I think arizona does have an uphill battle at least at this stage of the fight. the 9th circuit is one of the more liberal courts of appeals. at the same time it will decide this case at least initially by a three-judge panel. there are conservative judges on the 9th circuit that might view it differently. we won't have a feel until we know which judges are on the panel and once we've actually seen the arguments that arizona and the government put before the court. jon: i don't know, i guess it's tough to crawl into the mind of a federal judge, but the arizona law was pretty much written word-...
