Everyone knew it or they wouldn t have gone to such lengths to hide it. and the next question, who else has not been indicted who could be indicted? there s an unindicted co-conspirator in the indictment. he likely was jeff conway. he s the controller of the organization and logically would be a person involved in this criminal scheme. what do you think the stakes are here, zooming out a bit? you talked about how few tax crimes get prosecuted, and one of the themes of the trump era to me is how much wrongdoing has gone undeterred and uninvest gated and unprosecuted at the highest level of american life for so long and trump being the ....

We know that there is something called an unindicted conspiracy, coconspirator in this case. cnn is reporting that that person, or person familiar with the investigation told them that the unindicted coconspirator is jeff mcconney, the trump organization s longtime controller. there s a lot of information in there because weisselberg was the cfo, the controller and the cfo in most companies work very closely together on detailed financial matters and have financial responsibility. what if anything disrupts reporting mean to you? this conspiracy count to me is quite interesting because you have to have an agreement in order to have a conspiracy. then you have to have an act that is further in that conspiracy. the act itself doesn t have to be illegal, but in order to make a conspiracy you have that both that agreement and the act. so, you have to have weisselberg agreed with somebody to engage in the scheme. to enrich himself and to enrich others. ....

Moment. i will tell you, it would seem that there s a better chance that that unindicted co-conspirator is more likely to be somebody like the controller of the trump organization, the controller is an employee of the trump organization, sort of lower level employee, who reported to allen weisselberg. i mention the controller because he has been reported to have appeared before the grand jury. we do not know for sure if the unindicted co-conspirator is him. we don t know for sure. there s a reason this person is not named. we don t have any reason to believe if it s the controller that he has left his employment at the trump organization. as far as we can tell, he is still there. there s always the possibility when an unindicted co-conspirator is pointed to that that person is cooperating. prosecutors said they have not been allowed to talk to any employees outside of the grand jury process. we know that controller spoke with prosecutors within the grand jury process. it remains to be ....

that s right. a lot of people thought it could be the former president. but if you look closely at the charges, it was clear that this person was likely someone who was really involved in the financial side of things. someone who allegedly helped weisselberg conceal this additional compensation and avoid taxes. well, cnn has learned that the unindicted co-conspirator is the longtime trump organization controller, jeff mckind. we know he has testified before the grand jury where he was asked about matters including compensation. all right. thank you for clearing that up. paula reid, stick around. i want to bring in trump biographer and bloomberg opinion senior columnist, tim o brien. he has faced off against the former president in court over the factuality of his reporting and tim won the case. also, with us, cnn chief legal analyst, jeffrey toobin. a former federal prosecutor. jeffrey, this 15-count indictment, how big of a deal is this? well, it s certainly a very big deal for ....

CNN New Day With John Berman and Brianna Keilar June 4, 2024 12:10:00

Someone else, to say there was intentionality here, a pattern of it over years, even then it s still difficult, is it not? it s difficult because prosecution has to prove in any case evidence beyond a reasonable doubt, and here you re proving criminal intent. what s going on in somebody s mind? that s why, again, documents can play a big role here. the documents as for weisselberg, they seem to have him dead to rights. and they also apparently may have testimony of the controller who worked for weisselberg. and in the case of trump, you need somebody you probably need somebody who has talked to trump about these matters and can say, yeah, he knew exactly what was going on. that would be allen weisselberg, which explains the focus on him. how uncomfortable will this be for the former president, the children, the trump children, by the way, who are running the company, how uncomfortable will this be for them the next 12 months? if i owned a small family business with a small numb ....
