There is some sort of intent factor that might play into this? >> intent is not so much a factor as consent. if there is sexual contact, and you look at all of the new york codes with which harvey weinstein is charged, everything from rape to criminal sexual act which is for sentencing purposes equally as serious as the rape charges, but whatever the case may be, harvey weinstein's intent would only be relevant if he could argue that he accidentally had sexual contact with these complainants. and that probably wouldn't be a very, very helpful argument to make for the defense. on the other hand...
