Witnesses, but there is no better witness to develop these mitigating factors than jodi arias. i don t see a downside strategically to her to her testifying because she has to establish these mitigating, statutorily defined mitigating circumstances. not a question of whether the jury likes her or doesn t like her. that is an unconstitutional test. she has to show mitigating circumstances and the jury has to balance it, say do the aggravating circumstances outweigh the mitigating circumstances and there is no question that jodi arias has an uphill battle in proving these different mitigating circumstances to potentially save her life. i would say that s absolutely correct. because throughout this trial, she smeared travis alexander s name, the victim, and now she s telling a local fox station it was because she didn t get a plea deal. listen to arias. i was really hoping to get a ....

Spinning the wheels, circling the wagons, moving on to travis family, you better believe they will testify. i have never seen a more involved family and friends than travis alexander s family and friends. they are absolutely supporting the prosecution 100%. i would expect them plenty of testify. the prosecutor s problem is paring it down and choosing who to have testify and who not to testify. these will be very compelling witnesses and very difficult for jodi arias to reach her standard of mitigating or of mitigation by showing some of the factors that will outweigh the cruelty. i mean, this family is going to talk about what a terrific guy travis was, and that will affect the jury. danny cevallos, thank you so much for joining me this morning. thank you. another high-profile case, o.j. simpson back on the stand. will he get his appeal? live to vegas, after this. ....

Second phase was, is it such a cruel murder that the death penalty is justified? the jury again found yes. so now the final phase, which is where they look at the facts of the stabbing, the shooting, the near-decapitation of travis alexander, the victim here, in 2008. yes, it s especially cruel. let s look at the circumstances and see if there are any mitigating effects. you have aggravating and mitigating. aggravating is what it sounds like. these are things that make it even worse than other murders. what types of things? the way was done, the victim, the type of relationship, was this a parent/child? mitigate, a whole list of mitigating things, all done by law. arizona has its own laws on it. to be frank, not a lot of these mitigating factors jump out at you as to whether or not they would apply to jodi arias. of course this is the task of the jury. they must be unanimous. now, what are they looking at contextually? the jury is looking at arias ....

Wanting to be put to death was really just to influence or manipulate the jury in some fashion. shep: when you look at aggravating and mitigating, these are item which is are spell out and it appears to most court observers that the aggravating circumstances are there. yeah. i think that this is a clear case where the cruel, heinous and depraved nature are just overwhelmingly present and i think that the jury is going to come back pretty quickly on the aggravating phase. it s interesting, as long as this trial has taken, both the prosecution and the defense completed the whole aggravating phase in less than three hours. that tells me that both of them believe that this is going to be a pretty quick decision on the jury s part. shep: so the jury will decide either the death penalty still on the table or the death penalty is no longer on the table. then what happens next? yeah. what will happen next is that they ll begin the mitigation phase. that will be a time when the defense ....
