HC says person acquitted of moral turpitude cannot be denied appointment in armed forces

The Punjab and Haryana High Court has declared that individuals acquitted of offenses involving moral turpitude on grounds of reasonable doubt should not be denied appointments in the armed forces. Justice Jagmohan Bansal's ruling came in response to a Haryana resident's petition seeking the reversal of a March 2022 order canceling his appointment as an Indo-Tibetan Border Police Force constable. The court emphasized that denial of employment to an acquitted individual would be tantamount to indirect punishment. It directed authorities to reconsider the petitioner's appointment, citing the absence of an absolute bar on appointment after acquittal in relevant instructions.
