Kenya withdraws from ICJ maritime border case with Somalia - JURIST - News

The government of Kenya revealed Sunday that it had pulled out of the maritime border case with Somalia just a few hours before the scheduled virtual hearing before the International Court of Justice (ICJ) in The Hague, Netherlands.
In a letter to the ICJ, Kenya’s Attorney General argued that the COVID-19 pandemic struck right after Kenya had recruited the new legal team therefore the new legal team was deprived of the opportunity to hold necessary preparatory meetings and engagements. Furthermore, the case was not urgent, and, therefore, Kenya did not expect that the court would make this the first case to be heard on its merits via video link despite Kenya’s sustained objections. He pointed out Kenya’s concerns and perception of unfairness and injustice in this matter, which were made worse by the unexplained rejection of Kenya’s preliminary objections to ICJ’s jurisdiction and the dismissal of the request for the recusal of Judge Abd ....

UN top court dismisses Qatar's discrimination case against UAE

The UN s top court has rejected a racial discrimination case brought by Qatar against the UAE.
The International Court of Justice on Thursday upheld the first preliminary objection raised by the UAE that the blockade of Qatar were based on nationality, and not racially motivated.
During the plenary session of the Court at the Peace Palace in The Hague on Thursday, the non-appealable judgment was delivered.
It found that Qatar s attempts to base its 2018 complaint on the United Nations 1965 International Convention on the Elimination of All Forms of Racial Discrimination lacked merit and so the court had no jurisdiction in the dispute. ....

International Court of Justice dismisses Qatar s case against UAE for lack of jurisdiction
Abu Dhabi, 4th February, 2021 (WAM) The International Court of Justice, the principal judicial organ of the United Nations, today upheld the UAE s preliminary objections against Qatar in the case concerning the Application of the International Convention on the Elimination of All Forms of Racial Discrimination, in its final binding and non-appealable judgment.
A plenary session of the Court was held at the Peace Palace in The Hague. The President of the Court, Judge Abdulqawi Ahmed Yusuf, read the Court s decision. Dr. Hissa Abdullah Ahmed Al-Otaiba, the UAE Agent and Ambassador to the Kingdom of the Netherlands, represented the UAE at the delivery of the judgment. ....
