HYDERABAD: The Telangana High Court (HC) got its first woman Chief Justice (CJ) on Thursday with the Central government issuing orders to appoint Justice Hima Kohli, the senior-most judge of Delhi High Court, as the new CJ of Telangana HC. The incumbent CJ Raghvendra Singh Chauhan has been appointed as the CJ of Uttarakhand HC.

The Telangana High Court on Thursday directed Shamshabad Municipal Commissioner to inspect the alleged illegal structures in a land spread over five acres and 12 guntas under survey no. 203 of Shamshabad revenue village.
A bench of Chief Justice Raghvendra Singh Chauhan and Justice B. Vijaysen Reddy passed this order while hearing a PIL petition over inaction of authorities despite illegal constructions in the said land. The bench instructed the Municipal Commissioner to inspect the area and find out if any illegal constructions were going in the lad.
The Commissioner should file a report on the matter and furnish the same to the HC by January 4, 2021, the bench said. The plea was filed by India Fellowship Inc, a registered society, against illegal construction activity by two persons Lionel J Kurut and M. Purushotham.

Action sought for granting fellowships to ineligible students
Telangana High Court on Thursday issued notices to the Centre, University Grants Commission, Osmania University and Kakatiya university over a PIL petition seeking action against university officials responsible for granting research fellowships to ineligible students.
A bench of Chief Justice Raghvendra Singh Chauhan and Justice B. Vijaysen Reddy directed them to file counter affidavits on the matter.
The CBI, which was made one of the respondents, was also given notice.
A student K. Srinivas, who filed the plea, requested the HC to order for an investigation by the CBI into the allegations that students who did not register with the universities for the programmes of M.Phil and Ph.D. were given fellowships.

Telangana High Court on Wednesday issued notices to State government in a writ petition seeking to quash the nomination of Goreti Venkanna, Baswaraju Saraiah and Boggarapu Dayanand as MLCs under Governor quota.
A division bench of Chief Justice Raghvendra Singh Chauhan and Justice B. Vijaysen Reddy passed order to serve notices to Chief Secretary along with the three MLCs. The petitioner T. Dhangopal Rao, a social activist, also requested the HC to instruct the three MLCs not to hold the office till it adjudicated the plea.
Mr. Rao wanted the court to declare action of the Governor and Chief Secretary in nominating the three MLCs as amounting to violation of fundamental rights guaranteed under Articles 14, 16 and 21 of the Constitution. The petitioner, who filed an application to the Governor requesting for his nomination as MLC, appealed to the HC to set aside the ‘non-speaking and unreasoned order’ of the Governor with regard to his application.

Govt. seeks to vacate stay order in Dharani portal PIL pleas


Stay on collection of Aadhaar, caste details of citizens for property registration
The State government has filed a petition in the Telangana High Court on Monday seeking to vacate the order staying collection of details of Aadhaar card and caste of citizens for registration of properties.
A division bench of Chief Justice Raghvendra Singh Chauhan and Justice B. Vijaysen Reddy passed the stay order on this November 3, after hearing a batch of PIL pleas challenging enlistment of properties in Dharani portal. Seeking a direction to vacate the stay order, the government stated that State was empowered to ask for Aadhaar details in all government schemes providing subsidy to people.

Telangana HC Orders State Govt To Remove Aadhaar, Caste Details

The High Court of Telangana directed the state government to delete all the references related to Aadhaar numbers and caste from the registration manual and from the software of registration of non-agricultural properties. On Thursday, a division bench also directed the state government to take measures so as to stop the slot bookings and give PTIN for the registrations till the user manual has been updated.
The bench made it clear that the court is concerned about the protection and security of sensitive data, such as Aadhaar numbers of the people. It however, allowed the government to proceed with the registration without seeking the information of buyers, sellers and witnesses' Aadhaar and caste.

HYDERABAD: The Telangana High Court has put its foot down on the current process of the registration of non-agricultural properties in the State. A division bench on Thursday directed the State government to revise the user manual, meant for the registration of the properties, by deleting Aadhaar, caste and relevant references from it and the software. It also ordered an immediate halt on slot bookings and providing PTIN for the registrations till the user manual is revised. 
The bench made it clear that the court is worried about the safety and security of sensitive data such as citizens' Aadhaar numbers. It, however, permitted the government to continue with the registration without seeking Aadhaar, caste and family members' details of buyers, sellers and witnesses.

TS to chalk out new strategy on registration of non-agricultural properties

Hyderabad: The Telangana government will decide on Saturday whether to file an appeal against the High Court order on registration of non-agricultural properties or prepare guidelines as per its direction.
Chief Minister K. Chandrasekhar Rao will hold a high-level review meeting to chalk out strategy for registration of non-agriculture lands and properties registration in view of the orders given by the High Court on Thursday.
According to Chief Minister’s Office, Chief Secretary Somesh Kumar and senior official of the revenue department will participate in the review meeting. It also stated that the copy of High Court orders hasn’t reached the state government as yet.

HC directs Jalpally Municipal Commissioner to clear Osman Nagar’s stagnant water

Hyderabad: Telangana State High Court has directed Jalpally Municipal Commissioner to clear stagnant water from Osman Nagar, Shaheen Nagar and adjoining areas within 15 days.
The order was passed by a bench of Chief Justice Raghvendra Singh Chauhan and Justice B Vijaysen Reddy after hearing the petition filed by residents Syeda Begum and Syed Bilal.
According to the report published in New Indian Express, the court has also directed him to take necessary steps to prevent spread of waterborne diseases in the locality.
