We begin, though, with our top story, former National Security adviser Michael Flynn back in the news, he is under an investigation, we are learning today, this one from the department of defenses Inspector General. Now, in question here, this involves a 2015 trip to russia that flynn made. He was appearing there at an event that was sponsored by russian government television. Investigators, what they are looking at, is a particular and crucial question. Did flynn disclose that he was receiving payments for that visit . Did he disclose it either to the Obama Administration, when he took that trip in 2015, or to the Trump Administration when he agreed to join as National Security adviser after the election . Now, the top democrat on the House Oversight committee, Elijah Cummings from maryland, he revealed today the existence of this department of defense investigation, and he says the Trump Administration is essentially stonewalling, not making available all of the documents that Congress Wants to see. Sean spicer, the white house spokesman, he says thats not the case. He says the questions here go back to the Obama Administration. When general flynn came into the white house, he had an active security clearance that was issued during the Obama Administration with all of the information thats been discussed thatccurred in 2015. And Nbcs Kelly Odonnell is standing by at the white house, so, kelly, we know the central issue here involves this trip in 2015. Flynn is a retired military officer, had some obligation to disclose. Obama was president then. Trump tried to bring him in as National Security adviser. The Trump Administration saying, hey, look at my predecessor for this it sounds like. Reporter because the security clearance is something that is not an extension of the political side of a white house, but it is a federal government and investigative tool that the people who get security clearance are checked out by the fbi, for example, and its something that just carries over from one administration to the next. That part is true, based on what we understand, that the security clearance flynn had did begin during the obama era. What is unclear is what, if anything, did Michael Flynn disclose, and did he meet all of the requirements necessary to say that he had received payment for this visit to russia . A part of why this is of interest is that as a retired flag officer, general level, there is a prohibition against accepting any money from a foreign government. Now, he received that money through a Speakers Bureau that had contracted flynn to work at an event for russia today. A tv network, russian based, that is a part of the russian government. Thats the link here. So there was a separation between flynn and the russian government through this russian activity and through this Speakers Bureau. Now, in his disclosures to the Trump White House, we did see when reviewed those documents flynn outlining the payment he received for this onetime event, but House Democrats are saying he failed to properly follow the rules and they want more answers. Now, today, flynns attorney put out a statement that in part says, the department mning the department of defense was fullyware of the trip. We urge dia Defense Intelligence agency and the committee to release the full unredacted letter along with the documents general flynn provided to dia during the briefings and details concerning the inperson briefings provided by general flynn to dia. Their argument is that he spoke to those officials at the department of defense, the Defense Intelligence agency, to explain his trip, also says that there werent any other questions. We just dont know where the gap may be. Did flynn intentionally hide from officials that he received payment . We dont know the answer to that. House democrats say they want more answers, the Trump White House is saying dont look here, this is not a matter for the Trump White House, he was an employee for 24 days. They say they dont have any more answers. This will persist, steve. Congressional investigations are under way. As you point out, the Inspector General of the department of defense has opened an investigation. They should be able to have access to everything the dia had at the time and well have to wait to see more of how willing are they to disclose more or how long will this investigation take . If the Trump White House wanted to turn the page on flynn, thats not happening. Steve . All right. Kelly odonnell over there at the white house. Kelly, thanks for that. President trump now just two days from hitting that symbolic 100day milestone. This as congress is still tries to figure out how to keep the government open ahead of the shutdown deadline tomorrow. Republican also try to build consensus on a Health Care Replacement plan. They had a breakthrough earlier this week, a deal with the Freedom Caucus. Speaker paul ryan today saying, responding to questions of whether hes getting pressure from the president to get this done before the 1300th day. This has been a very organic bottomup process. It takes time to do that. Were doing big things. You know me. I lked about 200 days. The kind of agenda were attempting to put together here, overhauling health care, overhauling the tax system, rebuilding our military, securing the border, those take more than just a few months. They take a long time. All right. Joining us now to discuss, lets bring in former minnesota governor, former president ial candidate, tim pawlenty. Jonathan swan. And another former democratic president ial candidate and former governor, msnbc contributor howard dean. Thanks to all of you for joining us. Jonathan, let me start with you on the reporting on this. Republicans took a whack at this earlier this year, it went nowhe nowhere. Sounds like paul ryan is going to be a little more careful before trying to bring it to the floor. What are the prospects of republicans actually getting to 218, to that majority number, on their own on this right now . , so the whip team is still counting. Basically. They still dont have a full sense of the moderates. It all comes down to the moderates at this point. Join talk to people in leadership, theyve been skeptical throughout. Deeply, deep ll lly skeptical w this was starting up. And bitterness of being kind of cut out of the process. At this point, the finish line is almost in sight and they say to any privately they would much rather be in a position where they have to win over moderates than the Freedom Caucus because these are people who historically, theyll grumble and grumble but theyre team players, ultimately they come back is this a situation they kind of got burned the first time, where they want to be confident theyve got the majority before no chances on the floor . Is that basically the threshold here . 1300 . The phrase you hear inside the white house and leadership is no artificial deadlines. Theyre just allergic to and quite irritated when i published yesterday they were talking about a bill on friday. They were talking about it. They just didnt want that out there because thats not helpful to them. Right. They want to keep this on the inside. Speaking of which, though, this is a deelg right nal right now. Lets move this forward for republicans. Onhe right, some members we a holdout the first time around. The estion is, will that alienate them or bring them around . Heres the house leader on that subject earlier today. I would argue this is a bill that a moderate would more likely want to support. Some people were concerned about ehbs. Ehbs were taken oust the bill. Essential Health Benefits were taken out of the earlier draft of the bill. Theyre now put back in. Tim pawlenty, im curious what you would say about that. The first time around we saw polling that said 17 favorable rates for that republican replacement plan. You look at moderate members here, a lot of them are from districts where Hillary Clinton won or did pretty well last fall. They gt ot to worry about 2018. How do you think a moderate republican member of congress is going to feel about going on the record in support of this. I think this could be some improvement in that regard. For example, the point that the speaker just mentioned putting the essential Health Benefits back into the bill meaning they have to be respected and observed and complied with means theres a minimum level of quality that are going to be in these Health Insurance plans so moderates might like that even though some of them could be clarified, by the way. On the conservative side, theyre saying states can apply for relief from certain aspects of obamacare. That may give glee to conservativ conservatives, may trouble some of the moderates. Theres the question of whether does this bill do to medicare funding . 3 is it better or worse than the last draft . Concern conservatives. We dont have good detail on what it looks like. How much does that weigh on an average member, a moderate here, hillary won the district by a point, maybe she lost by a point. When they see the first time around the polling on this was just toxic, well have to see if its improved with these changes to it, im not sure its going to move that much. How much is that going to weigh on them, do you think, though . Well, you mess with Peoples Health care, it matters a lot, especially with swing voters, especially with voters who may be struggling economically, so it is a big deal. That 137 is one of the reasons the last bill didnt go forward. On the other part of the scale, if youre republican, this is one of the holy grails, told the base, were going to repeal and replace obamacare. If they cant do something, plausibly, say, accomplish that, theyre going to be in big trouble from their own party. Howard dean, from the democratic standpoint, we know the democrats are universally against this in the house. Right. In terms of Going Forward on oba oba obamacare, you have the premiums that have gone up, places in country, rural places where there isnt competition in these marketplaces. Do democrats need to be out there proposing their own reforms on obamacare . There are no reforms to be had with this congress. Heres the problem, heres where i disagree with tim. The i mean, trumps base is still in great shape. Hes got 9 the hes got 94 of his own base. Theyre going to love him even if he doesnt get this thing through. After the failure of health care a few weeks ago. The people that worry about him are the people that ryan is now asking to walk the plank. This thing essentially gets rid of Community Rating for any state that wants to get rid of it. That means that preexisting conditions go back in, essentially, because you can charge so much for preexisting conditions that no one can afford insurance. That attacks trumps base directly. I think this is a big problem for republicans. The longer this goes on, the colder the feet of not just moderates but more to the Center Republicans who are at risk in 53 districts. I think were going to take back the house. That should give the big for us to get 48 in the first ballot in a very conservative district in georgia, ought to scare the daylights out of the house republicans. I bet it does and i bet this bill doesnt go anywhere. Bigger picture question here, jonathan swan, at the end of 1300 d1 100 days no major legislative accomplishments yet for the republican the white house. You have health care on the table. The Tax Blueprint that came out yesterday. What is the sense from republic chance on capitol hill in terms of the ur jen spi of ggency of on the board . Its all coming from the white house. The leadership is not fix saaten this 100day deadline. Its bullish the extent they want this done in a, you know, the extent to which artificial deadlines are being proposed is coming from the white house, not from republicans. I think it doesnt make any difference. The odd thing is the white house is driving they dont need to do it. The public doesnt give a damn about 1300 d00 days. Tim pawlenty, is there a connection were going to get a new score from the congressional budget office, estimate of what the cost, what the savings might be. Is there a connection between maybe passing that there a republican standpoint and getting republican support on the tax side where you could say, hey, we saved money on the deficit, on health care, and maybe you shouldnt be as worried about the deficit and the tax plan . Are these related, do you think . I think its even more technical than that, steve, if you understand the reconciliation process. The money that they supposedly save against the deficit and the debt in the Health Care Bill would be helpful to them in the tax bill. So it does open up some financial breathing room with that in mind. I think your point is exactly on target. What about the point howard dean was making there a second ago, he said hes bullish hes a democrat and bullish on their chances of taking back the house in 230018, look at the special elections, so far republicans ought to be nervous. Are you nervous . I enjoy and appreciate my friend, governor dean, but in this case i think his judgment is a little blurry. Jonathan swan, let me ask you, do you pick up any conversation about this on capitol hill among republicans . They seem look, their candidate won in kansas but it was closer than we usually see out there. Georgia, well see what happens. Democrats got close to 50. How is that registering with republicans on capitol hill . The conversations im having, people are so scrambled, what theyre saying is what we used to think of as safe seats are not necessarily safe seats. Theres also stuff thats winnable. He scrambled up the map and messed it up. Yeah, there is anety. Theres ways anxiety. With this guy, theres partular anxiety. They dont know whats going to come next. They fes endless problems with things like tax return, unforced errors, things that are going to stay in the news. And theyre seeing these town halls which just keep going. There is real energy out there. And, you know, i remember at the start of the administration, you would talk to members and they would say, you know, george soros, some of them would sort of say you dont hear that so much anymore. Theres an acknowledgement this is real. That thing thats out there, howard dean, it purely antitrump in terms of 2018, is it prodemocratic agenda . C can they be antitrump and thats enough for 2018 . The people who organize, our base is not the dnc, our base is the immigration protest organizers, the womens protest organizers. This is real, its big, its internet driven. These kids are not democrats. Attend they are they received a body blow. Donald trumps election basically negate ed every value the under 35 generation has in this country.
