The ongoing hearing in the Supreme Court on petitions challenging the centre's 2019 decision to strip Jammu and Kashmir of its special status has brought Article 35A of the Constitution back into the spotlight.
CJI Chandrachud said that scrapping of Article 35A also virtually 'took away fundamental rights of equality, liberty to practice profession in any part of the country and even granted immunity from legal challenges and the power of judicial review'
He made the remarks after Solicitor General Tushar Mehta, appearing for the Centre, referred to the contentious provision in the Indian Constitution, saying it gave special rights to only permanent residents of the erstwhile state of Jammu and Kashmir and was discriminatory
