the Judiciary Committee want to see happen on the 3rd and 4th of december . He has talked about this for some time. I can count probably how many days are left for him. Thats the issue here. Theres basically only 20 hearing days until christmas for the House Republicans and then of course in the new year, the democrats take over the house. Theyre really trying to race the clock here. The republicans on the house Judiciary Committee especially have been strongly trying to pursue an investigation of what went on during the clinton email investigation because they believe that there was an effort within the fbi to try to undercut the Trump Campaign, and they are still concerned that the fbi didnt do the right thing in declining to recommend a prosecution for hillary clinton. Joyce vance, peter king, the congressman from long island was on msnbc last hour. He sits on the Intelligence Committee. He sits on the Homeland Security committee as well. He talked about why this is a good idea in his estimation, what lawmakers might learn. Lets take a listen to what the congressman had to say. This is actually something that should have been done a while ago. To me there are real questions as to how he conducted himself, why he began this investigation in the first place. Why in many cases he was telling us one thing behind the scenes and refused to say it publicly. He told us all along that donald trump was never a subject of the investigation, but refused to say that publicly. Joyce vance, at this point, what can we learn . Bob goodlap said this investigation is not about donald trump. Its not about hillary clinton, its about being able to conduct an impartial investigation. Whats your sense of what we could learn if Loretta Lynch and james comey are brought to capitol hill to do this in closed session . I think thats exactly the right question to ask and whether the appropriate focus for the use of congressional resources at this point in time is a former attorney general, a former fbi director, and a closed investigation, seems like the appropriate focus would be for congress to learn more about russian efforts to interfere with our election and charting a path forward. A way to make sure it doesnt happen again, to take the steps that are necessary, whether thats legislation and with Law Enforcement. I dont know how much we learned from a hearing that involves director comey and attorney general lynch, but one thing thats for certain is holding it behind closed doors does nothing to move this story forward, and in the tradition of the congress of holding open hearings on nonclassified matter, the only realistic way to do this would be an open session. Pete williams on that point, ive read that tweet from james comey saying he wants to do this in the light, in an open session. What are Republican Leadership saying about why theyre not moving in that direction . Well, i think they feel that theyll get more candid answers in a closed session, and of course they hold the cards here, although this whole business of subpoenaing a former Government Official is always tricky because while congress does have subpoena powers, if mr. Comey decides to resist the subpoena and who knows what hes actually going to do here theres sort of this public back and forth playing out to try to persuade them to have this as an open hearing, if he decides to resist the subpoena, then the house would have to vote to find him in contempt of congress, and then it would be referred to the u. S. Attorney here in washington, who could decide whether or not to prosecute. The law says he shall, but in the past sometimes members of the u. S. Attorneys office have refused to pursue these contempt citations. So who knows how it would play out, and of course the clock might run out anyway. Pete, weve followed how the comedy on capitol hill has deteriorated over these last many years, especially on these committees. You look at the Intelligence Committee as a prime example of that. It certainly has happened on other committees as well. Just give us the big picture of what changes, when jerry nadler comes and takes over the Judiciary Committee, whats going to change in terms of the scope or focus of an investigation like this one . One word answer if that, everything. Because this focus on the hillary email investigation is going to go away. Thats been a top priority for many House Republicans. You can be assured that thats not going to be a top priority for house democrats, and it will probably revive the interest in trying to pursue the russian meddling investigation in the house that kind of sort of ran out of steam under Republican Leadership. So i think youre going to see you know, weve seen over the last several years this continuing cycle of when you have the opposite party in control of congress, they seem to spend most of their time investigating the president regardless of which party is in power and which partys running the congress. And obviously thats going to change again come the first of january. Always good to talk to you. Thank you very much. Joyce vance as well. Now lets bring in Time Magazine jay newton small, and susan paige. Susan, let me start with you. I was looking at statements from david kelly. He said what were seeing here a divergence from house rules. When you look at what theyre asking for here, what chairman goodlap wants to happen on the 3rd and 4th of december. How far is this a divergence . Its a divergence from the standard past which is not to have subpoenas when you hardly have a chance to act on information that you would find. It is one of the things that fuels americans feelings that theyre not that satisfied or admire what congress does because you have the sense that the Opposition Party, the party that the Opposition Party about to take power so the party in powers wants to do whatever they can to damage their interests before they take over. Its hard to take this as something that is not a political stunt. As you think about what the questions might be like from the republicans on this committee, i imagine that underpinning a lot of the q a is going to be this Inspector General report looking at all that transpired in 2016 visavis james comey and Loretta Lynch. Give us your sense of where the questioning might lead should this happen . I think certainly comey was correct when he expressed reservations on twitter saying that there would be selective leaking of this information or from whatever testimony that he and Loretta Lynch might present. I think there is a worry that the whatever leaks would be sort of hand chosen and without context from, you know, by the republican side of the aisle on that testimony and the testimony is going to focus on a lot of issues that we have heard about a lot, already from these committees in the last two years, that theyre, you know, looking into hillarys emails, looking into the server, the independent server, the investigation into that. Looking into the potential conflicts of interest by Loretta Lynch, and the investigations into the campaigns. This is stuff that congress has already exhaustively looked at. The idea that youre going to need them to come again to testify when theyve already offered to testify on the record, you dont need to subpoena them, seems like, again, like susan said, its just a drama sort of the last minute kind of saying look at our power. Like, were going to force the truth out of these guys in the last minute. Were going to do this one more time, when the fact of the matter is they didnt need to subpoena these people. They had already offered to testify on the record in opening hearing. I was joking with Pete Williams saying i could count on two hands how many days this Republican Congress has left, at least on the house side. How much of a road map is there for this investigation . Rod rosenstein might be somebody the outgoing chairman might want to call to testify. Is there a list . Is there a road map . Are there individuals they want to talk to or are we seeing everything being thrown at the wall in the last few days . I think this is an effort to do whatever they can in these last few days. These hearings when theyre serious, they require some preparation. Theres usually some back and forth about whats going to be covered, open or closed hearings, when will they be held. You dont get the sense that has happened in this case. The clock is ticking. Christmas is coming, and with that will come a new congress and its not as though democrats may not pull political stunt ofs the their own, but it does if theres a road map here it may be a road map for democrats to pull some of the same stunts that republicans are pulling here in these final days. Rod rosenstein was talked about as somebody whos going to go before this hearing. Dealing with so little time as we are here in this congress, whats the likelihood that through procedural measures or whatever this is postponed to the point that doesnt happen . I think theres a pretty good likelihood, especially when you have democratic opposition to this where they can drag their feet a bit in these hearings with back and forth, with the Justice Department in negotiations and whether theyre going to make Deputy Attorney general Rod Rosenstein available for these kind of hearings. Subpoenaing him, versus subpoenaing a former Government Official is a much more complicated process. If he doesnt want to testify, i think its a lot harder for them to force his appearance moving, you know, in the next essentially three weeks before theyre out for the year. The whole border, i mean the whole border. President trump responding on thursday threatening to shut down the entire u. S. Mexico border over the arrival of migrants from Central America who are hoping to apply for asylum. This morning it seems the southern border is still on the president s mind tweeting a plea to lawmakers on both sides of the aisle to fund the border wall. Nbcs Kelly Odonnell is in west palm beach, florida, where the president is spending the holiday. Help us distill all of this. The tweets, the comments that he made to u. S. Military serving overseas, the comments he made to reporters on the heels of that call. What is the president s message on Border Security during this thanksgiving holiday . Reporter well, hi david, and happy holiday to you. The president is clearly feeling pressure that one of his signature promises, a border wall, and his beliefs on immigration that are hard line and certainly drive his supporters are going to some degree unfulfilled. The border wall is something that is a real dividing line, and he is coming up against a deadline that he may not have imagined would come his way, and that is democrats will take control of the house come january, so in these remaining weeks, he is hoping there would be some kind of deal to be made that would fund the border wall, and there is some pressure because there is a funding deadline coming up in december, and parts of the government would lapse in funding. Though congress has been able to fund for a longer term period, many parts of the u. S. Government, but they did not get it all done, and thats where this threat of a shutdown could come into play. It would not be for the entire government, but would be for portions of it, but it gives the president a bit of leverage because he would have to sign any shortterm spending gap that the congress would try to put through in order to avoid a shutdown, which we have seen as politically bad for everyone. Today the president in sort of an uncharacteristic sort of attempt to encourage bipartisanship says that on twitter republicans and democrats must come together finally with a major Border Security package, which will include funding for the wall. He says after 40 years of talk, it is finally time for action. Fix the border once and for all and do it now. The president perhaps trying to see the world in which he would like it to be where there could be a deal to be made. Theres really no political sort of urgency for democrats to go along with that, unless there were something really tantalizing offered to them and frankly, in january they will have control of the legislative docket on the house side and will be able to determine what comes to the floor for a vote and what does not. The president is under pressure with time, with reality of politics, and he has made promises that are at least to some degree unfulfilled. Theres been some border wall funding but not enough to do what he said he would do, so the president is under pressure and certainly talking about it in the ways weve come to know. He spoke to military personnel members. Thats unusual to talk policy to those serving in uniform, and then of course exchanging with reporters as we saw on thanksgiving day. Lets take a listen. Theres fistfights all over the street. Theyre starting fistfights. They said these are not like normal innocent people. These are people when you talk to them they start a fistfight. I dont want that in this country. If they have to theyll use lethal force. If they have to. Hes talking about the authorization of legal force. I want you to help me understand the magnitude of that decision the president has made. There will be a lot of people who remember what happened in 1997 when a marine shot a goat herder on the rio grande in texas. Theyre worried about what this might lead to, and the president seemingly approaching this in a kind of cavalier fashion. Yeah, i think its appalling, and it comes out of nowhere.
