Created: May 11, 2021 12:58 PM Another suspect charged in a 19-year-old Moorhead woman's 2020 murder has been sentenced as of Tuesday. According to Clay County court documents, David Marvin Erno, 22, has been sentenced to three years in the Minnesota Correctional Facility-St. Cloud. However, the sentence was stayed for five years. Erno also gets credit for a year served in the Clay County Jail, so he will face no jail time. Erno will be on probation for five years. Twenty-seven-year-old Andrea Payne admitted to knowing that her roommate, Dystynee Avery, had been killed.  Payne was sentenced to 378 days already spent in jail. (Fargo, ND)  --  The man accused of killing a Clay County teen last April is withdrawing his guilty plea and asking for the case to go to trial.  Ethan Broad's attorneys told a judge yesterday he changed his mind, after entering a guilty plea just last month.  Victim, 19-year-old Dystynee Avery, was murdered and dismembered last April.  Broad's sentencing hearing was supposed to be held yesterday and that's when his attorney informed the court he had changed his mind. Dystynee Avery MOORHEAD (KFGO) – A Moorhead man will spend about 30 years in prison for the stabbing death of a friend last April. 27-year-old Ethan Broad has pleaded guilty to second-degree intentional murder in the death of 19-year-old Dystynee Avery, who was living with Broad in his south Moorhead apartment. Broad admitted to hitting Avery on the head with a pipe during an argument, stabbing the woman and slashing her throat.
