Marriage, then olson responded with a question, saying you know, about interracial marriage. why does scalia say that is a key question? well, that really goes to the heart of scalia s judicial philosophy. he is what he calls an original. if he thinks the constitution means precisely what it meant in 1791 when it was ratified or 1868 when the 14th amendment was ratified, he says the constitution doesn t change. implicit in his question was look, in those eras, they certainly were not thinking about same sex marriage. so what he was sort of mocking olson s argument by saying well, if it wasn t true then, when did it become true. and olson s point was we don t keep track of the constitution like a clock. what the point is is that it s unconstitutional today to discriminate against gay people in this way. that was what both sides were getting at in that argument. that s why so many conservatives have turned on ted ....

To the great civil rights issues of our time, and he said that s exactly why the court is here and that s why it ought to rule on the larger issue. jeff, i don t know if you heard, we played the scalia/olson exchange where scalia would say when did it become unconstitutional and he gave some dates for same sex marriage, then olson responded with a question, saying you know, about interracial marriage. why does scalia say that is a key question? well, that really goes to the heart of scalia s judicial philosophy. he is what he calls an original. if he thinks the constitution means precisely what it meant in 1791 when it was ratified or 1868 when the 14th amendment was ratified, he says the constitution doesn t change. implicit in his question was look, in those eras, they certainly were not thinking about same sex marriage. so what he was sort of mocking olson s argument by saying well, if it wasn t true then, when did it become true. ....

Implicit, we re losing the culture wars, we should be more friendly to gays generally, the core of the republican party seems to be going exactly the opposite direction. look what s happening in in virginia and pennsylvania on voter id laws. look what s happening in virginia, elsewhere on gerrymandering congressional districts. if there s one single problem i think the republican party has it is this gerrymandering of districts. because that is the thing that makes the republicans in the house and the senate worried about being primaried. that s what s driving them too far right to be a competitive party in national elections. julian, on that point about the voter id laws and some of the other shenanigans going on, this is yet another area of cognitive disdense. on the one hand you have priebus saying we want to reach out to minority voters. does he not get that we get it that you re trying to disenfranchise our votes at the same time? that s exactly the point. i think what prieb ....

Ambassador? what options truly are on the table if the timeline that the president suggests is the timeline that we should take? well, implicit in saying all options are on the table is that the use of force by the united states is on the table and i just simply don t believe this. i don t think this president will use force against iran s nuclear weapons program, or in what may be the only worst case scenario, or case worse than that is that he would use force but not enough and we could get all the criticism but without the result that we need. i think the president s clear intention is to negotiate for the next four years, and what he fears more than anything else is that israel isn t prepared to accept that timetable, and as it has done twice before in its history will act preemptively in it s self be defense against a hostile state with a nuclear weapons program. jenna: do you think israel already has its mind made up about what to do? ....

Conflicts of interest implicit in contributors to this organization getting access to the president? well, look, i respect fred and respectlook, i respect fred respect his opinion. but the fact of the matter is we are in a battle for priorities in this country. i can promise you one thing. those gigantic republican super packs, funded by a few interests will spend whatever they have to in whatever way, shape or form they must to protect their loop holes in the tax code, to protect tax rates. they will do whatever they have to in order to preserve their special interest. so the president has an obligation it reach out to grass roots and to reach out to as many people as we can to participate in our battle for right priorities for the middle class and retiries in this country. we have to leave it there. congressman steve israel, thanks for being with us today. thanks, andrea. what stories will make the 24 next on andrea mitchell ....
