A judge overturns Brendan Dasseys conviction for the murder of that breaking news now a federal judge has overturned the murder conviction of Brendan Dassey. The Us District Court in milwaukee overturned dasseys conviction. Ordering that he be freed within 90 days unless prosecutors decide to retry him. Dassey had been convicted of helping his uncle kill Teresa Halbach in a case profiled in the Netflix Documentary making a murderer. Here to pick up the story. This is the first domino to fall as a result of the making a murder phenomon. Thats the documentary highlighting percieved flaws in the murder trials of steven avery and Brendan Dassey. Us magistrate William Duffin issued this 90page ling about 3 oclock. He says Brendan Dassey should be released from prison within the next 90 days unless the state of onsin wants to give him a new tria of Theresa Halbach. He was 17 years old when found guilty and sentenced to life in prison. In his ruling us magistrate William Duffin was critical of the investigators and dasseys attorney. But much of the ruling surrounds the interrogation of dassey and his confession. The judge ruled dasseys confession to detectives was involuntary. And his criminal defense was not adequate. Dassey was interviewed fo minor at the time and he had no adult or attorney present. The judge described how detectives coerced a confession from dassey telling him he had nothing to worry about as long as he told the truth. the judge also cites dasseys age and intellecual deficit as a reason the confession should not be used as evidence. If the state decides to give dassey a new trial expect a big fight over whether that interview can be used in thanks steve heres a timeline of key events in the Theresa Halbach murder case on november 3rd, 2005. Halbach is reported missing by her family, four days after going to Steven Averys ausalvage for a photshoot. November 15th, ery charged with firstdeee intentional homicide and mutilating a corpse. On march 2nd, 2006, Brendan Dassey is charged with being a party to firstdegree intentional homicide, mutilation of a corpse and firstdegree sexual assault. On march 18th, 2007. Is convicted of rstdegree intentional homicide. Hes acquitted of the charge of mutilating a corpse. On april 16th, dassey goes on trial. Four days later, prosecutors play dasseys videotaped confession for the jury. On april 23rd, dassey testifies in his own defense, saying he lied when he gave the statement but doesnt know why. Then, on april 25th, dassey is convicted of being party to firstdegree intentional homicide, mutilation of a corpse and seconddegree sexual assault
