He emerged calm and smiling. Confer with the lawyers, figure out what the next steps are. Reporter offering little comment on what the jury said he did. The trouble began when he ran for mayor of philadelphia, witnesses said his campaign was unorganized and earthquakely ran out of cash. What money he had in the account, prosecutors said, used to pay down his sons College Loan Debt and mounting debt for people who worked for him like a south jersey printer and law firm. When the campaign for mayor needed money, he took an it legal loan from a wealthy friend and used codefendant to pay it back, laundering through a private company. The cash used to repay the loan came from a nonprofit meant to help students go to college, but went into the banking the of the student loan executive, the man who granted the loan. The defense said there was no evidence he knew about the loan or had anything to do with repayment. The jury sided with the federal period of time and found he defrauded a Mortgage Company claiming a car sale provide funds to secure a mortgage for a vacation house. The car was never sold, and he drove it. He accepted bribes from a friend who paid his tuition bill, agreed to buy the car, but never took it from his garage. Now, the codefendants are scheduled to be sentenced in october. We did reach out to the fattah legal team, they are not granting interviews today. Live outside the federal chou courthouse, nbc 10 news. A statement now from the congressman. He says, this is an extraordinarily difficult day for me and my family, a jury decided that based on the evidence presented to them that im guilty of charges presented by the government. He goes on to say while todays outcome is not what we hoped, i expect our nations judicial system and thank the people of the second Congressional District for the honor of serving them. As we mentioned, he was not the only one on trial. Jury came back with a mixed verdict for four codefendants. Peterman guilty on all counts like bribery and bank fraud. The jury found philadelphias businessman report brand guilty on all charges, quicking him of conspiracy to commit wire fraud. Were going to ask for jail time. U. S. Attorney in philadelphia talking about the next step in the case against congressman fattah guilty on ul counts against him. Hopefully our elected officials in philadelphia and elsewhere hear todays message loud and clear. Reporter as they gathered outside the courthouse, federal officials have multiple agencies spread a lesson and message. We hold our Public Officials and staff to a very high level of trust. Reporter saying he breach that. Notably and contrary to the congressmans public per son that as a champion of education, fattah was convicted of stealing caterble funds and federal grant funds used to benefit children in the community. Reporter asked whether he lost a primary but months to go on the term should step down, the u. S. Attorney deferred. This trial is a referendum on his conduct, and other persons will determine what the appropriate steps for the congressman will take. Its not my call. Reporter now, i contacted the House Ethics Committee today, and they have no comment on this. One other interesting note, though, is that they served as a super delegate in the dnc happening here in philadelphia next month. I contacted the Pennsylvania Democratic party to ask about this, and they tell me that the verdict today dont change anything. Hes a super delegate because hes a congressman. Unless he resigns, nothing changes. Live in old city, lauren mayk, nb 10 news. Thank you. The prosecutions kiss, former federal prosecutor joining us. Howard, likely hell appeal, what are chances of a successful appeal . Well, next step for the congressman and sad saga for him is sentencing on october 4th, and after he is sentenced, he would then appeal to the Third Circuit court of appeals, appeal as a matter of rights, and files appeal based on legal errors made at the trial, and rulings that the judge made he feels are against him or Improper Conduct the prosecutors may have engaged in in the course of the trial. All of that is briefed by both sides, and then it goes to the Third Circuit, they review it, oral argument, and a decision on appeal, appeals are generally uphill battles for federal criminal defendants, but theres a chance.
