The city Council Passed an ordinance that would allow transgender people to choose bathrooms that correspond to their gender identity. Wbtvs Pamela Escobar is on your side with how the ordinance could be enforced and what it means for you. What can you tell us . Well, i wanted to speak to the City Attorney about this updated ordinance that goes into effect in april but he did not want to sit down. I was able to review memos that he wrote to city councilmembers answering their questions and sat down with two lawyers asking to me if there is a lesson from the Civil Rights Era the statutes need to have teeth and if they dont have teeth you are not going to have broad compliance in the community. Josh says the newly approved nondiscrimination ordinance that includes sex, marital status, family status, gender identity and gender expression does not have teeth because if someone experiences discrimination for one of those reasons they cannot go to court and file a complaint. The public accommodation statute has a weak enforcement provision. Which only allows somebody who has been victimized to make a complaint with the Conciliation Division. And the Conciliation Division has no power to compel a business that violated that statute to comply. The City Attorney wrote in a memo to council the zika viruses voluntary compliance through the Community Relations committee or misdemeanor. Ordinance violations are class three misdemeanors. So presumably if you are a business, club, ymca, and you violate this ordinance, then somebody could be arrested for a class three misdemeanor for not enforcing it. Criminal lawyer brad smith read the ordinance and asked who would get arrested in that case and asks does the ordinance tell a business how to comply with the law when it comes to questions regarding bathrooms . Does it practically speaking set out standards for enforcement . Does it set out standards for how its supposed to be enforced . If the ordinance goes into effect in april, it looks like members of the Lgbt Community and businesses could really end up challenging the effectiveness of that Community Relations board who is going to hear the violations or complaints. Steve, what is he going to do here . Well, paul, we came to the Governors Mansion at his request today and patrick cannon cannon pat mccrory is fuming over the decision by city council. The governor says the North Carolina General Assembly will visit this issue during the short session this coming april. Mccrory says going to the bathroom is a matter of privacy and told us what the Charlotte City council did is an overreach by local government and is passionate about the topic and says it sends the wrong message. I think breaks the basic standards and frankly expectations of privacy that all children alike would expect in a restroom facility or in a locker room facility. And i just i think they are creating a lot of potential problems. Now, the governor told me he has been in touch with at least one city councilmember during the conversations. But he plans on talking to a number of state lawmakers and legislators as they plan on drafting this legislation that he hopes will rescind what was done by the city of charlotte last night. Today state prosecutors eased into asking potential jurors about their experience with alcoholism or substance abuse. At least five of the first 13 admitted they or a close relative had been an alcoholic. They were also quizzed about their experience with ambien five said they took it or lived with someone who did. One woman said she had no issues. Others noticed a change in demeanor. And one woman said she would never drink with it its powerful enough. And prosecutors asked potential jurors a lot of questions about drinking and alcohol, expect that to play into part of their case. I will tell you that the warning use alcohol if you are using that drug. As for the outcome of this case it will depend whether the jury believes sanes actions were voluntary or involuntary. Moving through mississippi, alabama, louisiana but it has its eye on us just in time for wednesday. Things are calm right now. Mainly cloudy skies. And tomorrow we could see another 12 inches why we have the Flash Flood Watch and saturated ground and the winds are picking up on top of that. We have a wind advisory in place 40milesperhour wind gusts and trees could come down and on top of that we have the possibility for severe thunderstorms tomorrow.
