The lawyer representing Keresi Maya, the disgraced former Naitasiri rugby union player charged for assaulting a referee, has asked that high court to have the charges against his client dropped.
Defence lawyer Sevuloni Valenitabua said in court today that his client has already been penalised.
He said a person cannot be penalised twice for the crime he had committed as this can result in double jeopardy.
Valenitabua said his client is currently charged by the magistrate court in Nausori for a count of assault causing actual bodily harm.
He said his client has already been penalised by the Fiji Rugby Union with a ban of six years from all levels of rugby in Fiji and abroad following the alleged assault.
