Today is a solemn and sad day. The third time in a little over a century and a half, the House Judiciary Committee has voted articles of impeachment against the president for abuse of power and obstruction of congress. The house will act expeditiously. Thank you. Tenminute proceedings followed a grueling 14 hours of debate and last night tabling of a vote by the democratic chairman. A move that infuriated Jerry Nadlers republican colleagues. There was no consulting for the Ranking Member on your schedule there tomorrow. You have just blown up skenguchs for everyone. A schedule issue of this magnitude. So typical. This is the Kangaroo Court that were talking about. This is a really sneaky move on their part. Democrats, obviously, disagree whole heartedly. It looks like a full house vote will happen on wednesday, which means President Trump could be impeached just days before christmas. If the house impeaches President Trump, the next phase will be a trial in the senate and in an interview on fox, senator Mitch Mcconnell assured sean hannity that the president is safe. Theres no chance the president is going to be removed from office. My hope is that there wont be a single republican who votes for either of these articles of impeachment. Well see about that. Based on that, Senate Republicans already intend, at least by Mitch Mcconnell standards. Joining me from capitol hill, msnbc correspondent garret move to the broader house and a rules markup. When are we expecting to see it on the floor for a vote and what will that look like . This will be an allday affair once we get out of the rules mark up, although it is another speed bump along the way. Every member, remember, we only had debate over this in two committees. Intel and judiciary. There are literally hundreds of members of the house of representatives who are going to want to have a say in the consequential vote most will ever take. Expect a potentially floor debate on this on wednesday and once again possibly dealing with a vote late in the night. We dont expect to see much more deviation off a Party Line Vote here. Remember, two democrats who voted against opening this inquiry in the first place. One independent who voted for it. Those votes will likely stay the same. Were watching closely the more moderate democrats, particularly some of the freshman who came in in this new class in 2018 to see which way theyre leaning. So far of those who have spoken out, all have said they will vote for impeachment. Wow. Nancy pelosi was asked about the moderates by a reporter a little bit earlier today. Heres what she said. What is your message to those moderate democrats who are undecided and who are concerned that a vote for impeachment could back fire on them politically . I have no message to them. We are not whipping this legislation. People have to come to their own conclusions. They have seen the facts as presented and the Intelligence Committee that has seen the constitution and they know it. They have taken oath to protect and defend it. But they see the constitutional experts speak about it. Theyll make their own decisions. I dont say anything to them. Those eagle eyed viewers at home might have noticed that was actually from yesterday not today. So, shes not whipping votes. Shes making this a vote of conscious. Any indication that republicans might have a change of conscious on this . Unlikely. Look, i mean, republicans have been in lock step behind the president and on this Kevin Mccarthy told one of our hill team members yesterday that he doesnt think theyll see a signal defection and im seeing the same thing from my perch here. You look at republicans who might be considered vulnerable here who might vote against the president. Somebody like will herd from texas. He represents a clinton district there. He is retiring. He has long been a critic of the president on certain issues. But hes also on Intel Committee and said at the end of their hearings, he didnt think he had seen enough evidence yet. If i was a betting person, more likely that republicans keep everyone in line in a house vote. A senate vote is a different story. There youve got 100 independent contractors essentially. Some of those republicans in the senate are very loyal to the president , but some are not. And you might see a different result there. Will herd, the faith in will herd potentially switching lines on this is diminishing by the hour, especially after he said that during the intel hearing the other week. I know republicans are targeting a number of those front line democrats were going to put their names up on the screen for you. These are eight vulnerable democrats that republicans are trying to pressure to change their votes. If they dont do that, theyre going to try to use it against them for 2020. Even if it is a Party Line Vote or crosses the line on the republican leaning side, regardless, this is a moment that will go down in history. Well be teaching this in the history books and telling our infant children that they were alive during this. Kind of amazing to me, certainly for President Trump, you know, going to be impeached and he cant escape that. Thats it. But, you know, also striking to me that there is something anticlimatic for this for all the history of it. Why . Because its obvious that the whole proceeding cant escape the bounds of polarization and partisanship in this washington. That democrats were able to convince their own party to go ahead, but not really make, you know, a huge end roads with voters outside their party and build momentum to bring republicans along. It remains what nancy pelosi feared it would be. An exercise in partisan power, however justified. I think you hit the nail on the head because we have been talking about so much and it feels like we have been having a discussion about impeachment for many weeks but the impeachment debate for the past week and it feels like yesterday should have been a debate. A debate on the merits of impeachment and a debate on the merits of the fact and a debate on whether or not what the president did was an Impeachable Offense. Not a debate on whether or not the president did what he did. And thats what we were seeing with republicans just refusing to acknowledge what the president said with his own mouth. I want you to do us a favor standing on the white house lawn. China, if you want, investigate the bidens. Just refusing to acknowledge the president s actions. Not one of them said it was a perfect call, as the president has maintained. I think what weve seen here, especially yesterday, was hours and hours and hours of republicans treating every minute like that hearing. Like it was a fox news segment. And as soon as their spiel was done, they moved on to the next segment. This is kind of the byproduct of a situation where you have a quote, unquote proceeding or hearing where the majority of the firsthand fact that we heard republicans whine about all they, this is one of the times when we went into a situation where we already knew the end outcome. Mitch mcconnell is on tv telegraphing what is the outcome and we are not going to hear from any other people who could actually play a role in potentially changing minds in the American Public, as well with the republicans. The president committed no crime. That you couldnt prosecute this in a criminal trial. This is not a criminal trial and the impeachment standard is not one of a criminal of a crime. Its not one of a civil offense either. This is a completely different political standard. Everyone is making mistakes in both directions. Its not a crime, case closed. Broken record. Its bribery, treason or other high crimes and misdemeanors. High crimes and misdemeanors is a broad definition. Very hard to telegraph and very hard to break down yesterday to put it mildly was very tedious. What you had and the way you put it, katy, the characterizations of everything. Dont you agree that when a president for his own personal benefit. That is a characterization. Leading. Leading, very good. And a characterization of facts. Almost like youre in a case. Is the light red or green. One side is dug in that it is red and the other that it is green and you call a professor and say, you agree, professor, that he went through. For me, the lawyer, an open question as to whether or not this makes out a high crime or misdemeanor. I agree that Mitch Mcconnell should not because hes in the role as a juror should not turn around and say preordained outcome because when you start a trial, you start with a clean state. All the jurors and senators will take an oath to be impartial. How can you take an oath to be impartial after going on fox news and telling sean hannity, dont worry, the president will be fine. The trial is not going to be a real senator and senator mcconnell said he will coordinate closely with the person being prosecuted. But you dont really having a trial. Ultimately in american politics and in our constitution, an Impeachable Offense is what twothirds of the senate says it is. Its a vote. Its not written down on a statute. A matter of politics and what has happened here is democrats have not been able to, republicans have not been willing to see these things as Impeachable Offenses in the end. He tweeted, as well, the American People have already made up their mind on the, quote, hes hashtagging, impeachment scam. It will soon be proven. Taking a page from the president s book. Run towards scandal, not away from it. Pretty brazen and, in fact, he was still doing the kinds of things that got him in trouble the first time as this proceeding was unfolding. He was going back to ukraine to find more trouble for himself. Which i think probably goes to the president in feeling confident in how this is going to end. You know, i think hes emboldened by this. But im also not sure that the outcome here is going to really matter in 2020. Im not sure convinced at the end of the day that this vote or what happens next is going to for the democrats to draw a line in the sand. Say, historically speaking, this is what we will accept and this is what we wont accept. 2020 politics be dammed or is this a 2020 i dont think democrats will see a big upside from doing this. Take them at their word. Theyre saying theyre doing this because they cant let it happen this way. In terms of 2020 in polling. The president , we dont need to play it, but the president earlier today in calling this whole process a witchhunt, a sham and a hoax. He also claimed that all of the poll numbers for him have sky rocketed since this impeachment and gone down for impeachment and, reuters, i believe, has been tracking all the polls. We can put it up on our screen. December 45, november 47, november 46. September 45. Thats remarkably consistent in terms of the support for impeachment. If you are a if youre looking at this, do you feel better if youre a republican or do you feel better if youre a democrat. Any time you have close of the majority people thinking you should be impeached, thats not a good position to be in. Again, the election is so far away. I dont believe that anything that happens in december or january will have that drastic of a bearing what happens november of 2020 because however you feel about impeachment whether youre for it or against it. However that mobilizes you. You already made up your mind. You know who you are voting for in november a republican or democrat. It will have a complete wipeout. I think nicks right. The democrats have made the decision that this is what needs to be done. Historically speaking they need to draw a line in the sand. Impeachment is the permanent stain that donald trump needs to have and that will do him a lot of harm. This guy spent his entire adult life plastering his name on buildings. How do you feel about the way democrats try to prosecute the case in the house. I know prosecute is totally the right word, but argue the case in the house. Just getting over the top, in other words, in a real courtroom. What about the fact witnesses. The fact witnesses werent bad. I think everybody is too over, we had no due process and no opportunity to participate. Not fair to categorize it that way. On the other side when you bring in the law professors, not to go back to that, that was very disappointing. The fact is theyre not fact witnesses and theyre there to explain what is or isnt an Impeachable Offense. Instead you had angry outbursts, basically. It really demeaned. I was thinking back to my beloved law professors and i dont think they act in that fashion. You think some people across the country just tuned in i thought that the professors, you know, as a trial lawyer, i thought that kay came across with poor credibility. A number of them. I really mean that. That was the problem. I was surprised that democrats didnt make Rudy Giuliani more part of their narrative. He is supposed to be at the center of it all. Sondland was more of a centerpiece. Highlights the reason why the president isnt letting rudy jewel giuliani testify. Whether you agree with them or not know what theyre saying isnt true, they were message discipline. They repeated the same thing over and over. I wish democrats spent more time doing that about rudy.
