One that we've talked about in the past is the power to control the border where an executive order carries huge weight with the Supreme Court because it is about a presidential numerate of presidential power as I understand it from the way people have described it to me is that the power is actually not an executive branch power it's there if it's congressional power. And you waited for it the legislative branch which has then passed a series of laws that provide for the ways in which that will be carried out by the secular branch and so it is unclear to the people that I've talked to who are sort of you know constitutional experts why a an executive order or a memorandum as you suggest would really carry all that much weight if it if it potentially does you know president the administration's rationale more quickly to the court and you could do it if you went through that sort of Administrative Procedures Act But it's unclear at least to the folks that I've talked to that that actually carry their constitutional weight with the Supreme Court and that you also get your sources are being disingenuous for this reason you have to ask them then what is your position on the 9 delegation doctrine because I've hated the non delegation doctrine forever I've been teaching con law for 25 years because the non delegation doctrine has Congress pass delegated authority to the president and then the president give it to administrative agencies the Congress has delegated the enumeration power b.
