Okay, great. So ive been communicate withing Entertainment Commission since november 2021 regarding the union blue bar, they were granted a g. M. Permit during covid period where the public was not allowed to have any opinion on their activities. This is a bar who in the same time, they were granted a permit in november of 2020. In that same month they were sued by one of my neighbors for building a unpermitted back yard and making so much noise or disturbing the neighbors. The lawsuit was successful, the question i wonder whether the commission knew that or took that into consideration when they granted this permit into the blue light. Since then, ive been reporting violations as a 60foot distance where they have to not exceed am byyant noise. Its not possible to not receive ampient noise. Ive submitted about 15 complaints, i think two or three have been given notice of violation. But in general my complaints are ignored. And most recently when they were in violation, i was told they were barely in violation, im not sure i understand of that. But because they were in violation, the permit was modified so they can have ambient above level. This is done, because they could not be able to continue their programming and also, satisfy the terms of their jam permit. It seems to me that they should stop operating rather than you should extend the distance of their allowed to make noise to bother the neighbors. I would like this to be changed back to she can only play unamplified music, thats my request. Sure, hi, president bleiman, the comment was accurate, there was an evaluation of jam blue permit. We know that the jam permits are fluid in the sense that we have been amending them, based on changes that are necessary. Recently, there was a determination that the program which the blue light is only allowed to have entertainment on fridays and saturdays with no drums, they self conditioned themselves with no drums. And the other days of the week, theyre allowed to have recorded amplified sound. We did extend the distance at which the entertainment portion is allowed to be heard of which is 100 feet from the property plain so we cannot exceed ampient which is consistent with the other permits that have same programming with live entertainment. Just taking this out of order, i just wanted to welcome our newest commissioner torres to seat 2. Its the board appointed industry seat, so welcome aboard. Were very happy to have you. Justium pg right in, soy wanted to update everybody on our annual survey. The survey did close at the end of october and we received 133 responses. We think this is a good sample size relative to service years. Our last year, we had about 120 responses. Kufrntly organize eyesing and analyzing this data and hell send you key findings in early december and plans to present to all of you at our december 20th hearing. If you want to check out the survey questions again, that is in your folder in the google drive. A shared update for you all tonight and this may be pertain to anybody watching who is a permit holder. Just announced that the deadline to receive the applications has been extend today january 15th from the original november 1 due date. Weve been promoting this new due bait in our e blast and social channels and urging everyone to act now and not wait until the due date to submit their applications. Just to help jog your memory, the permit is a permanent version of the permit that businesses can obtain to replace the pandemic shared spaces permit. The pandemic permits are said to ex tire at the end of the march 2023 and businesses must have a permit in order to operate after the Pandemic Program expires. The jam program which correlates to shared spaces are said to expire on march 31. This means that our jam permit holders have more time to apply for this legislative permit which they need in order to start their process for our brick and mortar. So were working with dpw for approval that are coming through with these spaces so we can align with our processes and continue out reach with our permit holders about their next steps for the transition. We plan to give you more update on this on the 20th of december, along with a proposal for any special hearings that might be needed. We may be able to nannage these with regularly scheduled hearings. But well keep you posted here as we get informed projections around the volume of regular agenda applications. Next update is around next year free program. This was a legislative program that began a year ago and it technically was said to end on october 31. But it was extended just recently to june 30, 2023, so just refresher on this one, this is a program that waved initial application and license fees for new businesses that were starting that were in the last year. So we were able to waive Entertainment Permit application and annual license fees for this program. Amended ordinance also expands eligibility for businesses to increase the gross receipts for a business to qualify for the tax and fee waiver from 2 million to 5 million dollars. Le and it removes the requirement that the business be located on the ground floor. So the board passed this on second reading and its now for the mayor for signing so we anticipate it going into affect shortly. Just for some data in the first year, we were able to waive 14 total permits, including 8 places of entertainment and one billiard partner for a total of 21,471 waved in application fees which we love to hear. Our next update is on the hiring process for vacant 1840 sound inspect or. This is a parttime information, we have identified our candidate and theyre now going through backgrounding. Were really hopeful that we can introduce them to you officially at our Holiday Party which im going to update you about now. So just wanted to give you a little bit of an update about our upcoming hearings here. A reminder that our hearing on thursday december 6 is canceled were having a Holiday Party in place of that. It is going to be similar to last year, pretty cashl. It starts at 5 p. M. On tuesday december 6 and goes to until 7 30 p. M. So were advertising it as a cocktail party. Its a cash bar and there is a password to get in which is in line with the programming of this bar. So we decided on turn tables as the password. Our hearing on thursday january 23, is also canceled due to holiday and well pickup on january 17th. So tonight, december 20th and january 17th are our main hearings coming up. Commission secretary leon will send a schedule of 2023 hearings shortly and will continue to send polls to check on your planned attendance. I also wanted call for attention about emails for required training for commissioners. Please make sure that youre opening your email to see if you received one from leon, there were a few commissioners on the list that were mission mandatory city trainings. Most of them are due bit end of the year. To make sure to complete those as soon as you can, some of them were marked as soon as possible because theyre overdue. And if you dont receive an email, this means that you have done all of your mandatory trainings and you get a gold star. All right, if you have any questions on that, you can contact may directly. Finally, for you this evening, i wanted to let you know that i issued a directors order for sky lark recently, so we received complaints from a near by business about sky lar proposing safety concerns. So an sspd officer and did a complete place of Entertainment Permit and security plan check. Of the 12 security conditions listed, we observed they were in violation of 7 of them at the time. So we issued a citation immediately and held a meeting with the owner of the venue along with admission station to discuss their security plan and Current Operations. In affect, i went ahead and issued a directors order that required skylar to submit a revised security plan to reflect their Current Operations and to ensure spont operations moving forward. Today is the day that that goes into affect. So well be conducting a followup compliance check to the business to ensure that theyre adhering to the security plan conditions. The only notice i get from trainings is from Entertainment Commission saying that theyre late. There is no earlier communication that i think ive ever gotten asking about them. The next item is number 5 which is a report from Deputy Director. Thanks, good evening, commissioners. I too have a long update for you, so please settle in. The memo is included in the report, your google folder if you want to follow along are the enforcement updates in the tracker. So the first, thing i want to mention is that we have received 7311 complaints. And i have a few rather large updates for you. Please feel free to ask any questions when were done. The first is about adobe books. They are small coop bookstore and hold a coop. We have learned that their events are staffed by veering volunteers who may not know about the neighbor conditions or policy. Since the pandemic, many have brought out a lot more patrons than expected. It has lead to some complaints and large number of patrons congregating in front of the store. This year we received 6, 31 complaints and visited the business 3 times. We issued them a notice of violation for having their door open while having a band inside. And crowding on the sidewalk. Saw at that time front door was open and by the time he parked, and headed over, the performance was done so he was actually unable to confirm. However, did observe a large crowd out doors. Inspect or spoke with the volunteers who were unfamiliar with their permit education. So we educated and showed them a Good Neighbor policy explaining that theyre responsible for keeping the crowd clear. They were issued a citation for these violations. On november 11th, we received another complaint. He observed a large crowd and a person with a blue tooth speaker playing music outside. And explains the reason for the visit. Asked speaker of the outside was not sponsored by the bookstore but it was clear that it was one of their patrons. The next day, they said that the crowd was so big that it stopped two mini buses and people were climbing all over them. While we did not witness this happening, inspect or did take a video of the crowd. It also shows people having actually walked in the street to by pass the large crowd. And finally i received a email from the permit and that eager to be Good Neighbor and create a safe non bar destination for people to gather. So director wyland and i plan to meet with the leader and discuss strategies as this appears to be the biggest issues. Their events are well attended and their capacity cannot hold all of their patrons. So result, people are handing out in the sidewalk. Please let me know if you have any suggestion buzz this and ill keep you apprised. We have received 38, 311 complaints and visited the business 21 times. We received a smraint saying that their window was open during entertainment. The business was otherwise in compliance with the permit conditions. Upon return to go their parked vehicles at 12 00 am, the band was still performing inside of the business . So they went inside and they told the owner that their permit requires them to End Entertainment for them. We issued a sieltation for the occurrence as they had just received a notice of violation for the same violation. This is their 4th citation since november 2021 for having entertainment after 11 00 p. M. As a reminder, the business came back to hearing to discuss their on going violations. Namely for operating after 11 00 am. Staff is recommending that you ask them to come back and potential recontinuing as you all see fit. Inspectors have, there is no more education that we can provide and the citations dont seem to make a long term impact on compliance. This business holds llp from our office. Respond today a 311 on november 5, about loud music and he he arrived there was a dj performing inside. Manager indicated that they had a onetime event for that night. Upon our review of our application database, they have not had a onetime permit since march of this year. So they issued a ticket for violation. Next update i want to provide you with is about the mix, as a reminder of the mix has had outdoor amplified sound for the last 30 years. However they were recently approved to make their Outdoor Activity official with our office. On october 5th, you approved to have amplified sound, sunday through wednesday, until 10 00 am and thursday through saturday until 12 00 p. M. Set up a sound limit for their back patio. They have near by residential neighbors. During the sound test, inspectors identified the value limit which they locked into place with their outdoor sound limit at all times. This is a digital of demark ating and vision the permit holding not to turn the knob past the line which we have done before to help management and staff be consistent. Since the business was granted their peo amendment permit on october 5, we received 16 sound complaints on 10 different days and 15 have been anonymous. Its important to note that some complaints specifically call out noise, crowd noise as the problem, we while we dont regulate, it can squaou. So to solve for this, our inspectors have been check the volume control channel that we mentioned. Next update is about bar parttime, this business also has an llp permit which they use for live entertainment. They also obtain onetime permit that are schedule today go later than 11 00 p. M. Recently have been contacted about their sound and noted the abatement theyve done to the building including suspending their speakers. We did issue them an nov, since then, we have visited the business four more times and have observed full compliance each time. The neighbor is disrupted by the volume of their music and he can hear it when they open the back door. I spoke with one of the owners about the complaint he explained that theyre directly in touch with the neighbor and the practices that they put into place, including sticker garbage bags to muscle the sound of bottles and cans.
