Like some of the charges will relate to falsification of business records. the idea is they falsely log these payments as attorneys fees, but that would just be a misdemeanor, the less serious type of charge with one year maximum the dividing line between a misdemeanor and felony by the way. is one year if it s one year or less. it s a misdemeanor as the max and if it s above one year, then it s a felony. how could they make this a felony if they can tie those business records to some other crime to some second crime, and the theory here is that second crime could be a campaign finance violation. if prosecutors charge and prove that it s a class e felony, the lowest level of felony in new york state, which has a maximum of four years and finally done we know from our reporting from john miller and others here that the indictment is expected to have 34 counts. that s a lot, but each individual entry in the business records could be its own count out of the trump folks out this weekend, ....

Conviction. we will get to sentencing and then it s all got to go up on appeal. so we are at the very beginning of a long, very long process. let s talk about potential charges. here are john miller broke the news last night. this indictment has 30 plus counts. what could they be? so we know that there s over 30 counts that doesn t necessarily correlate with seriousness. but let s take a look at what it could be if these charges are based on the hush money payments that caitlin laid out, we could be looking at a state charge for falsification of business records. the idea there is if they falsely logged these payments. as attorneys fees that would be a misdemeanor , meaning the maximum penalties one year no one s realistically going to go to jail on a misdemeanor, however. if prosecutors can prove that those records were falsified in order to conceal or commit some other crime, some second crime, then we re talking about a class e felony. that s the lowest class . it goes a to e. okay ....

Pretty good balance. and if somebody comes in and knocks you off balance, even a little. you could fall right off the falsifying business records. how serious i mean, are people i ve been reading that there are a lot of people get prosecuted that for that in new york. it s a misdemeanor, as scott said, which means no one goes to prison for a misdemeanor. there is a way that it can be bumped up to what we call a class e felony. that s the lowest level of felony coz a through e. if they can show that the records were falsified. in order to commit some second crime. there s a little bit of uncertainty about what that second crime would be here. the thinking is a campaign finance violation. these hush money payments were designed to protect donald trump electorally as opposed to personally. even then, though, it s important to know even if that happens, and he s convicted of that, quite likely, he s not even sentenced to prison. if there is an indictment. do we know what the timeline then ....
