High Court judges ignored key issues in ruling on BBI

The High Court declared the BBI process null and void. [Samson Wire, Standard].
The dismissal of the Building Bridges Initiatives (BBI) in totality has the potential, through the judges' interpretation of the law, of injuring the persona of the Kenyan voter. The judges failed to interrogate the constitutional amendment with a view to safeguard Kenyans against perennial electoral violence which the BBI attempted to cure.
Lord Alfred Denning’s would have cited their limitation as having compromised our justice system and their action as a rule of public policy which could be justified through convenience. The question is whether the ruling was made out of convenience other than progressive realisation of our common aspirations as Kenyans; protection of our primary and secondary rights.

Kiharu MP Ndindi Nyoro kicked out of parliament for four days over claims of bribery

Kiharu MP Ndindi Nyoro was on Thursday suspended from the National Assembly for four days for claiming that MPs were bribed to vote for the Building Bridges Initiatives (BBI) Bill.
National Assembly Speaker Justin Muturi had summoned Nyoro and Gatundu South MP Moses Kuria to substantiate claims that some MPs were induced before they voted for the Constitution of Kenya (Amendment) Bill, 2020.
The Speaker asked the Kiharu MP if he indeed called members conmen, cowards, sell outs and traitors.
"Did you make those allegations or not?" Posed Muturi.
The MP said some members used their stomachs and were cowards, traitors and sell outs who bought and some voted because of the directives from their party leaders.

But he failed to substantiate his remarks with credible evidence.
“It is not uncommon in Kenya for members of parliament to be paid or compensated to vote in a particular way, especially when the government has an interest in a matter,” he claimed.
He added; “When the new Majority Leader was appointed because they were not elected…we went to the majority leader’s office and received the $1,000 (about Sh100,000) gift.”
The outspoken MP when pressed to explain why he took the money yet he knew it was illegal he defended himself and said that some legislators were bribed Sh100,000 to pass a Constitution Amendment Bill, 2020.
