Dot radio a lot Talk dot com and go to our pod. We live shows that we podcast and you can search the topic you want to search and find it in our on our website cost at 855 La radio if you want to make a comment or tweet us at Radio law talk I've got to these Turks here myself Frederick Petit and my co-host also over here talk union we're going to talk about billionaires the bizarre 3rd section all battery lawsuit and we're going to state both sides of the argument because I kind of studied his side of the argument the one they're claiming is sexually harassing women and we've got to bring up both sides because really that what's going on is he's getting a lot of publicity because of his bizarre actions but my courtroom in the courtroom and even outside the courtroom in the hallway but we still need to go through logistically a look at a few of the facts here that are allegations the allegations and but some interesting allegations that has me that I'm just shocked about we're going to also talk about the Supreme Court's going to hear Trump records subpoena issue that may whether fight lawsuit why was there a lawsuit we're going to explain that and there's an executive who had a lot to do a survivor the show because the Amazing Race and big brothers that is suing c.b.s. And we're going to tell you why and then at the end we're going to do our Quick Takes which is at the very end of the 3rd hour we do a quick little synopsis of something that we thought was interesting top Denise and I and they are things for you to remember the rest of the week and the best part of our 3 to East is our case or no case that Cal Hunter is going to try to stump us once again on whether or not we have a case or no case so roll it Cal now it's time to play case for new came. Earlier we talked about a free the nipple creation Utah in an earlier hour on the radio a lot of talk and this is not really. Aided in any possible way so this is Kyle Dubois an 18 year old high school senior I believe is in Connecticut in shop class where he was learning how to work with electricity he was finished with this project so he took a day or his friend said Here put these 120 volt wires on alligator clips and attach them to your fried. Chest area shall we say and if he did there was a can a Mountain Dew in it for him well that's a good one though I had to accept a challenge I mean Mountain Dew man think about it yeah so he attached and then they flipped the switch and to put it kindly It did not go well he immediately went into cardiac arrest suffered other medical injuries a cardiac arrest caused a little brain oxygen deprivation His parents say he was left with permanent brain injuries as folks wondered just who was in charge in that classroom anyway and fact there was some allegations that the shop teacher himself may have made the dare. So I ask you Mr pinning are going to start with you it's your turn case or no Ok while this is up my alley Actually it is not that I've done it before but this is a personal injury if I do you know you are not allowed to talk up or not I would say back in the seventy's I would not thought about something like that and not that I'm saying top hasn't already done it but with a lower voltage he does use double a bad battery I also double a battery in a so he's actually he still does look a loon in charge of everything yeah there were you know but you know what here's the interesting thing 1st of all you who used to use soup really this school district is who they would be suing I would think they probably wouldn't sue the kids that they're at him and that helped him do that because really the parents are the only ones that might have money and getting to the parents is going to be difficult but let's say they sue the school again you've got to make a claim and the school district has also some government exceptions and some protections very difficult to sue schools difficult to sue counties cities government entities you can and they win and you can win but they're a little more difficult you've got to go through more steps that's going to be an issue I think the facts are going to bear out how this is going to work I think it was a case I think the issue's going to come down to what happened did the shop teacher know about this let's say he didn't know about this specific instance but knew that these kids were screwing off and doing other things similar to this and he wasn't watching them closely enough so a lot of us can be a fact base but I'm going to say that the kid family wins because ultimately these these teachers have to watch over these kids and what they're doing in this seems like something that probably wasn't just though a quick 2 2nd thing that sounds like people been daring him I don't know what the teacher was doing so case and the family wins Mr Coon and what say you on our case or no case did oh. Ok that's all I'm saying. Like I'm not going anywhere different than Mr Benny Ok Mr Dirk What say you are on our case so fry the nipple Well I'm actually. Well I'm saying you know kind of like a fry festival you know just like this what So you do something I'm just thinking that it could be negligence on the part of the teacher for failing to supervise the kids that are using Lector city. Dang it I just want to be like oh you are going to die oh go for it say no case don't do it let's just like the pressure to do it like the kids like you know fresh the classes or. The clips you know the funny thing is my cousins we had farm cousins right yes and they said yeah they are fresh Yes they had a farm but I lived on a farm that's what they called me our own city and they were farmers for it goes right over you all right and they had us you know grab onto the life trick you know that was something that you're different about and you don't know that we had to know we were from the city to tell you to put your feet in the water too you know they didn't do all that thank goodness already got in trouble for that one and if you're a boy they suggested you somehow oh yeah yeah I got water make contact. Ok I mean as you say. Well he sure sounds like it's an aerial. I'm just going to say no case just to have fun with it and say it's a scenario I think it's a scenario but no case all right Ok well you know you go folks here's the story. All of this myth stuff that we told you and I listed as material fact did in fact occur so those of you who say this was a case that would be Fred and. Yes we were facing these 2 points each now thank God they did one point only one thing but wait but wait parents through the school district and the principal and the teacher and neither side is able to discuss the outcome because there was a pen or a settlement which we win that the principal of the time was forced to resign yes that means they want something I tell you right now it's settled they want to talk to the teacher was signed and they say that the teacher didn't warn the kids about the dangers of electrical cords they went through all these ridiculous and there was of course he did Their working with electricity of course he wanted to but you know what can't you see taught me how I could see this as a teacher just probably egging on a little bit but wasn't paid that let the kids do whatever they want what you got be careful of that yeah all right now I'm going to do it and said Stuart I'm going to do it count down here because I've got Freddie in last place at 14 May next at 17 and tied for the 1st time ever is ahead at 23 I don't know if it's the 1st time ever but I'll take it Ali got to say how you 2 points talk it's 2 points whatever that adds up to Ok well you can give me the numbers here in a minute because we're going to take or we're going to come back and talk about the billionaire boss that we're going to that is being sued for a number of sexual battery lawsuits. This is the 3rd one we're going to talk about and then we're going to talk about the Supreme Court heard Mayweather fight and the executive survivor of Survivor and The Great Amazing Race and big brothers is suing c.b.s. These are going to blow through a comeback that's going to be interesting already a lot is coming up don't go away. That . You're listening to radio lot of talk dot com at Dow back to your host Frederick Penney so Alki David is a billionaire that was inherited a Coca-Cola Bottling franchise error that is worth over supposedly over a 1000000000 dollars with a b. Well he is a little bit interesting fellow. What I want to say is this is this 3rd lawsuit for sexual harassment and or sexual battery I wouldn't employ He and it's usually through it was through these film on you know he's got these film companies that he has but he's the allegations are that he acts bizarre and grabs and gropes women walks around the office and these are allegations naked. With I'm not going into detail because I don't want to go on the radio but a real interesting fellow that's all I got to say and he forces people to watch movies at pornographic movies that they don't want to and so this is the 3rd lawsuit against him he's already been sued and they've won other cases against him civil cases for this and he's you know been hit with millions and millions of dollars of lawsuits and verdicts So this 3rd one is an individual lady who has basically sued for the same basic things that the other women have sued for and the verdict just get I mean the reason I want to bring this up is is there's a lot of background issues that I want to discuss but the verdict just came down for what you know no there's no verdict yes there is that just came down the area around just came down like on Friday or something a place not in our little you know yes it just came down they asked for 10000000 and one area and and 5050000000 but it just came out for 8.2 $5000000.00 that just just awarded and that's it did they get to the secondary part about punitive no this is that this is all it said is I just looked it up they just came down to a point $25000000.00 verdict on this is a case of I'm trying to think at this lady's name but come on come on that's exactly right and she is is I believe Muslim and it offended her in many ways that she felt. It did that it derailed her career or it dear. Her psyche because of her religious beliefs that she felt even more violated than a normal person and I guess this was the kind of the allegation because of her religious beliefs that touching that area is not proper you know. But to me it doesn't matter what your religion is that's improper but here's the interesting thing that people do not know that all you hear about is this guy's crazy actions. The 1st thing is this individual is commonly actually asked after this occurred and this is there are you again this is defense defense arguing this allege that. That the 2 individuals that testified against him claimed prior to this that they that he owed the money so the people testifying against him. Owed him that they were owed money and they were upset so that's an argument of these guys had a way to just get a get go gives them by saying hey since you didn't pay us the money you owe us we're going to testify against you the other thing is caught and said she had suffered a horrible abuse by this guy but they had evidence according to defense that thought a promotion that she was seeking a promotion even after these instances again I am not in any way those of you listening to be saying this is Ok there's this is an exception therefore you know what he did was not improper I'm just telling you we need to bring out both sides of the arguments and so they're claiming if she had such horrible abuse by Mr David why did she kill do you see promotions within the company and that's their argument so and I think what's interesting about the fence think of you as the defense lawyer here all the 3 of us what do you do I mean this guy's bizarre he's yelling at the judge he's yells at the the jury yells to the jury what is it Denise you do to argue in this guy's behavior you know this whack behavior Well I think what happened is that he's so bizarre and that he does not think anybody has any control over him that he 1st and when I say he I mean l.t. David he hung out as companies to dry that's what he did because he refused to go to deposition he refused to produce evidence that he was required in the discovery process and big. Because of that he got sanctioned by the court 1st compelling him to go to a deposition compelling him to produce the documents and when he didn't at trial he got issue sanctions where he can no longer testify he can no longer bring that evidence before the court and he got sanction monetary only as well let me tell you couple of things he yelled out and said This is not not Nazi Germany this is America he went out yelling things to the jury as they're out there but let me just say one quick thing Todd this is how there are more you're arguing and this is the only thing the lawyer could do and this is the argument for don't forget he represents this lawyer represents the companies not him because he was represented the lawyer said quote Mr David is loud aggressive and can be of noxious and he is not to everybody's taste but that does not make him a sexual harasser So that's what Ike what a good argument that's the only thing you could do about a case like this they had to hang on to strings to make arguments trying to save these companies so for those keeping score at home in April it was an $11000000.00 verdict against him and now he's got the $8250000.00 verdict and because they found the allegation of malice the penalty phase for punitive damages starts on Monday to see if there will be additional charges against her dish and all monies videos while this billionaire might not be such a billionaire anymore we're going to come back and talk about Supreme Court and how we're going to talk about Mayweather spy when we back stay with us remember we're live Pacific 9 to noon every Saturday you can tune in then or of course you can also read as a radio long talk don't lie. So we try not to talk about Trump all the time because that's a full time job and it's so political politically charged back and forth on both sides would you like to bring up both sides but we have to bring out what's going on in the issue of the House panel trying this through subpoena trumps records the underlying courts clearing the appellate courts have held in d.c. That trump basically has to open up his books to this House committee What's what's the what's House committee is this I can't remember off the top of my head House oversight committee oversight committee but just recently this week with this is why it's important to bring this up the United States Supreme Court put a halt on all of that and said they didn't they didn't trump didn't when all they did is put a halt on it so the Supreme Court can hear the arguments. And those filings have to be filed by December 5th. Before the Supreme Court to determine whether or not these subpoenas are appropriate and appropriate or not for the House Committee to get all of this his information out top brought up during the break that in these talks and I were discussing this it's. Not necessarily they're asking for his tax returns but he's going to go through the actual subpoena when it said yes and so what we have here is that this subpoena was 1st issued on the 15th of April this year by the House Oversight Committee and what they are seeking from Mazur's Now this Masters is the name of the accounting agency that did Trump organizations finances and it used to be called Wiser masters and so what they're seeking is for an 8 year period information from the following 4 categories but the 2nd category has no time restrictions and opens it up so the 1st one is they want all statements of financial condition. Media your tax return this house during a fishing expedition this as here all statements of financial condition annual statements periodic financial reports and independent auditors reports prepared compiled reviewed or audited by Mazur's USA l.l.p. Or its predecessor wiser Mazur's l.l.p. That's one or 2 without regard to time all engagement agreements or contracts related to the preparation compilation review or auditing of the documents described in number one and then it just keeps going on to where the they want any and all 'd communication basically from any employee in the Trump organization it's very broad and because of the timing of the lower court decision saying yes you have to turn it over there was not time to file an appeal to have it heard to to even see if the Supreme Court would even entertain hearing it and so they've got relief. To allow them to file their briefs by the 5th to see if the u.s. Supreme Court even get to hear it right my understanding is that the entity that they are trying to get the documents from. It does not relate to trump the businesses that relates to Trump himself and his tax filings and that this is a long time I think in excess of 8 years. Accountants and they're also asking for audits correct they are asking among those or the financial information and independent auditors reports prepared by now it is him but consider this here this is number 4 all memoranda notes and communications related to the preparation compilation review or auditing of the documents describe the number one which was all those things including but not limited to all communication between Donald bender and Donald Trump or any employee or representative of the Trump Organization and all communications related to potential concerns that records documents explanations or other information were incomplete in accurate or otherwise satisfactory is wide open right it's very wide open but the with the reality is there's no privileged documents there because and I talked just about this with my c.p.a. That they won't give out the records absent a subpoena but if they get if they're given a subpoena they have to give out the records because the financial records are not enough themselves privileged and there's communications between you and your c.p.a. Are not privileged I mean if you're not is what about if you have Attorney communication within the within the it what it what it all c.p.a. Is a tax attorney what if you are talking with a tax attorney you know you hear this all the time on the radio these tax attorneys offering a call me and we'll go over this and we'll get your past tax returns filed you this and everything is protected because I can perform this service and I'm also your lawyer yeah no I think. That's the conception for sure that's what they've got here I think the argument with all of this is that the House Oversight Committee doesn't have the authority to issue this subpoena this subpoena would be rightly issued in connection with maybe an impeachment inquiry it might be properly given with regard to a criminal inquiry but that the entity it came from is not is beyond the purview of what they can that's the argument that they're going to make that one plays out I think oversight means oversight and part of their directive is that they're supposed to oversee oversee what the different the different areas of our government either so they can the oversight can oversee that you dish area that oversight can see the legislative and they can oversee the executive when they do that that's typically overseeing programs and things that are going on here this oversight is looking into things that happened before Donald Trump was even part of government as a private individual it seems broad but it does seem broad but the remedy here for this though is let's say the court agrees with him and it's overly broad Well guess what entity is going to issue the next subpoena. Adam Schiff over the impeachment inquiry there's just they're going to go here and this is part of the impeachment What were you or they did what does that tell you and we're going to cals like what does that tell you about if you're a business person and want to run for office don't do it hard our past not that we're out of the beyond you know once that opened up further you guys should challenge yourself don't you remember why Trump said he was going to release his taxes because he was in an audit so it goes further what they're trying to see is just exactly and there really it came as a result of Miller and Cohen because Cohen made these statements about Trump making false representations to lenders or false representations to the tax authorities so this is what the oversight is looking at. I would say it's what they're looking at but if he made false statements to. Lenders overinflating that's fraud that's a criminal thing with the d.o.j. Investigated letter and part of the impeachment inquiry of the d.o.j. Well well this is just political this is the problem this is political short trip is over the Justice Department that's why the people will Justice look the Justice Department had no trouble investigating Trump look at the good to hearings that they had Look at all this all of this stuff with Mueller and all of that they got to face a war you know they Yeah I mean come on so I this is just politics guys and political theater here is an interesting thing I want to bring I wouldn't call it theater the night we have a constitutional crisis right now where you've got to have 3 different branches of the law and now we're testing out we're just Lexy muscles all the way around to see just how far but here is each branch of us I think you're right to something agree what I see here is something that's going to affect both sides. On the debt be careful what you wish for because it's going to open up the Democrats now here's what I worry about here's what I worry about I want to say this I've always worried about this. I think people that should be running this government should have some business. Experience I don't think one person has a I don't have a right should be stepping foot in the government unless they've been an employer or an employee there for their full time government you know like people they don't understand reality both understand the rules that the government makes of their effect on the common person trying to make a living and what I'm saying here Ali I still think the difference and if you have somebody that's only been in the business world and never been in politics ever in their life they don't know how the political structure and I don't disagree that here's my point I'm bringing you know it's a crime when I'm bringing up is I worry about people getting cold feet that want to run for a bit run for the offices that have any business experience or had their own businesses or have done that in the past because wow is everything going to be open up I don't care if you're Democrat or Republican I'm running because I'm not opening up everything that we may not have a life may not have qualified candidates yet and I'm in a worst case scenario for the Democrats Trump wins we're reelection but even then it's only 2 terms he goes back into private life he goes back as a private citizen but if you have to turn over all your finances what business person would go in knowing that when their politics career comes to an end everything that they have is now exposed it's very difficult to run a business when everybody knows everything about your finances it's that in the past that way not no no no no it always done that nothing ever really happened not lies before just but I mean you're right to these it's testing it's testing a law right now this is I think never done this I have to say I'm learning a lot about our government Yeah but we're going back and talk about half the fans trying to sue me whether I am the executives behind Survivor executives this week c.b.s. We'll be back lots of action in the law that we haven't covered yet but it's coming up in just a bit right here on radio a lot of talk to stay right there because the program will continue right after this. Of. The laser. Radio. Now back to the show. So those of you who are boxing fans the Mayweather How do you separate Capecchi. Was supposed to be a huge fight in 2015 I remember when this this was this was going to be for the championship and it's a big deal and pay per view had it on an individual's You know we're really excited about this and apparently Pac you know had some injuries that he didn't allow people to know are poor kept a secret. And so there's a number of people that have brought lawsuits suing you know everyone down the line including Mayweather Paki. And all the. Different companies to get their money back for. A fight that was quote basically boring even though it went all 12 rounds and boring because of the fact that he had an injury and he really couldn't fight very well well here's an example of the ticket costs and this is in New York where this this case. And let me back up this one is in the 9th circuit area. But there are going to talk about one that occurred in New York also the 2nd but this is what I want you to understand that's really interesting tickets for this fight started at $1500.00 a seat and got up as high as $231000.00 a seat for a ticket in the secondary market can you believe that commercial subscribers to watch this had to pay up to $10000.00 for pay per view access if you like maybe had a bar or $10000.00 per page if you people that watch pay per view they have to pay so much money and pay per view this was millions and millions of dollars and their argument is look we didn't get what we paid for because what because we didn't know there was an injury to pack you know and that this this was a boring fight now the night circuit court of appeals came down and ruled $30.00 9th Circuit is generally found as being a little bit liberal but it changing what it's like arranging But but here's the point it's why I say $30.00 It's not that often $30.00 happens in any courts but a $30.00 that the score subscribers who paid all this money to this as people quote a yawner or boring won are not going to are not going to be able to receive anything due to the fact a couple of things 1st of all the court held that the plane is devastated no injury well which is obvious what were your injuries Oh I paid money for this but then the biggest issue is this. Follows 1st of all just because they had a shoulder injury he doesn't necessarily mean the fight that would go on it wasn't a normal fight or could have done well and letting this occur this is the biggest issue they were going to open the floodgates to fundamentally alter all professional sports where athletes better disclose all their injuries look Lennox Lewis in my opinion was one of the most boring boxers in all of boxing and he filled the void after Tyson went away and Holyfield won away at Lennox Lewis was in there and if this litigation went forward then everybody who bought pay per view for a Lennox Lewis fight to be able to sue to get it back Amen for not letting this litigation go forward Manny Pacquiao suffered a separated shoulder while he was sparring and it happened about 4 weeks before the fight and he tried as hard as he could and was medically cleared to play the Athletic Commission and I think this was in Las Vegas the Athletic Commission would not have let him fight if he were not medically cleared to fight if you're medically cleared you're able to go and you don't have to disclose that the only people that may have an axe to grind are those people who bet on the fight because clearly laying down money not knowing one of your fighters is hurt. It is is information you would have liked to know and I can't imagine any court allowing the lawsuit to go forward because of the gambling community and so Amen for this decision by the way that Mayweather Pac you know purse was reported to be $300000000.00 Wow The weather was standing to earn approximately $180000000.00 and. Pack you know was going to receive a humble 120000000 so I'm think of my shoulders feeling good Cal If I see let's see we're going to cancel this thing I don't care if it's off drill a hole and put it back together like pin the tail the donkey for 120000000 I think there's an incentive to fight anyway what you think to be absolutely Manny Pacquiao if you ever if you ever want to study the life of an individual study the life of Manny Pacquiao because he's a guy that will not quit he was raised in poverty in the stories told about how his dad had to kill the family dog so they could eat they growing up in the Philippines he was. In poverty like that and then he found his way through boxing competing in the Olympics he's also a politician in the Philippines if I believe he's either a congressman or senator over in the Philippines The man has made something out of his self he's not the type that is going to back down because of a little separated shoulder and let's face it you know yeah it wasn't the most exciting fight but also it wasn't a dog either I mean he put on a show you did his best you know when you put up you know who really put on a show Mike Tyson and the New York state appeals court dismissed the suit when he bit off Evander Holyfield's ear yes there was a lawsuit that sprung up in New York and this is the precedent for this. Lawsuit in Kenya's case it was as well yeah that's interesting so but you know you got to say is the 1820000000 we're fighting you know I'll tell you right now look I was a survivor feel for many years and I enjoyed survivor after a while to be honest you kind of got old because the same thing over and over the Amazing Race is interesting that like one awards for yeah I said years or something well there's a guy named Get main hard and again main hard is a veteran of c.b.s. He was one of the original guys that try to help that that kind of founded some of these I mean don't forget is usually not one person but multiple people that are involved in this but he joined c.b.s. In 1907 he also helped develop the drama. C.s.i. What this guy is though not well known on the outside has done a lot of things for Hollywood on the inside so what's happened is he did the Survivor Amazing Race and big brother and he's arguing that he's he's brought on the company over a $1000000000.00 is his argument. And what he's done is they have said that basically and he's I believe he says he's been discriminated against because of his age and his national origin I believe his dishpan raised an age and they accuse the company of conducting a sham bias investigation against him yeah he's like saying he set me up to fire me right right and he's age 53 but I can't tell the suspended or what but he's of Japanese to step in is the Ok I couldn't tell one way or the other I mean he looks out they see the picture of him I can't tell but what it comes down to is he sues them c.b.s. Claiming that they fired him for improper reasons and they fired him just a few months ago October 2nd he was advised that his position as senior executive vice president of what's called alternative programs was being eliminated and being shut down and then they said his last employer was diverse December 2nd so he's suing them for a myriad amount of money to determine whether or not he's been discriminated against and it goes on and talks about all the background issues here about. You know some of the other chairmen of executives have left the company in September 2018 you know. Accusations of sexual harassment this thing is just starting and the reason I'm bringing all this up is the lawsuits are just beginning and this is what we're going to be be following as time goes on so yeah he's recently just made the reboot of Beverly Hills 910 and that c.b.s. Made for Fox And he also helped with the new version of kids say the darndest things before a.b.c. And hosted by Tiffany Hadash Have you seen that no I haven't it's actually funny it's very funny based on the old Art Linkletter show for many many years ago well guess what I think that's great you guys because I'm sure you have a lot of takes today and one that you can show. Or with us what we would call a quick take so Mr Penny we'll start with you then I see we have found a new business. To compete with I have news that parks a big Why is the lives of people and spends them around 175 times in 60 seconds and we charge them 15 bucks nice All right Mr Cuban What is your quick take to that there are 3 branches of government criminal investigation is an executive branch function not legislative folks stay in your lane and Denise I wish I could respond to that but his dad becoming more attractive Johnny Depp No he needs another lawsuit to be more interesting to radio a lot Tom thanks for being here radio a lot of talk See you next week I'm Frederick County your host with Todd and Denise will be back next week I'll see you next time on radio on talk.
