Zane Kilian’s lawyer has approached the Western Cape High Court to appeal against a decision by a magistrate not to grant bail to the former professional rugby player implicated in the murder of Anti-Gang Unit (AGU) section commander Lieutenant-Colonel Charl Kinnear.
In the application, Kilian’s advocate Marius Botha argued that the case against Kilian was weak and that the possibility that he would be found guilty was “remote”. Kilian is appealing against the ruling made by magistrate Nonkosi Saba on 18 March, refusing him bail.
The debt collector is charged with murder, conspiracy to commit murder and contravening the Electronic Communications and Transactions Act.

Alleged underworld boss Nafiz Modack was arrested in Cape Town after a high-speed car chase on Thursday.
Lawyer Irfan Parker confirmed the arrest of his client and at least three other individuals near Century City. Parker said the charges were still a mystery but added that he was attending to his client who was being held by police on Thursday evening.

Nafiz Modack: Hawks confirm arrests after high-speed chase in Cape Town
The Hawks said that Modack's arrest relates to "cases of attempted murder of an Advocate, murder of police officer as well as gang related extortion".
Alleged Cape Town gang leader Nafiz Modack has been arrested on Thursday 29 April 2021, with the Directorate for Priority Crime Investigations (DPCI) – better known as the Hawks – swooping on the notorious underworld figure and four other suspects during a dramatic high speed chase.
The arrest of Modack is believed to be connected to the murder of Anti-Gang Unit member and top detective Charl Kinnear in September last year, as well as the attempted murder of prominent Cape Town attorney William Booth.

Alleged underworld boss Nafiz Modack was arrested in Cape Town on Thursday.
Lawyer Irfan Parker confirmed the arrest of his client and at least three other individuals near Century City. Parker said the charges were still a mystery but added that he was attending to his client who was being held by police on Thursday evening.
TimesLIVE understands that Modack may appear in court only on Monday.
Modack's arrest comes a few months after the Hawks arrested his alleged underworld rivals, Mark Lifman and Jerome “Donkie” Booysen, on murder charges.
