As the European Patent Office (EPO) enforces virtual hearings without the consent of all affected parties during the pandemic, its position has fuelled controversy.
Many have speculated that this approach could become commonplace once the threat of the COVID-19 subsides, prompting concerns that applicants’ access to justice could be affected.
The question of the legality of the EPO’s approach is due to be reviewed by the EPO’s Enlarged Board of Appeal.
