Trial date set for 2 men facing murder charge

Sean Bryant, 53, and Michael McCauley, 43, are accused in the April 2018 death of 70-year-old Norman. Bryant and McCauley are co-defendants in the case and will face trial together.
The trial date had already been changed three times before the selection of the July 27 date. The proceeding was originally scheduled to begin on Feb. 28, 2020, but was pushed back when Bryant and McCauley’s defense attorneys requested more time to review evidence.
The trial was then repeatedly delayed, as courts were unable to operate normally in 2020 due to the COVID-19 pandemic, said Bryant’s defense attorney David Brooks. Brooks added that it was possible that the trial date could even be moved again, due to the backlog of cases the court system is dealing with. ....

Man enters plea in racially motivated case

Kristopher Lee Breschi, 37, pleaded guilty earlier this month to a charge of assault likely to produce great bodily injury. His sentencing is set for June 4, authorities said.
Breschi was arrested in September 2019 on accusations that he assaulted a 22-year-old man at a gas station on Pleasant Valley Road. According to police, Breschi threw numerous punches, inflicting substantial injuries on the victim, who suffered a concussion from the assault.
Breschi also allegedly yelled racial epithets as he attacked the victim, who is Hispanic, prosecutors said.
“We believe that this attack was racially motivated because in the initial police report, in the statements, there were words exchanged and the defendant used words that mentioned the victim’s race as being Mexican,” said Assistant District Attorney Chris Walsh. ....

Murder charge upheld in Nevada County stabbing death case

A Nevada County judge on Wednesday found enough evidence to hold Michael Stine on a murder charge in the stabbing death of Shelby Comeaux II last fall.
Stine, 60, was arrested after Nevada County sheriff’s deputies responded Oct. 8 to his residence in the 14000 block of Garden Bar Road, and found Comeaux, 48, suffering from penetrating stab wounds. Comeaux, who was renting a room from Stine, was later pronounced dead.
Stine has pleaded not guilty.
During a preliminary hearing into the evidence against Stine in Nevada County Superior Court, witness William Clark testified Tuesday about the events leading up to the stabbing. The hearing continued Wednesday with testimony from Nevada County Sheriff’s Detective Andrew Liller. ....

Nevada County jury finds man guilty on all counts after sex assault trial

A Nevada County jury didn’t buy a defense argument that a 62-year-old man believed a BDSM contract meant he had his victim’s consent, finding him guilty Tuesday on all counts.
Wesley Panighetti erupted while the verdict was being read guilty on three counts of sodomy by use of force, two counts of oral copulation by use of force, and one count each of criminal threats, first-degree burglary, attempting to dissuade a victim or witness, and misdemeanor battery and was removed from court.
The jury also found true allegations of two prior violent felony convictions, in 1996 and 2015. Panighetti is set for sentencing on May 14 and is facing multiple 25-year-to-life terms, said Assistant District Attorney Chris Walsh. ....

Suspect in luring of minor case granted pre-trial release

Three days after a Nevada County judge OK’d a $350,000 bail enhancement for a Grass Valley man arrested on charges of trying to lure a girl younger than 16 into meeting him for sex, the defendant was granted a pre-trial release with zero bail by the same magistrate.
Tyler Michael Clanton, 23, had been taken into custody Saturday night on charges of sending harmful matter to a minor with the intent to seduce, and arranging a meeting with a minor with the intent of engaging in sexual activity, reports state.
At Clanton’s arraignment Tuesday morning in Nevada County Superior Court, Judge Linda Sloven granted the pre-trial release, a move that left Grass Valley Police Chief Alex Gammelgard “deeply concerned about a system that would assess a low risk factor to the type of crime committed in this case.” ....
