Acting on a petition filed by Lt Col Devesh Jayant Joshi of 17 Jammu and Kashmir Light Infantry (JAK LI), a bench of Justice Rajendra Menon and Lt Gen C P Mohanty said that the pendency of a Court of Inquiry (CoI) against the officer cannot be held as a ground to deny promotion.
