Septa asking a judge to order the workers back to work requesting an emergency injunction in an effort it is an effort i should say that is not just focused on election day and possible difficulties voters might have in getting to the poll. Septa says there are other harms as well. Septa is asking the court for an injunction ordering twu local 234 employees to return to work immediately. To alleviate the devastation caused by the strike. Reporter septas argument the strike has created a clear and present danger to the Health Safety and welfare of riders and citizens. The authority has never used such an argument before but is citing a pittsburgh case as president s. Septa says theres five groups particularly harmed school districts, school kids, 52,000 of them use septa as a School Bus Service and now they must cross busy intersections, the poor those who cannot afford a car or taxi to get around, the disabled who cannot get to work voters who septa says are in jepp he dee of losing their right to vote on election day and finally, medical patients septa says some are at serious risk due to the strike. Again septa is asking for an injunction to order the strikers back to work as soon as possible. The union has responded saying it will fight the effort tooth and nail saying that collective bargaining is the answer, that only a handful of issues separate the two sides at this point. It happened on the unit block of Spencer Court in lumberton and two brothers ages 24 and 27 are under arrest tonight for murder. Reporter jim, the costello brothers of lumberton are behind bars tonight held on first degree murder charges. They made a first appearance in court via video this afternoon where their substantial bail was continued in this bizarre murder case. 27yearold Christopher Costello of lumberton and his younger brother 24yearold brian appeared via video in superior court today. The costellos are facing first degree murder charges accused of killing a man who lived with them at their Spencer Court home and burying his body in the backyard. I shocked. I dont know what to say. Never think they would do Something Like that. Speechless. Reporter prosecutors say the victim is 23yearold Justin Dubois. He was reported missing by a Family Member october 31st. Im a little scared. All right action News Reporter dann cuellar has arrived on the scene of that huge water main break in the east falls section of philadelphia. Dann what are you seeing, what can you tell us. Reporter jim theres good news to report tonight and theyve made significant progress now. Theyve shut off the water supply to the broken 48inch main. The other good news is that the Shopping Center here sits on a slope so it goes down the water all flowed down below to theres a ravine below the Shopping Center and so now you barely see any water in the Shopping Center. The bad news is that the damage has already been done. There is water inside these stores. The fine wine and good spirits store, the got the look store, the ross dress for less. Theres water inside those stores. Theyre heavily damaged by this. The good news is nobody was injured in this thing. The Fire Department did a fabulous job in rescuing people. They had to use rafts to get them out of there. This is the what im being told the third water main break here in the last three years, they have several 48inch mains here, four of them. Theyre not sure if this is the same water main that broke or another one. Needless suffice to say that some Business Owners here are getting tired of all of these breaks here affecting this Shopping Center but again the good news now is theyve shut off that water supply, people have gotten out safely and everybodys fine. A man who claims that he was victim number two who was seen being abused by Jerry Sandusky in a locker room shower testified for the first time today. Sandusky is trying to get his conviction overturned. Action News Reporter chad pradelli has the story from belfont, pennsylvania. Reporter appellate attorneys for Jerry Sandusky called victim number two to the stand this afternoon. During a Contentious Exchange the man testified he was the boy whom former penn state coach mike mcquery claims he saw being sexually abused in a football facility in 2001. Victim number two testified initially he told prosecutors and then defense attorney joe amendola that he had never been abused by the iconic coach. During the criminal trial victim number two was a defense witness thats until he changed his story and said he too was a victim. He eventually received a settlement from penn state. And appellate attorneys believe prosecutors hid information that didnt help their case. Prosecutors have said they didnt believe the man was credible and definitively victim number two so he was never called to testify during the criminal trial. Its important that we get out what he has said mainly that he was not abused and that mr. Mcquearys statements were incorrect. Reporter Jennifer Storm is a Victim Advocate who spoke on behalf of victim number two who doesnt want to be identified. Its incredibly common for victims of Sexual Violence to not be forthcoming initially. There was so much pressure on this young monday. Reporter over the course of the appeal hearing sanduskys attorneys argued he didnt get an adequate defense because his attorneys didnt have enough time to prepare then believe grand jury leaks hindered their defense. Judge john cle lands told both sides to provide briefs outlining their argument in the appeals hearing by next friday. This track is also shared by septa and the accident has interrupted service from trenton to philadelphia on septas trenton line.
